Simply read the documented stories about these people taking payments and than turning around and claiming they did not receive the payments, which then defaults the amount back to the original. That is great you were able to make it through, I commend you, but not everyone is you, nor are all these situations the same as yours. They are garnishing my cousins account and she is disabled.  The money they are taking is from her school loans (trying to get off of disability and goes to school online) and money earmarked for her mother's headstone (mom passed in 2010).  She also cares for her father who has Alzheimer's disease.

I received a call from this place while I was working today.  They were very rude, so I hung up on them.  I have no time to talk to rude people.

Request a Verification of Debt to find out what it is and get it sorted out. I would not suggest ignoring them simply because you don't feel you have any debt.

A "VOD" is short for a Verification of Debt. It is commonly used in collections, foreclosure and most legal language i have heard the term used at every law firm I have worked at.

I got calls in from this number into my cell and I do not have any debt, of any kind.  Haven't had revolving debt, which was always paid on time, in more than 15 years.  No reason for these folks to call me, and haven't left any voicemail.

Don't post things that ur not completely aware of they do have paper work trust me and If u don't just ask for vod validation of debt see for ur self they have original contracts u signed  with banks or credit card company's best thing to do is say ur in a hardship and broke they'll give u a    payment plan of 100 monthly  I'm just really tired of people posting there own opinion on here and in the process people get screwed over because of some dumb guys advise be smart people unless u don't care about ur  wages getting garnished avoid it face it good luck every one

No one here mentions the key word..."old". Every state has a statute of limitations for incurred debt, different lengths of time for different things. It's available on the web in a per state listing. For instance DE is 3 years for open line credit (credit cards). Period. unless you're sued & they're pursuing a judgment. Read the statute & know the law. These "law firms" buy debt for pennies on the dollar. I've simply told them they're operating outside the statute of limitations go pound sand. They launch into some diatribe about moral obligation, just hang up. They may call one more time, but just never take a call again. Best just not to answer in the 1st place.

Who gave you the court summons?  Was it a real process server with a badge?  I was given what looked like legal papers of a case filed SIX MONTHS before the guy handed it to me.  They looking to rattle your cage, that's all.  Don't panic and just relax.  It cost big bucks to file in "Superior Court" (that's what my papers read.) like $190.00  Well, that's a LOT of money for a shot in the dark.  Whatever you do if you get mail from them send it back "not at this address" and the calls and letters will stop.  Remember, they guys buy debt for 1.5 cents on the dollar.  They're not going to file cases only to get a judgement that the debter won't pay.

WRONG!!! They are a law firm acting as debt collectors. Even the messages they leave on voicemail indicate this! I know, as I ignored their calls and letters and am now being sued by them.  Fortunately I know enough about civil law that I am able to respond so they cant just get a default judgement against me.  They represent CACH, LLC the third company (ie...junk debt buyer) to acquire this debt.  Each paying less for it than the one before them.

I can't believe what I've read here. Do NONE of you feel any responsibility to actually pay your debts? I mean really. I  understand maybe you didn't have money to pay at one point but to just odge your bills seems like stealing to me.
I've had times I couldn't pay but in the end I took care of my business.
I think instead of trying to avoid your debt mayne you should try making an honest effort to pay the debt. It's not like they will refuse any money you send them. And if you'r making an honest effort that goes a long way when they take you to court.

I'm not sure I comprehend this poor writing and it's now too late to help Georgie, but I'll respond for the sake of others. You don't "call" an arbitrator, you have to give notice to the collector that you elect arbitration with one of the two remaining companies, AAA and JAMS, the latter being much preferred. That's what nullifies litigation. Then a party initiates with the arb forum, which is analogous to filing in court. Usually you'll have to compel the corporate parties to arbitrate through a court motion, since they'll make a bunch of crybaby excuses why they think they don't have to.

There is nothing to "mess up" with an arb forum. It's merely another place to fight your battle, which shouldn't affect plans for BK. Much more on the topic is found on Credit InfoCenter and DebtorBoards.

Sorry, you can't reasonably ask anyone for a civil action tutorial in a phone number thread. In general, if the prosecutors want you to do their work for them you should avoid it until compelled to. I hope you didn't just file an answer without some idea of what you would do when the plaintiff fought back.
