Debt Collector
Recieved a phone call from Stephen Wilson Ext. 206 today. Recieved a message that he wanted to speak to me reguarding a old location on a pet shop where there were allegedly reports of dog abruise and was owned by me. Mr. Stephens message stated that if we didnot call back he would send the police to our store location and have us incoserated for moving without reporting to the proper authorities without a overlook of our animals. When we were dumfounded by these accusations left by the Mr. Stephens to our employee, we called right back to find out what this was all about. When we (meaning my husband and myself) called back...it was nothing of the sort. This matter was an embarassment to our employee and our self from the false accusations. I asked him to send us a letter via postal service with proper letter headings, so i may contact my lawyer. And on my behalf, have it in writing.

I receicved a call saying there were documents that they were trying to deliver to me.  It was said that a Steven Wilson (Investigator) was trying to deliver court documents with a case number and all.  When I asked them what this was about they said it was either a criminal or civil case against me.  They gave me a number to call which was the 877-423-2652.  When I called they answered "law office" but didn't say the law office of who.  I was given two different numbers with two different extensions to call for information but when I called both numbers and both extensions the same person answered (Eric Frank) he got kind of aggitated because I spoke with him and two seconds later tried to call the other number for the other person and (Eric Frank) answered that line as well and then he seemed to be really angry because I realized what was going on. They tried to scare me with court and it was all over a debt that has been on my credit report for years.  Watch what you are doing with them and make sure you check with a lawyer before doing anything.  This is a debt collector not an investigator that is coming out to arrest you like they make it sound.

Debt Collector
I received a phone call from a Stephen Wilson ext. 206.  He is from the Law offices of Adam Katz.  Said he was representing a payday loan company that had allegedly loaned me money over a year ago.  Said he had all of my personal information including place of business and references...but he would not give me the references nor say if they had been contacted.  He said he would be willing to work with me and gave me a settlement amount of $794.00 that had to be paid today.  I told him i would speak with my attorney and have him get back to him.  He tried and tried to get me to release the name of my attorney.  Told him I was a victim of identity theft three times in two years and my information was compromised long ago.  He said it wasn't identity theft as the company gave me money and they didn't take it out of my account.  I told him it was fraud to try and collect on a debt that didn't exist.  I get these calls at least 3-4 times a month.  Funny, my co-worker received a call from the same law office about a week ago.

i too received threatening calls from this Eric Frank person , unfortunately i did decide to take a "deal" without first doing more research which i admit was my fault because i was informed by my job that someone was there looking for me which actually it was a call that came in to them and they never seen anyone on the property claiming to with sheriffs office , i authorized payments to come from my account to settle this debt (which the "debt" in question was outside of limitations for my state so legally a collector could not take me to court over it ) , after making about 9 payments i came across this forum (too bad i didnt find anything on ripoffreport.com when i checked before giving this crook any money) and i stopped making payments and informed them that i would not be sending anymore money to them , just be careful because they will still try and draft from your account as long as they have your account informaton , anyone know if there is a way that i could get the payments i submitted back since i too was threatened and subject to rude scare tactics to get me to pay this debt that was no longer valid.any help would be appreciated

Eric Frank went as far as to call my father (whom I have not lived with in over 7years) looking for information on my whereabouts. Eric was very rude to my father when he would not give Eric the information he sought. When I tried to call his office (1-877-423-2652 x 209), I got an answering machine calling itself simply "Law Offices." I searched the case number with no luck and when I searched the phone number, this website popped up. THANK YOU to everyone who has posted here, I was very worried that I was in some kind of trouble I had no idea even existed! Now that I know this info, I will not bother returning Mr. Scum-Bags call and I will block his number from my (and my fathers) phone.

Received call from Eric Frank stating he was with Law Firm of Adam Katz.  The caller asked to speak to a Jim Grant.  This is the last of several calls from  to "Jim Grant" over the past year or so from his telephone number.  My husband or I have repeatedly returned the call to advise the caller, or whoever answers the phone, there is no "Jim Grant" at our number, but the calls keep coming.  I Googled the telephone number and saw all of these other postings.  I would advise anyone receiving a call from this number to place a block on this number and/or ignore all calls.

This man contacted me last week.  After his call, I Googled his name and his law offices and found alll these posts.  I was very nice when speaking to him, and he was with me at first.  When I told him I was not sure about him, he cussed at me, and threatened me with going forward in a lawsuit.  Today, he had a woman call me saying she was from County and how they had tried to serve me papers but I was not home.  So sad for her, I am a stay at home mom and student.  WHen i informed her I was home, she got upset and gave me a number to call.  I called and it was Eric Frank.  He then started getting nasty and said he could not give me details on the case, and told me i ws broke, I had not tried to reconcile with them, and he was going to be suing me for 7xs the original amount.  He even went so far to say that he knows I am a single mom, and that I dont have any money.  I believe this was a racist remark, seeing as how I told him I was married the week before, and given my name which is a "black name".  I will sue for harrasment, as he told me he can call me as much as he wants, whenever he wants.  I had no idea people could be so nasty.

I just filed a bar complaint against Adam Jeffrey Katz since he has his employee send me a legal letter on his letterhead who said he was an attorney and he wasn't. If more people report him to the Florida Bar for allowing his employees to practice law on his license, eventually they will shut him down.

This man( Erik Frank) called me today and told me that he was an attorney with Adam Katz in New Port Richey. Told me to cough up 5k or they would sue me and put a lein on our home and garnish our wages and freeze our bank accounts in the amt of 15k. I tried to look up their websight and there is not one. The only business info I could find was in Coral Springs fl. I called the ABA and there were several disciplinary actions taken against this law firm. When I called him back to tell him that I don't think he is a registered debt collector he got biligerant with me and then admitted he was only a paralegal who works for a company who works for a company etc........... when I informed him that it is illigal to misrepresent himself as an attorney he yelled that he never said that he was an attorney. He said he had recorded the previous phone call and I laughed and told him I was so glad he did because I am hiring a lawyer who will definately want to listen to that phone conversation. ( besides he never informed me that he was recording any phone call which is also illigal)  Then he accused me of trying to play the system and said something about a trump card and then said " I won't work with you then. We will just proceed with the lawsuit" Interesting. I will get a lawyer in the morning and post updates.

From Federal Trade Commission Website ? FAIR DEBT COLLECTION PRACTICES ACT
Debt Collection FAQs: A Guide for Consumers
If you?re behind in paying your bills, or a creditor?s records mistakenly make it appear that you are, a debt collector may be contacting you.
The Federal Trade Commission (FTC), the nation?s consumer protection agency, enforces the Fair Debt Collection Practices Act (FDCPA), which prohibits debt collectors from using abusive, unfair, or deceptive practices to collect from you.
Under the FDCPA, a debt collector is someone who regularly collects debts owed to others. This includes collection agencies, lawyers who collect debts on a regular basis, and companies that buy delinquent debts and then try to collect them.
Here are some questions and answers about your rights under the Act.

What types of debts are covered?
The Act covers personal, family, and household debts, including money you owe on a personal credit card account, an auto loan, a medical bill, and your mortgage. The FDCPA doesn?t cover debts you incurred to run a business.

Can a debt collector contact me any time or any place?
No. A debt collector may not contact you at inconvenient times or places, such as before 8 in the morning or after 9 at night, unless you agree to it. And collectors may not contact you at work if they?re told (orally or in writing) that you?re not allowed to get calls there.

How can I stop a debt collector from contacting me?
If a collector contacts you about a debt, you may want to talk to them at least once to see if you can resolve the matter ? even if you don?t think you owe the debt, can?t repay it immediately, or think that the collector is contacting you by mistake. If you decide after contacting the debt collector that you don?t want the collector to contact you again, tell the collector ? in writing ? to stop contacting you. Here?s how to do that:
Make a copy of your letter. Send the original by certified mail, and pay for a ?return receipt? so you?ll be able to document what the collector received. Once the collector receives your letter, they may not contact you again, with two exceptions: a collector can contact you to tell you there will be no further contact or to let you know that they or the creditor intend to take a specific action, like filing a lawsuit. Sending such a letter to a debt collector you owe money to does not get rid of the debt, but it should stop the contact. The creditor or the debt collector still can sue you to collect the debt.

Can a debt collector contact anyone else about my debt?
If an attorney is representing you about the debt, the debt collector must contact the attorney, rather than you. If you don?t have an attorney, a collector may contact other people ? but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney.

What does the debt collector have to tell me about the debt?
Every collector must send you a written ?validation notice? telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don?t think you owe the money.

Can a debt collector keep contacting me if I don?t think I owe any money?
If you send the debt collector a letter stating that you don?t owe any or all of the money, or asking for verification of the debt, that collector must stop contacting you. You have to send that letter within 30 days after you receive the validation notice. But a collector can begin contacting you again if it sends you written verification of the debt, like a copy of a bill for the amount you owe.

What practices are off limits for debt collectors?
Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:
    use threats of violence or harm;
    publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
    use obscene or profane language; or
    repeatedly use the phone to annoy someone.

False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:
    falsely claim that they are attorneys or government representatives;
    falsely claim that you have committed a crime;
    falsely represent that they operate or work for a credit reporting company;
    misrepresent the amount you owe;
    indicate that papers they send you are legal forms if they aren?t; or
    indicate that papers they send to you aren?t legal forms if they are.

Debt collectors also are prohibited from saying that:
    you will be arrested if you don?t pay your debt;
    they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
    legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action.

Debt collectors may not:
    give false credit information about you to anyone, including a credit reporting company;
    send you anything that looks like an official document from a court or government agency if it isn?t; or
    use a false company name.

Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:
    try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt ? or your state law ? allows the charge;
    deposit a post-dated check early;
    take or threaten to take your property unless it can be done legally; or
    contact you by postcard.

Can I control which debts my payments apply to?
Yes. If a debt collector is trying to collect more than one debt from you, the collector must apply any payment you make to the debt you select. Equally important, a debt collector may not apply a payment to a debt you don?t think you owe.

Can a debt collector garnish my bank account or my wages?
If you don?t pay a debt, a creditor or its debt collector generally can sue you to collect. If they win, the court will enter a judgment against you. The judgment states the amount of money you owe, and allows the creditor or collector to get a garnishment order against you, directing a third party, like your bank, to turn over funds from your account to pay the debt.
Wage garnishment happens when your employer withholds part of your compensation to pay your debts. Your wages usually can be garnished only as the result of a court order. Don?t ignore a lawsuit summons. If you do, you lose the opportunity to fight a wage garnishment.

Can federal benefits be garnished?
Many federal benefits are exempt from garnishment, including:
    Social Security Benefits
    Supplemental Security Income (SSI) Benefits
    Veterans? Benefits
    Civil Service and Federal Retirement and Disability Benefits
    Service Members? Pay
    Military Annuities and Survivors? Benefits
    Student Assistance
    Railroad Retirement Benefits
    Merchant Seamen Wages
    Longshoremen?s and Harbor Workers? Death and Disability Benefits
    Foreign Service Retirement and Disability Benefits
    Compensation for Injury, Death, or Detention of Employees of U.S. Contractors Outside the U.S.
    Federal Emergency Management Agency Federal Disaster Assistance
But federal benefits may be garnished under certain circumstances, including to pay delinquent taxes, alimony, child support, or student loans.

Do I have any recourse if I think a debt collector has violated the law?
You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can?t prove that you suffered actual damages. You also can be reimbursed for your attorney?s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector?s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.

What should I do if a debt collector sues me?
If a debt collector files a lawsuit against you to collect a debt, respond to the lawsuit, either personally or through your lawyer, by the date specified in the court papers to preserve your rights.

Where do I report a debt collector for an alleged violation?
Report any problems you have with a debt collector to your state Attorney General?s office (www.naag.org) and the Federal Trade Commission (www.ftc.gov). Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General?s office can help you determine your rights under your state?s law.

Debt Collector
I had a phone call from Mr Eric Frank claiming to be a representative of Adam Katz gave a case number and told me to call him back immediately. When I called back 877-423-2652 x209 a women answered the phone "Law Firm" I was put on hold for about 5 mins. before Mr Eric Frank answered the phone. Upon speaking with him he offered me a one time opportunity to pay back a portion of my debt that he said I owed. He said if I didn't pay it back in 3 business days and if I could not get the money to them in that amount of time the Sheriff would come to my work and summons me to court and that I was being sued for a "Considerable" amount more then the debt owed and that my waged would be garnished for 20 years.

After talking with my lawyer he told me to do some research on this man and see if he is A) legit and B) registered in my state.

The answers to my research are this Mr Eric Frank is a fraud.
