Helen, if this is showing up on your credit score, file a complaint with the credit bureaus.  Even if it was a valid debit, it's far too old for them to be reporting on.

I spoke with a person who stated his name was William Taylor and an attorney. I told him I did not owe the debt they placed on my credit report. I asked him to validate the debt, he said 'no' he didn't have to and would send the debt to an attorney in Alabama to take me to court and I would have to pay court costs, etc. I told him that fraudulant companies have been attempting to collect debts I do not owe and that this has happened before. He proceeded to indicate that 99% of the people are liars. He told me that if I send him the amount indicated by money gram today, he would remove it from my credit report and normally does not do that for anyone. By the way, this guy made me cry because I do not owe this debt and he stated even if I have a receipt- it does not prove it was paid and stated that I cannot prove anyone received payment for a 15 year old bill. This bogus collection has affected my credit score & he was very rude and intimidating! I told him I would sue them. Things like this affect your overall credit rating and interest rate. I cannot believe people sell information for pennies without regard to cleaning up databases or implementing procedures to ensure the rights of people who pay their debts.

Outside of Texas state law, nothing compels a debt collector to ever validate .... unless of course the agency wants to continue contacting and demanding money. Raising and later reasserting a dispute via Cert Mail is wise practice. You can try setting your own response deadlines just to test a collector's intent, but it's not something you can enforce.

The collector slinking away quietly is a common enough response among peddlers of junky and fraudulent debt claims that it's a no-brainer to spend the six dollars in USPS fees to make it happen.

If they refuse to give the info as required by the FDCPA, FCRA, they are scams.  You must ALWAYS, and I mean ALWAYS insist that they send you a validation.  If they refuse, They are out of luck.  If they DO send it, you need to write a formal dispute notice.  More than 90% of the time by my own experience, they don't call again.  I had one recently --gave them 30 days to validate.  2 days AFTER the validation time had passed, they sent letter saying they were investigating.  Been almost 90 days, now.  Not making assumptions, but it's gonna be hard to deny that the lawful time to validate is hasn't long passed, and that it has not yet been done!
