The answer to those hostile threats is not that you "don't have any money". It's "stop calling or be my defendant in a *real* lawsuit". The threats you heard were empty, therefore illegal. The "debt" is probably bogus, another FDCPA violation. Blabbing about it to relatives and co-workers is again illegal. Somewhere in your story is a winning case, paid for by the loser company.

Never let bullies on the phone confuse extortion with debt collection. Honest debt collectors do not typically send their claims straight to a judge, and they don't take your ransom money to broker quick deals with so-called "process servers". There are no secretive "arbitrators", "mediators", or "prelitigation specialists", only sweaty criminals with a script full of bullying remarks. Lawful debt collection is a process, not an ambush, and you are due a chance at each stage to raise a dispute. The agents' horrid threats are empty and their conduct is illegal. Do not reward lawbreakers with your money. Challenge them always, sue them if you can.

This number called my relatives and place of employment saying that I was going 2 be served with papers and threading 2 come 2 my job if I didn't call back. I called these ppl and spoke with some later who was rude and tried to intimidate me. She told me I had an outstanding loan from Advance America and wanted me to pay 120.00 and make payments every 2 weeks until I pay 720.00. I told her I didn't have any money so she said they were going 2 serve me with the paper and I would end up paying 3000.00 in legal fees.

I keep receiving harassing phone calls from this number saying that they have my address and someone will be coming to my home to serve me some papers. I have no clue what they are talking about, and when I asked the representative what was going on, she became very rude and disrespectful towards me. I wish they would stop calling me and threatening me, it is very disturbing.

Do not accept an email - per the FDCPA, your callers legally have to MAIL a debt validation letter showing you owe a debt and that they have the legal right to collect said debt.  Refusal to MAIL this DV letter is a violation of the FDCPA and you should NOT pay them!  More info here:

Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

You are have protection under bankruptcy protection laws - and also, per the FDCPA (Fair Debt Collection Practices Act), you should NOT pay any caller who refuses to MAIL a debt validation letter showing that (1) you owe a debt and (2) that your caller has the legal right to collect said debt.  However, since you state this "debt" was included in your bankruptcy, your caller is in violation of both bankruptcy protection laws and also the FDCPA.

Debt Collector
Just received a call from a Quinn Marks first leaving a message stating I had legal charges and a claim pending against me. I called back (representative gave no name and avoided to give it as i asked) and gave the case number given, She explained it was referencing an outstanding "payday loan" from 2009. I had no problem handling the issue, however I requested an email first with such information before I gave my credit card number.. She explained that in order to get that email as I requested it's a requirement to have my cc number first. I refused so she placed me on hold and went to speak with her supervisor. Coming back with the same information, I explained I have no Idea who or where your calling from and your requesting money but can't provide me something for security and personal records? She then said good luck to you and hung up on me!  Who are you fooling..though the information you have may be very well correct.. I have to look out for myself. Needless to say I called back spoke with someone who had common sense and assisted me..I have yet to receive an email though?

Lady tried sounding intimidating on phone, asking for someone who used to have my number apparently. Said you have one chance before action will be taken against you. Ended the conversation by saying the person's name and adding 'you have been served'. lol
