I keep getting these harassing calls from 'Heather', who claims I need to call immediately as there is a pending court case against me and she needs to be sure I am aware and to get a 'statement to stand on my behalf'.  Excuse me??  Why would I call someone suing me to make a statement to stand on my behalf? Isn't it a lawyer I'd need?

So glad to find you guys so knew this was ripoff.

She gives her extension as 338.  PLUS Heather's voice seems to change a lot, but always same name.

I got a call from "Heather", who had a very odd, robotic sounding voice. She says that I have a court case against me, and to call her immediately to show that I am aware. I called it back, but there was an automated message telling me I would need to pay £100 to get through to an operator and to enter my credit card number!

This is a rubbish scam, and they also called my boss and asked for me.

How do i stop these fuckwits?

They called me today as well as my elderly parents saying that there was a case pending to be filed in my local county court "without my knowledge" if I did not call them today.  I called and they are claiming a credit card balance from 6-8 years ago, which was long since paid by me.  This debt is so old that it is gone from my credit report entirely.  Every state has a statute of limitations on unsecured debt and this one is expired years ago.  Search "unsecured debt statute of limitations" to find out your states laws....most are 5 yrs or less....If you agree to pay even a small part of a debt which is past this age, you can inadvertently reinstate the entire debt......just hang up on these crooked people......Tell them the statute is passedh

I received a call from this number. I called back and of course the person who left the message was "busy" but it so happened that her supervisor answered.  She had my ss# and name. I asked what this was regarding and she told me it was a credit card debt that my ex-husband ran up but unfortunately had my name on it. The last charge on it was well over 5 years old. When I told her it was "out of stats" she responded that the statute of limitations "in your state" (never mentioned my state name) was 6 years. I informed her that I had been in the collection business myself for nearly 20 years and knew the law in this state. She kept repeating herself about the 6 years. I asked for "proof of debt" and she told me she had already sent it. Yesterday I received what she had sent. It was called a "pre-legal demand", not proof of debt. I will be taking this to my attorney first thing next week. Stupid of them to send that to an employee of a collection agency! The account is no longer eligible, in this state, for suit, and by sending this letter they have violated the law by threatening suit when they can not follow through.  If you receive ANYTHING from this group, Accelerated Financial Solutions, check it carefully! They obviously buy "junk debt" and if you make any type of payment it will renew the statue date!

A girl named Ashley has suddenly decided I have "a pending matter" and that I must call immediately, and gives me a reference file number. This is the second fraud agency that has tried this. I have not owned a credit card for 6 years. I just got a letter in today and its website is www.acceleratedfinancial.net

It claims about my citibank card account. Well, I dont have a citybank card account. It claims I owe 4373.28. Sounds good to them.
First of all, I have never owed close to that amount on a credit card.
The letter lets me know I still have the option to remit the balance in full.
Do they think I'm stupid.
These kind of companies use intimidation to scare you into paying them.
Unfortunately it works on some and many have lost many to companies like this.
We need to stick together and call our local police department and report them. This should be illegal since they are robbing people of their money!

Her name is Sarah, same story. Don't ever answer or call back. These are junk debt collectors. They buy old depts for pennies and try to recollect. I now have 11 calls on my messages. M-F at 9:10 am.  They know your county by your phone number. Try to scare u that way. Don't get caught up. They are very corrupt people. Phone call #11 left this toll free number. The number till now has been 757-483-9185. They are getting very frustrated and I am laughing more ea day........

I have received several calls from this number as well as my family members (all of which whom I haven't lived with for over 15 years).  The numbers that they always list as contact numbers are 877-484-5455 or 714-361-7580 or 714-361-7571.  I spoke with one person in August who tried to tell me a $450 CC was now $3800 but of course I could "settle" for only $2300.  I told him I had to think about it because it sounded fishy to me.  Sure enough, I started researching the number and came across many websites, including this one, that showed this as a huge scam.  The most recent kicker was I got a message yesterday from a "Bill Thompson" in the Legal Department so I called him back armed with some more info and I have to say that I have NEVER been treated so rudely on the phone!  I have filed bankruptcy and at that point was on nearly every debt collectors list and not ONCE was anyone ever rude or inconsiderate.  He was actually yelling at me and telling me I was irresponsible for filing bankruptcy!  When I told him I'd like notification of the validity of the debt, oh watch out!  That sent him over the edge!  He told me he couldn't believe I'd ask for that and it was not even legal to ask for it!  He said "by asking for confirmation of the validity of the debt, it was a fast track to a lawsuit!"  Watch out, this company is nuts and a total scam.  I'm taking necessary steps to report them and you should to.

My daughter applied for a few jobs on Craigslist which turned out to be just ads for agencies wanting to "help" you find a job, and since then many calls are coming in like the bogus one from 1-877-484-5455. I'm pretty sure Craiglist is where they got my phone number, so beware.

received a call yesterday and today on my cell, both callers left a voicemail for a sonya which i do not know anyone by the name.. message said reguarding a pending payment, gave me a reference number, things seemed weird so i decided to look up the numbers online.. when i checked the first number i found this website and when i checked the 2nd number it pulled up a mall in the same state i live in.. def not calling them back after all this mess but i dont want them calling me either!

My husband received a call from "Danielle Martinez" today at 4:43pm. She said she needed a statement from him about a pending action in our county. He called her back and they answered "legal department". Now, I'll tell you that my husband is pretty gullible about this kind of thing. Instead of thinking about it critically, he just freaked out. The debt they were collecting on in 11 yrs old and not even on his credit report or anything. They refused to send him a statement and they refused to accept any payment other than a credit/debit card. They wouldn't tell him what company they were either. They told him that Iowa doesn't have a statute of limitations and neither does Arizona - the state he lived in when the debt occurred. I wasn't even on the phone and I could tell it was fishy. But he gave them his debit card number and set up a payment plan. I went online and did some research. Then I made him call them back and cancel the payment plan. We're going to cancel his debit card tomorrow. I can't believe how easily he got freaked out by theses people! I mean, I know it can be scary. I've had my own lovely encounter with agencies like this!

Just be aware that they will say ANYTHING to get you to pay the money. Every state has a statute of limitations - otherwise they could collect on debt that's 30 yrs old! Refuse to pay anything until they send you a statement and validate the debt. You can also file complaints with any place that will listen. So far, I've filed complaints with the FTC and the BBB.

When a collection agency claims to be a Legal Dept - they are violating FDCPA.   By stating legal debt they are claiming to be attorney's or calling on behalf of the county court when they are not.

It also usually means they cannot validate the debt and have no legal right to collect it.

Record calls where you can - check your state government website about recording calls and whether you are required to tell the caller or not.

Can a debt collector contact me any time or any place?

How can I stop a debt collector from contacting me?

If you decide after contacting the debt collector that you don?t want the collector to contact you again, tell the collector ? in writing ? to stop contacting you. Here?s how to do that:

What does the debt collector have to tell me about the debt?

What practices are off limits for debt collectors?

publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
use obscene or profane language; or
repeatedly use the phone to annoy someone.

False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:

falsely claim that you have committed a crime;
falsely represent that they operate or work for a credit reporting company;
misrepresent the amount you owe;

Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:

try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt ? or your state law ? allows the charge;
deposit a post-dated check early;
take or threaten to take your property unless it can be done legally; or
contact you by postcard.

Can I control which debts my payments apply to?
Yes. If a debt collector is trying to collect more than one debt from you, the collector must apply any payment you make to the debt you select. Equally important, a debt collector may not apply a payment to a debt you don?t think you owe.

Can a debt collector garnish my bank account or my wages?
If you don?t pay a debt, a creditor or its debt collector generally can sue you to collect. If they win, the court will enter a judgment against you. The judgment states the amount of money you owe, and allows the creditor or collector to get a garnishment order against you, directing a third party, like your bank, to turn over funds from your account to pay the debt.

Wage garnishment happens when your employer withholds part of your compensation to pay your debts. Your wages usually can be garnished only as the result of a court order. Don?t ignore a lawsuit summons. If you do, you lose the opportunity to fight a wage garnishment.

Can federal benefits be garnished?
Many federal benefits are exempt from garnishment, including:

But federal benefits may be garnished under certain circumstances, including to pay delinquent taxes, alimony, child support, or student loans.

Do I have any recourse if I think a debt collector has violated the law?
You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can?t prove that you suffered actual damages. You also can be reimbursed for your attorney?s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector?s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.

What should I do if a debt collector sues me?
If a debt collector files a lawsuit against you to collect a debt, respond to the lawsuit, either personally or through your lawyer, by the date specified in the court papers to preserve your rights.

I got a call from these clowns today. First a woman who asked if the last four of my social were ****. I asked if it were a debt collection call and she said no. I confirmed the number and she transfered me to a man who was very rude. He indicated that he was calling regarding legal action in the court house about an old credit card debt. I told him several times that I was told that it wasn't a debt collection call, and he ignored me so I hung up. About a month ago I got a letter concering an old credit card debt, saying that they could settle the debt for me for $279/mo for 48 months.  I think this is all a scam. I think that the call is designed to worry the victim, and then you accept the offer in the letter.  They collect your money, and they likely disappear with it.  If you owe money, let them prove they are the people entitled to it by making them take it through court action. I am convinced that this is a total scam.

Got a call from my father telling me he got a call from someone saying they had a "county" matter to discuss with me. Left the 877 number. I haven't lived with my father for over 16 years!

They left a message on my office line too with the 757-484-3309. She said her name was Danielle Martinez and she was going to process "arbitration paperwork without (my) knowledge" if I didn't call back. <sigh>

I was just about to bite the bullet and call them back when I decided to do some research...Thank you to everyone who wrote their comments here...you have all saved me from more needless abuse from harassing debt collectors!

I had a message on my answering machine on 7/16/09 - the name was "Heather" - she said it was urgent that she speak to me regarding processing of D------ H----- (my ex-boyfriend) in Elmore County and that  she just needed to get in touch w/him to be sure he was "up to date" on all the issues regarding his case. I was VERY confused, first of all the message was for "Roberta J." - my name is NOT Roberta - my husband's name is Robert! Not only that but the home we live in was my husband's before he and I got married and the phone number at this residence has always been the same - no affiliation whatsoever with my ex-boyfriend. In any case, I returned the call the next day - asked for the extension that was left for me - also had a case number - I was told by the person who answered that "Heather" was on another line and could she help me - told her I was returning a call and began to explain the confusion - she said to just disregard the call - that thier system just pulls up anyone that had ever shared a residence with DH - she said she would make note of this in the file and we hung up. The following day, my phone rang - I answered and "Heather" said, "Hi Ms. J., this is Heather, did you not get my message?" O.K......LIVID.....I said, "yes, I did and returned your call although my name isn't Roberta!" I told her about the conversation I had with another lady the day before and she said she wasn't aware of that, that she wasn't even at the work the day before...UMMMMMM??????????
I hung up with her and got to thinking about this and it bothered the crap out of me so I called the number back - 877-484-5455 - got a guy on the phone this time - by the way, they ALL answered "Legal Department" - when I asked for "Heather's" extension he asked who was calling and then transferred me - I began asking questions as to how this whole thing came about - how my husband's number he has had since WAY before we even met would show up in some data base that is affiliated with DH - not to mention that they didn't even have the correct name...
This is a scary, and more, an INFURIATING thing - I'm sure there's not much that can be done, but whoever these people are, they've got ways of finding people even if they aren't the right people they are looking for!!!

These people called me today and left a semi-threatening message. I called them back and they were very very rude. Its a $488 debt that was a bank screw up that the bank refuses to fix and I can win in court anyway. After telling them that the girl hung up on me so I called back, talked to a guy who was very rude as well. He refused to let me speak by trying to talk over me and before he hung up on me too he said to make sure I have all my s**t together, to obtain an attorney, and they would see me in court! I would love for a company to take me to court over $488, hilarious! What they dont know is my attorney is laughing her butt off about this and cant wait to go to court against these a-holes. Not only did they violate FDCPA laws they also used foul language, and the company they are claiming I owe the bebt to does not even have me in their database anymore because the debt is 9 years old!

I just got that phone call today. They had my SS # on record... Didn't even ask me for it... she just read it off to me. I told them that it was indeed me. Thankfully here in CA there is a 4 year limit to collect debt and it's been about 6 years now so either way I think if they are real... they are out of luck.

I am worried that if it is a fake, how do they have my last four digits of my SS#?

Dee-I recently recieved a call from a different number, but after doing some researh on it I have been able to link it to Accelerated Financial Solutions. They are a full service debt buyer. I suggest you look up in 800Notes the following phone numbers they have also used:
757-484-3309, 747-484-1123 and 757-484-1388.

I suggest you read all the comments before you talk in any way with them. I also suggest if you have the ability to record any and all phone conversations that you do so. Also, make sure if you send any communications that are done in writing you keep a copy and send it certified return receipt. When and if you talk to them, keep calm and be polite. This will help you with whatever actions you plan to do.
