Debt Collector
Got a message today from a Ms.Cassandra Wilson, a process server for Chesapeake County, saying all of the above ^^^^^. It's crap. but they do have a new number (866-676-2361) and it is on behalf of Check and Credit Reporting INC. Here is some info from a previous post that is very useful. I've danced with this lady more than I could ever care to. Once you metion "file a report" and one of the below agencies, the calls normally stop.

Please do file reports with the FBI, your state attorney general and Department Of Justice,FTC & FCC..

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

Again today, October 25 at 8:16 am.  Phone warrior blocked them.

And again on October 23 at 1:08 pm.  Phone warrior blocked them.

I wonder when they are going to give this up since they can't get through and they can't leave one of their bogus messages.

Beginning to get comical that they keep trying especially when I have impeccable credit.  Makes you wonder how they decide to bother a certain person.

They called me today 10/17/2013. Sent it straight to voice mail, no message left. I have never used a check cashing place or a payday loan cneter. Any debt I have is on payment plans so not sure what this was. This page is where I found out it was some kind of debt collector.

Started receiving calls once again after a couple of weeks from 15ca6a9aaba5.  I still have that number blocked, but I must say they are determined.  They give up and start again.  I still don't know what they supposedly want and I really don't care.

I have phone warrior and the number doesn't get through.  I believe they get a busy signal.  They must have alot of time on their hands to keep bothering me since I have impeccable credit and many people mentioned a pay day loan (don't even know what that it).

Well, they can show up at my door (though I doubt it) and we'll see how far that gets them.

Good luck everyone

Just received a phone call with an id of 15ca6a9aaba5. I answered, but heard nothing & hung up. After researching this page, I'm glad no one answered me. I've never seen letters show up in a called ID before. Hoping to not get another call, but because I answered it, I probably will. These posts I've read are quite unsettling. I hope my child doesn't answer a harassing call, and I hope it's somehow figured out how to track who is doing this to people. Shame on them!

Just received two calls from that odd number and sent them straight to voice mail.  I now have that number blocked in my phone so good luck to them.  They did not leave a message on my voice mail and now they can go bother someone else since  my phone won't connect them.

Do people actually fall for this nonsense?

This women called me and said she was coming to my place of residence to serve me for a 10 year debt.  I called back and she threatened to take me to court.  When I questioned her about the 10 year debt she hung up on me.  I called back to tell her to stop calling and she threatens me with a harrassment charge.  She shows up at my house she will be arrested.  This is against the fair debt collection practices and the federal trade commission.  This company is in violation of many legal practices!  It is a scam don't call for it.  The only thing is they have social security number.

1. Your new number may have been held by someone who really did owe debts.  OR 2. Your name is similar to someone who does owe money. OR 3. The scammer pulled your number out of the air and hoped you'd be upset enough to pay him.  Ignore the calls - chances are the scammer is not even in the United States and they certainly will not be knocking on your door.

I am angry!!! my head is pounding from the stress and I think its against the law to protrait yourself as an investigiator of the law with a summons to appear in court.  I hope they had a good laugh as they made these phone calls in their office.  Iwill be reporting this phone number to the state!!!  this is horrible.  Im glad you all started this blog.. this call was made in richmond virginia.

It's almost getting old to say it - but I received the EXACT word-for-word voice mail as you did -- "Alicia" sure is a busy girl! My goodness, she talks fast - I had to replay and replay her message to understand what she was saying.

I can't emphasize enough how important it is to know your rights under the FDCPA: Fair Debt Collections Practices Act. For an EASY to read & understand summary - check out the Wiki entry or Nolo Press website.

http://en.wikipedia.org/wiki/Fair_Debt_Collection_Practices_Act

http://www.nolo.com/legal-encyclopedia/illegal-debt-collection-practices.html

For example, another poster is correct - you have the right to demand a debt validation demand letter, or a cease-communication letter. Read more about these rights that you have and by educating yourself, you can protect yourself and avoid being a victim to the outrageous tactics these scum bags use to squeeze money out of you!

I'd suggest you check your state's statute of limitations for how many years the creditor has to collect the debt, before the law says it's been too long and they can no longer - LEGALLY - go after you to collect those monies. It's super important to do that because if you make even one little itty bitty payment towards a debt that was, let's just say 12 years old, and you find out that your state's statute of limitations is 10 years -- well, you would have been free and clear of having to repay this debt - but now that you've started paying, you have completely re-set the clock and the 10-year timing begins with the day you give them that first little payment. I speak from experience for a past debt of over $7,000. Don't do something as stupid as what I did!

lastly I would like to recommend a FANTASTIC unbiased financial advisor and credit repair specialist (who also advises people with low credit scores how to obtain a mortgage without paying outrageous interest rates): Her name is Carolyn Warren. She has two web sites - use the urls below:

I received a call today from a investigator HARPER. He said that a complaint was files against me. He didn't say who filed it nor what court it was filed with. He said that I would be served with papers at my residence but he didn't have my address at this time. He said that if I wanted info. about this complaint before being served with the summons that I could call 1-877-498-1496 to speak to the plaintiff directly. He said that I would need a valid form of ID to sign for my papers when they serve me. It sounded crazy that he didn't say who was sueing me or anything real pertnant info. My husband said to call but I said that if they have a complaint against me then I'll wait for them to follow through with their threat. I mean, WHO contacts a plaintif  directly? REALLY!  I GIVE PRAISE JESUS CHRIST. While I was on the computer the LORD said just type the phone number in. That is when I found you guys with the same number and this Harper guys name. The exact same thing happened to me yesterday. I called back today and asked to verify their information. He said their website was broken. I tried to explain that I didn't get a loan from that payday loan. He told me I was on camera. I knew he was lying, because I was unemployed 2002-2006. He claimed this happened in 2004. Got a call from this number yesterday. said I owe money on a payday loan from 2005 and they were going to file 2 charges against me and I would be charged with felony. Of course I vaguely remembered this and being freaked out set up payment arrangements which supposedly have to start tomorrow. After I calmed down and looked up the number found out they are frauds. Called back telling them I had retained a lawyer and wanted their attorneys number or address so my lawyer could contact them. Told me they did not give out that information and why would he want to talk to them it dealt with me. So finally they gave a  fax number for my attorney to send over paperwork because that was the only way they would talk to him. Checked that number and it apparently belonged to a land line which was also bogus even though when calling it it does sound like a fax machine. These people are insane! Also wouldn't give me their address
