Occasionally, I get this phone calls threatening criminal action from a proclaimed debt collector.  When you pin point who they represent and address etc.., they're vague..  When you threaten to report them to law enforcement, most of them hang up.  Good degree of probability, they are a scam.  It's a poor system, that anyone can get access of your credit ratings and report without any authorization.  Government needs to intervene!  And, cudos to the lady in West Virginia who sued and won 10 million from a debt collector and there scam.. Fight back and report them!!!

Received this call from Mr. Himley on two or three separate occasions.. The message is always very stern and almost threatening,but they never really say who they are calling about... I finally called the # back and talked to someone who said they were trying to reach ___________. (not important).. I know who she is, she is my ex-husbands first wife, but I have no idea how to reach her, I haven't seen or spoke to her in 20+ years... But I am very sick of the repeated threatening messages left on my message machine.

We are the Federal bUREAU OF cHECK investigation and looking for Joyce ________. This was a call to my good friend and neighbor who ran over to our house immediately.
We are at the court house and having papers processed to have your arrested for writing a bad check and that you are also defrauding the PDL Company ripping us off..
Look out your window someone should be coming to your home shortly to serve you papers
You will be going to jail for closing your checking account and preventing us from securing money you agreed to pay back. .
And again we called your neighbor because we had no way of getting in touch with you. . I called them back and called them Liars and said you just spoke to me  in the past hour.  My phone number never changed etc. and again I will have a felony after I am served with papers since my intent was to defrause this so called PDL Company

I got a payday loan for my brother who was in the processing of getting disability. . .I am retired have a check coming in. . applied for the loans (2companies for him) bla bla. . .was paying and paying and unfortunately my brother. . had his home broken into and he was murdered. . tHIS quack agency started to call. . saying since I closed the checking account (joint hubby and me) it was in fact writing a bad check and they were going to the court house to get a cease and descest??? I would get calls saying Md.  State Police from a cell phone. . I would get calls and they said someone is coming to your home to have you arrested.. .it went on and on and they even called my good friend saying they were the Federal Bureau of Check Investigation. .(and I am santa claus)  My husband did not know what i DID FOR  my brother. .and hubby had the checking account closed put the account in  his name. . this went on and one. .and than quiet for about 1.6 years.  they were calling my husband on his cell phone who has nothing to do with this re siging the paper work for the PDL. I get a call from the Maryland Court house saying they have some papers they must hand deliver to me??? I asked what it was all about and she said it is sealed. . and she have me the infa 877 # to work out a deal.  .I read later in the week that these pay day loan companies must be registered and licensed in the state of the person who gets the loan. . .I checked and no such company is registered with a license to do pay day loans. I sometimes think I should go see the Md. Attorney General. . .that I should make the PDL Co. fax me all the paperwork. . I am even afraid they will try to send a killer virus to my computer. . these people are dangerous. .


He told me he was taping the conversaton. . bla bla bla. . Later that day I called the # from the court house and asked if this lady worked their and they said no..this was the clerks office. . she even checked the district and the bigger court to see if any action was being taken against me.. noTHING
and she told me sometimes visitors must use their phones and that is why it will show up Md.. court house. . .it is intentional. . .to scare a person. . and I was upset..I've never wrote a bad check in my life but the FLRS said if you close an account you are guilty of writing a bad check???? or that when I got the payday loan . . I was intentionally trying to defraud the company. . .I am at wits end with these SOB's and it is all scare tactics that no doubt are illegal. . In our state before you can prosecute for a bad check. . they must send the person who wrote the check a certified registered letter and must be signed for. . this was never done. . .I think maybe I should  call their bluff and tell them to come get me. . they would also call and say look out the window. . a police officer should be their shortly to serve me. . it  just goes on and on

This company has been calling my teenage daughter's cell phone and my close friends and relatives trying to retrieve information about me. They have also called and left messages on a friend answering machine stating that I used my girl friend for a reference and they are calling to settle a debit and that I am going to be served notice of intent papers. I know that you can't serve notice of intent papers on the phone and the notice should go to my attorney. What can I do to stop the harassing phone calls?

Scott Harrison contacted me stating that I owed a pay day loan.  Refused to send me information to prove authenticity of debt.  Deducted $100.00 out of my account with my debit card.  Claimed he was a process service company and that someone was out there looking for me as he was speaking.  He offered to have this resolved quickly by paying something today and then made payment arrangements for the rest on two different pay dates.  I have since then cancelled my debit card and alerted my bank.  Every time he and some lady who answers the phone get asked a direct question they have to put you on hold and everyone else is always in a meeting and you can't talk to anyone else.  The more you ask for proof, the more upset they get.  After two days of promising to e-mail me information, I cut the strings.  I reported them to the BBB and the FTC.

I rec'd a call last wk from FLR service and they demanded money that day in order for them not to send the police to my address.  Now they want a large payment 11/30/10 which I do not have.  I tried call them today but they have not returned my call as yet.  They also have my bank info to put a debt thru, now i am worried!

I too am receiving calls from the same so called company. When you answer the call there is either a recording that says, " you have been named a person of interest ", or a man states that I owe x amountof dollers and that if i dont pay they will contact my job and have me fired. I dont know if this co. is real or a scam. I know there are scam companys out there that have access to your private info. such as your s.s. number, name , address and so on, they get there info. from tapping into companys that you have done bussiness with you, where you may owe them money, mostly payday advance co., they obtain the information from those companys and then start to call and harrasse you with threats, trying to scare you into paying them. The money does not go to the legal lender, they have nothing to do with the original company/lender that you may have done business with. They are not leget collection companys, one such co. was calling there selfs " the bam group" I contacted an attorney and he found out that it was a scam company, he advised me as to how these companys operate and how they get all your private info.Unfortunetly several other bogus companys have started calling me as well, having obtained there inof. in the same manor. I wish I knew how to stop these callers, or how to find outif they are legit or not. I dont know if the company calling them selfs " financial liability reporting services" is a legal co. or not. I dont want to give them any money if they are a scam company. If you find out any info. on this company please let me know. Any one, HELP !!

so last night i got The call... "You need to pay this amount from a debt taken in 2005 or ELSE". The next thing i did was look up state statutes of limitations. i suggest everyone else do the same. I mentioned this to a Mr. Johnson this morning and was told that the case manager would call me back. still no call. companies like this can be prosecuted under the fair debt collection act for using deception and misrepresentation to collect. the only ones who can have you arrested is the court itself. Also, if the company Is real, they have to send a conformation of the debt within 5 days of initial contact.

Just hung up on the man, who then called me back and told me I was very immature for hanging up on him. I had set up a payment plan and then thought better of it over the weekend, after some research on the internet I found out they are a collection agency not an Attorneys Office. Beware, make them send you a letter via mail, don't give out cc information or anything else. I probably owe this debt, but will only pay once a formal letter is sent to me via United States Postal Service. Good Luck.....

LeeAnna Please read my post below on Debt Collectors/Collection Agency's.  If you talk to them again, tell them you do not discuss these type of matters on the phone EVER!  Tell them if they will send you a statement, you will respond!  Then hang up the phone.  They will tell you they have sent you stuff and you haven't responded (most likely a lie).  They know if you get upset, you will likely pay them.

I have enclosed a letter you can type and send to them once you receive that notice.  They will have to go away.  The Loan was in 2003 - chances are it is past the Statute of Limitations - check your state.gov or your state courts.gov, to find how long the Stat. of Limit. is in your state.

I might open a new email at petmommy@gmail.com to help people like you.  I am not an Attorney, just a consumer who knows the Consumer Protection Laws, and who has fought to lawsuits on my own without previous Legal Experience or an Attorney.  Good Luck to you!!!

The calls made to other people to family members are severely illegal of a Debt Collector/Collection Agency; or even an Original Creditor to discuss your financial problems/status with others.  They are NOT supposed to do that.  They violated your privacy rights. Call an Attorney, or find one online and sue their clever little butts off!!!

You replied a few min. ago, stating you got sued?  Read your states Rules of Civil Procedure.  Put in your Answers to the Complaint,  CounterClaim and Cross Claims for $1,000.00 for each person they called advising of your Legal situation.  

You can meet with an Attorney for a FREE Consultation for help to do this; and what other Counter Cross claims you can include.  If the Plaintiff/Petitioner finds they can have to pay you, if THEY lose;
they aren't so bold, usually.  Also be sure to add 3X the total violations for Punitive damages to due mental and physical durress(?) as a result of their violations.

I am not an Attorney.  I have fought 2 lawsuits on my own without an Attorney.  I am writing from my own experiences, and offering information on what I have done.  Good Luck

Dear Good Credit Score:  

You sound pretty self righteous calling people losers, when you have no idea of each individual circumstance or situation.  And even better yet - why does Federal Law tell me I can tell a Debt Collector/Collection Agency not to contact me anymore, if I send them a letter; if I supposedly owed them money, and am allegedly obligated?  This law is the Fair Debt Collection Practices Act, and a Federal Law.  And if they do contact me again, I can sue them for $1,000.00 each violation, or each time they contact me afterwards.  

Guess you've never had your work hours cut, or your paycheck cut, because of cutbacks, or an illness so you can't work.  What do you do, when the money isn't there, to pay ALL ALLEGED debts!?  What if you barely can pay for your rent/mortgage and utilities?  Obviously you've never been there, or you wouldn't be so judgemental.  

Or what if you wake up to a good paying job, which you had for 15 years, only to find yourself unemployed at the end of the day, and NOT because of anything you did, and/or didn't do?  I hope your safe little world gets knocked off it's axis, so you'll understand, that sometimes it's all a person can do, just to have a roof over there heads, heat, and water; due to NO fault of their own.  

I do hope you someday experience this, so you will have a little compassion for others and their situations!

Check your State for Statute of Limitations.  Sounds like a Debt Collector/Collection Agency trying to collect on alleged debts past the statute of limitations.  Do report to AG when you find out who they are. They are using illegal tactics!

Debt Collectors ? Collection Agencies do NOT fall under Do NOT Call registry, as they are not telemarketers.  However, they do constantly violate other Federal Laws, because us American's don't know the laws to protect us.  They are counting on that.  

- Federal Law says you don't have an obligation to Collection Agencies or Debt Collectors; you can send them a written letter and they cannot contact you after that.   This includes Attorney's in state's other than your state of residence.  The only Attorney's that can sue you, have to be licensed in your resident state.

A word of caution:  Some Law Firms do have Firms in other states, and Lawyers licensed in other states, so you have to do a little research before sending a Cease & Desist (Do Not Call & Go Away letter) to make sure they aren't in your resident state or you're likely to get sued by these #%#&*@!#%&@$^*.  

Once a debt collector makes contact with you, they also have to contact you within 5 days after the first phone call, letter etc., and give you validation/proof or judgment of the debt.  You are not required to ask for it.   They never do this!!!!

This law is known as the Fair Debt Collector Practices Act.  You can get it at FTC.gov; as well as other Consumer Protection Laws.

Most collection agencies, purchase your delinquent debt for pennies on the dollar.  Guess what? It is no longer your debt!!!  You don't have any agreement/contract with the debt collector or collection agency.  Your only agreement/contract was with the original creditor.

Do NOT agree to any payment arrangements, or you'll be creating an agreement/contract, where upon initial contact by the Debt Collector, one didn't exist.  The collection agencies are counting on you not knowing this little bit of information.  

The best advice I can give you is, do NOT talk to these idiots - they will leave you in a frustrated heap on the floor.  They lie, and will tell you whatever they need, in order to get you to commit to paying them.

The lies are illegal, but they honestly don't care, they're probably on commission for how much they collect from you and others like you.  

If you do answer the phone, do NOT give out your employer, social security #, DL #, Credit Card and/or Bank information, or any personal information.  Tell them to send you a written statement & you'll respond. Then hang up.  When you get that statement, google, Fair Debt Collection Practices Act and you'll probably find a letter you can send them   Or:  send the letter I?ve enclosed that I use.  Sign and mail that letter Certified Mail, so you have a signature and confirmation of delivery!!!

In the Law of Novation: if a debt is purchased by another, for that to be a legal owed obligation, a new contract / agreement has to be written and signed by all parties.  Google Law of Novation and read up!!!

No I am not an attorney, just a well knowledged, educated consumer.  I have spent the past 2 years studying various Federal Consumer Protection Laws.  

I wasn't just satisfied knowing I could send a letter to a Collection Agency/Debt Collector and they had to go away.  I read that in the Fair Debt Collector practices Act law;  I needed to know why, what law tells me the reason why I can.

Everything I have typed, I have learned basically on my own through reading, studying, printing out and binding the laws and underlining/highlighting them.  Not to mention the knowledge I have gained on my own fighting two lawsuits without an Attorney.

I was sued by a Collection Agency, and waiting for a Court date. The Collection Agency Attorney, sent us a letter willing to dismiss with prejudice our lawsuit, if I dismiss our Cross/Counter Claim for Fair Debt Collector Practices Act violations.  Oh, I forgot to mention, we do not have an Attorney representing us; and I have not had any legal experience, in the past whatsoever.

I have read / printed & bound, my State's Rules of Civil Procedure and Rules of Civil Procedure - Evidence.  I catch Attorneys on violations of State Rules of Civil Procedure all the time.  And our Judge's let them get away with it.

And for those of you who say pay up and quit being a deadbeat; it appears that you have never had your life turned upside down, because a good job, not high paying by any means, but a supposed secure job, got your hours cut by 3/4.  

And then a couple years later, as you are just recovering, you lose that job.  And when you are in your 50's, a new job is not so easy to come by.  And when that happens, then what?  

Or what about a major illness, guess you've never had that either - too bad.  Maybe if you did, you'd understand why and how people end up getting in financial straights. Not because they chose to, or decided they were going to find loopholes to get out of paying obligations etc.

What if the money isn't there to pay these debts to begin with?  We've been barely able to pay a mortgage, let alone credit cards etc. It's easy to tell someone else what to do.  I hope someday, something throws your secure little world off its axis, and you find yourself in the very situation as some of us here. Maybe then you'd learn it isn't such a cut/dry situation.

Oh, we've struggled.  And the job last hasn't exactly been replaced.  We're still behind in our Mortgage and trying to catch up, as with our other legal obligations.  I can't work because of various health conditions, or I would, including a part time job at least.  My husband started his own company with the tools of the trade, and now contracts for copier, computer, IT technical jobs as he has a computer science degree, and has years of experience in the others, especially the wide format copier / printers / computers.

People, please read the Fair Debt Collector Practices Act; if a Debt Collector violates any one harrassment or other law in there; Federal Laws says you can sue them for $1,000.00 per violation.  Do it, and then THEY can pay off YOUR obligations!!!  

Again I am not an Attorney - but have learned these by my own experiences.  There are Attorneys you could talk to, and I would, if any violations of the laws have occured in your circumstances.  I am posting this strictly to help others maybe have a piece of mind, if they are up all night worrying about financial problems, and sick to their stomach in worry as I have been, and still are in some ways. I am again just a well informed, knowledgable consumer, who has spent hours studying the laws, because I had no where else to turn for help.  If anything I have written, causes you questions, please seek the advice of an Attorney.

Certain situations such as Mortgages and Car Payment loans usually do not apply here; so you may need to seek the advice of a Lawyer for your individual situation.

I got several calls within the last week.They said that they were going to file a suit to take me to court so they could get the money that was owed to the bank, but this cash store is the one that orginally had the check. They tried to tell me that I scammed the back because I did not pay them back. Let you know this two years ago I had a company named United Processing that did the exact same thing this company is doing except last time I paid some of the money so I got scammed and I am not going to let this happen again. It has been over five years that I had that account with this cash store. When these people at this number called and asked abbout this check I said I had paid most of that off and they told me no you haven't. You have not paid a dime on this account. So, I am so glad that I get receipts for a long while and it is a good thing because when I found out that the other people scammed me so I told this lady (Nina Spencer) that works for this company that I already had this business sent to my police department. Se did not say anything but, they have not called back anymore either. BE AWARE OF THESE PEOPLE BECAUSE THEY ARE A SCAM ALSO. PLEASE do your homework before you PAY anybody anything. just got a message from my mom that they called her, and told her that I am in legal trouble and she should help me out. I can see how they received my moms number she was the co-signer of many loans I paid back. they called my step father who is not under my mom's plan. My brother's, who are under my mom's plan. My neighbor told me that she received a phone call asking if she can watch my kids because I was going to jail for writing bad check. I feel so harrased. Hope they do not call  my job, personal phone calls can get you fired.
