Ok found out the following:

Caller is a collection agency called Alliance One.  They collect for a lot of people including payday loans etc ....they do lie about garnishing wages etc ...know your state laws before dealing with them.

Alliance One Collection Agency is a large national collection agency which was formed as the result of the merger of five smaller agencies in 1999. Alliance One Collection Agency specializes in collecting unsecured debt including credit card debt, telecommunications debt, utility accounts, medical bills, and retail charge card debt. Additionally, Alliance One Collection Agency collects debt on behalf of state and local governments. If the Alliance One Collection Agency contacted you about a debt, then they likely used an a collection tactic such as phone calles, dunning letters, etc.

Under the TCPA, a consumer has a right to file a lawsuit and recover $500 for each call that violates the TCPA. The TCPA can also be used in conjunction with the Fair Debt Collection Practices Act in some situations.  

Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.

This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc.  NCO Group is a debt collector that uses automated prerecorded collection calls.  In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc.  Mr. Watson filed suit under both the FDCPA and TCPA.

David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors.  Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call.  Judge Davis wrote;

[The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.

Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.  

So what can you do if you receive "wrong number" calls from debt collectors?

1. Sign up for the Do-Not-Call registry.
2. Save the calls captured by your voice mail or answering machine.
3. Contact a consumer lawyer.

Calls me 5-10 times a day looking for someone named Mary I don't know anyone named Mary and ask them to please stop calling they just call back in about an hour or two and I am getting so very tired of this. I asked him if he was slow, because you just don't get it, to which he replied do I sound slow I said as a matter of fact you do. Stop calling me I don't even know anyone named Mary.

Since they won't deal with you, look up law for you state regarding non-secured credit expiration dates.  For example, in South Carolina it's three years.  After three years, they have no rights to attempt to collect, or harass or anything..... as long as you make no agreements with them stating in writing or by sending money saying otherwise.  Note, the wait begins with your last agreement.  No money, no agreement, three years, no debt.  It can however, remain on your record.  Some may removed it on request after that.

Debt collectors do not fall under the do not call registry; and as such they can call you.  They cannot however, harass you.  If they call you more than once a month; reprot them for harassment at FCC.gov.  Let FCC know that they are debt collecting and harrassing you.  This should get them to leave you alone.

I have had them call several of times! One time they yelled at my husband when he told them not to call back bc we didn't have the money at that point in time, then when they hung up, he called my cell phone! creepy people.. i just received a phone call at 830 at night from them telling me i made my bed now i have to lay in it! they are scumbags, i actually paid them 75 dollars on my debt, then they said they would bring it down to 675 to pay in a lump sum, now some how the debt got up to 1, 056 tell me if thats not crazy! they yell and scream at you when you try to tell them to quit calling, they are like five year olds that are like "well i don't have to stop calling, i will call you everyday all day till you pay it" i thought harassment was against the law?

I moved last year and got a new phone#.  About six months ago started to get repeated calls from this collection agency representing Captial One looking for someone else.  Now I am getting the the call from the same number looking for me for a debt in 2007.  I never had a Captial One card.

Just got a call from that number. when I went to get my friend who is staying with me bc she is homeless, they hung up! I tried to call them back and the phone said the number was discontinued and no longer in service. I did more research and am quite surprised. My number is NOT listed and is blocked and these creeps still got the phone number... I am going to call Verizon and complain.

I keep receiving creditor phone calls. They are calling for the person who last lived at my address. We told them they don't live here. I had the same phone number for 8 years. They asked if it was a landline or a cell phone. Does it matter? One creditor even called looking for my mother-in-law who never even lived with me. They must be really hard up for cash!

This is alliance one. these people are HORRIBLE!! they have called relentlessly due to a credit card i have that's past due. i realize i have this debt, but after numerous attmepts to explain my situation they still continue to call and they are extremely rude!!!! one rep told me to get a job and sell newspapers..when this scumbag has absolutely no idea what i've been through the past 1 1/2 years. i understand a debt is owed, but they are totally out of line, entirely rude and disgusting. if anyone has a capital one card and are past due, alliance one takes over for them and they are terrible people. so excpect a call. and dont be surprised if they ask you to ask other memebers of your family for money. theyll actually try to call for you!!!! scumbags!!!!

receiving 10-12 calls PER DAY from 877-533-3232. if I let it go to voice-mail the robot caller hangs up.  if I answer it, I can hear a phone ring on the other end and it is various people with heavy accents or the call quality is crap because you cannot understand.. When I ask the person to repeat the caller hangs up.

now this really frosts my legumes - I get a person who is understandable and the first thing he or she asks if they may place me on hold - I say no (I mean they are calling me so why do I need to hold??_.. anyway when I say no, the person hangs up.

needless to say this is very annoying - when I call that number I get a recording that the person at mailbox 6514691 is not available, leave message at tone -- I'm sorry this mailbox is unable to accept any more messages.
