It depends on the laws of the state you're living in, but see what the statute of limitations is. If you have not acknowledged the debt (this includes payment) in a number of years they run out of time to collect it. In some states it's seven years, others it's ten years. You can also always ask for validation of the original debt.

Just wanted to give everyone some input to Mcguigan Law Office LLC..... DO NOT give these people any of your information especially your banking info. They will set you up on an arrangement and either Post Date your check or Credit Card payment for the date you have agreed upon. If for some reason you call back to change the amount of the check or cancel they payment altogether they will not do it and instead tell you that is to late even though they still have the ability. If you bank charges you fees for this because of their error they WILL NOT reimburse you for them even though it was their fault. They will call your bank to verify that the funds are there and if not they will change the amount of the payment to what you do have or keep running your credit card until it does clear even though that was not the amount you had agreed upon. Further more when the end of the month comes they will make up bogus checks against your debt to increase there collection totals to try to shine for their client. You will never know this because it will be for a bank that you do not belong to and an acct number that does not exist. The shear amount of NSF, Invalid accts numbers and unable to locate checks they receive every month is absurd. And as far as verifying funds with your bank even if your bank says the funds are not available the managers will still run them because they have a number they have to hit to get commissions as well as the collectors. I would suggest and complaints to be filed go directly to first CFPB, 2nd Attorney General and also their Client who purchased the debt Square Two out of Denver, Colorado. The will use many illegal practices to try to collect a debt from you and use the name only Law Office to try to scare you into paying the debt. They will say "have you ever been sued or garnished for a debt" which is a scare tactic to make you think they are going to sue you. They will also say that the client has requested suit against you which again has not happened. These are all illegal tactics that they will use under this Atty name to make you think that you are being sued but in reality the owner Larry Weil will not put out that kind of money as he is to cheap and has trouble just making payroll every month when employees have to wait to cash checks cause he has not deposit funds into the account yet. Also when these people call you make sure they are saying that they are a Non Attorney Legal Assistant and that All calls are monitored and recorded for quality control and compliance purposes and that this is an attempt to collect a debt by a debt collector and any information obtained will be used for that purpose.  They are required by law to say this WORD FOR WORD on all calls inbound and outbound. If not then this is money in your pocket as they will settle out of court. Also look up FOTI and NON FOTI messages as to what they have to say on your answering machine and they are NOT allowed by LAW to leave any message at your place of employment even if your office ID's your by your full name.

FOTI
This message is for ________ if I have reached the wring number for this person please call me at _____ so I can remove your number. If this is not __________ please hang up. If this is  ________ please continue to listen to this message. _____________ you should not listen to this message so that other people can hear it as it does contain your personal and private information.

This is (Collector Name) calling from McGuigan Law Office. Federal Law requires me to notify you that this is an attempt to collect a debt by a debt collector and any information obtained will be used for that purpose. Please call me at 877-543-6152 and when calling please refer to ID Code E(last four of your SS#).

This message must be said word for word and is the only message they are allowed to leave on your machine. Any deviations is a violation and you have a suit against them.

Have fun and keep you lawsuits coming in against him. And Michael McGuigan is just and attorney who works for Larry Weil in name so everything is done by Larry himself. Michael is actually a very nice person but he is probably the 4th attorney who Larry has used because they all leave as he keeps screwing them all over. If you have any questions just post here and I will answer them for you.

Marvin Harris called my home at 8 P.M. on a Monday Night  and told my husband it was very important that I call him back ( I was visiting my grand children at the time) he left some bogus reference number.  I called back the next afternoon from my cell phone and got an answering machine.  I left a message as soon as I hung up my phone rang and a man said "can I help you?" I asked who he was and he said Marvin Harris. He told me he was looking for my son, that he needed to speak to him right away it was urgent that there was no "verifiable" number for him.  BALONEY!  His number is not unlisted.  I told him not to call my phone again I would consider it harassment.  When I asked my son about him he said the guy has been sending him "paperwork" on a bill he supposedly owes for about 2 years now but it alwys seems to get lost in the mail.

I receive calls daily from Marvin Harris with the McGuigan Law Office.  He is very rude and nasty.  He said they had my account since November but didn't call me until February.  Claims I owe Sears $6000 but they will settle for $2100 if I give them a post dated check.  He calls every day and each time the settlement offer changes.  Do not talk with these people

You are sooooo full of it.  First of all, anyone with an 8th. grade education knows that debt is a civil matter NOT a criminal matter.  You CANNOT be arrested for debt.  Clearly you work for these people as does the post before you.  Get an education, get a job serving others instead of hurting them, and try..please try not to look so stupid when you post.

This law firm sued me they are real i had the sheriffs serve me and they posted a property sale for my personal belongings in my home they tagged everything in my home and said if i removed anything id go to jail. So of course i paid my bill in which i had the money to do the whole time. I just didnt want to payan old credit card that i couldnt use. Message to all banks and law firms in this enocomy need the accounts paid. Everyone should step up like me and pay because maybe the banks would lend money to families that need it again if us people in debt would just pay back what the abnk thankfully gave us . So people start paying your bills and stop saying these people are scams because you and ypur family members are deadbeats and dont pay there bills.

I had the same experience. They were very rude, one person actually asked me 6 times if I was listening. I told them I would call back and actually contacted the company that the debt was through and informed them how rude the firm was being. The original company then in turned contacted them and had a manager call me directly. It seemed to work out a little better

This is a collection/law firm. I have worked there for about 4 months. And the collection tactics from some of the employees is just atrocious, unprofessional etc. I have been in the business for 20 years  and made a good living in it. You just need to provide correct information to the intended consumer and talk to them as you would want to be talked too.   Another input Nick Sacco is a good person and usually personable and jovial. He must 've had a bad day.    Not all collection agencies and collectors are rude and obnoxious. And also a lot of the delinquent debts are bought and sold from company to company. It is hard to exactly know what the debt is  owed.  Most clients  give the original account numbers, open date etc.   So For people who are rude and obnoxious about collectors, Pay your debts and  you will not have to be subject to rudeness and be polite with these people, they are only  doing their jobs to support their own families and pay their debts also.....

I had an outstanding debt that I could not pay, because I lost my job. I did get a new job, but my pay was decreased by over half. This law firm contacted me at my new job and told me that they were going to sue me and garnish my wages. They said they could workout a settlement with me, but I had to give them three post dated checks for $953.  They told me after the last payment they would send me a letter showing the debt resolved and it would be removed from my credit report. I made the last payment in September. I never received the letter. I just got a call tonight from them tonight telling me I had to pay the rest of the debt. I cannot pay anything else and I would have never agreed to such large monthly payments if it were not going to be settled!  I am freaking out!  What can I do to stop this?

state.  What can be done about this harrassment and fraud?

Since I didn't recognize the incoming number (651-346-7371), I declined to answer and let it go to my voice mail. The female caller provided her name as Asia Branch and said they had an important business matter to speak with me about. They provided the toll-free callback number of 877-543-6152 x139.

The caller sounded very smooth in the message left which leads me to believe they have been doing this for quite some time.

The McGuigan Law Office is totally unprofessional.  I received a telephone call at work that they were going to sue me for a debt  that was forwarded to them within the past week. I called them back after work, and politely informed them that I could not receive telephone calls at work, and asked that they call and leave a message on my home phone.  I explained I received a dozen different toll-free telephone calls recently, but no messages.  I assumed they were telemarketers.

They offered me a lump sum payment option, but stated the offer would only be available for two days.  I agreed that I would let them know if I could obtain the funds in two days.  They, then, required a payment of good faith, which I emptied my checking account and submitted a payment.  The very next morning - (less than 24 hours) they called my home phone twice and called me work again, after I politely asked them not to call me at work the day before.

I returned the call at lunch, and assertively explained again that I could not receive calls at work, and asked very nicely not to call me at work.  Then, in an attempt to pay the outstanding bill, I tried to remind them that the agreement was made for two days.   The person on the other end of the telephone replied really rude, and suggests that I sell my car to pay the bill, and to give them a post-dated check right away to escape legal actions.  In explaining that I did not have the funds available, but was working on it, he told me that I am not trying to resolve this bill.

I asked them if I pay the lump sum, what proof would I have of it paid in full.  They stated they could send me a letter.  With the illegal practices, and unsavory debt collection methods, I wish I could be sure that they can be trusted.  The original debt was a revolving credit card that increased with every payment made.  The reduced lump sum is actually a reduction in the already made payments.  If anyone has additional information relating to this aggressive collection agency that shows no sense of humanity for the consumer - that they seem to advertise on their website, http://mcguiganpalaw.com/  please post your comments.  On their website they state the following:  "McGuigan Law promotes collections with compassion in its collection process. We understand that just because you have a debt it does not make you a bad person. In this economy many people have become debt-stressed consumers and we want to assist you to clear your credit, not beat you up over it."  I do not believe that the arrogance received from dealing with this firm can be justified by that website.  I am not a bad person trying to escape bill collection; I am like so many other Americans trying to survive.

McGuigan Law Office - Marvin Harris called me today AT WORK!!!  He claimed he was a Legal Representative and was collecting a debt.  He stated if we did not pay the debt right then and there that the Sheriff's department would force themselves into our house by breaking down the door and seizing all our belongings that totaled our debt.  The thing is, I don't even know what debt he is talking about.  When I asked he was EXTREMELY RUDE.  I told him I had to hang up as it was my work number and that's when he threatened AGAIN with breaking down my door.  On numerous occasions during the phone call he called me liar.  How can we protect ourselves from this type of harrassment?  What steps can I take to keep them from harrassing me at work?  Also to mention, this debt was supposedly my husbands and they now feel it's ok to "shake me down" for the payment.

Any help is greatly appreciated!

Wow!!! I am in so much shock! I knew these people were shady from the beginning! When the lady over the phone insisted on getting my debt card number or my personal checking account number that instant, I knew something was wrong! NEVER GIVE YOUR BANKING INFORMATION OVER THE PHONE! I have filed complaints against them for calling me at my work place when I have asked them plenty of times not to! I also looked them up atht BBB and they don't exist! I looked up the address and it shows nothing but trees and bushes! Now I know they are out to scam people for their money!

What a ruse- woman leaves message for two names NOT related to my husband's LLC (one person) company they are calling.  Funny, the incoming caller I.D. shows as 332-0895 w/ NO area code.  Left long drawn out message "(insert heavy sigh)...I need you to call me immediately.  Oh, boy.....(pause)  have your file # ready."

I delete and call their toll free as a courtesy to let them know.  Merely answer phone as "Law Office" & get transferred- deep voiced guy I get transferred to says "WHY didn't you write the case number down?" as IF IT'S MY JOB.  Not my problem- good luck with that but if you call me again, see what happens.

You, madam, are an insipid cow.  Law of Novation...WTF are you even talking about.  You claim you have spent the past two years becoming an educated consumer.  Perhaps, you could have better spent the time finding work to pay your bills.  Perhaps, if you had tried to work with your creditors, instead of attempting to weasel your way out of paying your legally owed debt, you wouldn't be in the mess you are currently in.  If I were you, I would be quite ashamed, being in your '50's an still not having learned how to be a responsible and mature adult.  You saw absolutely NOTHING wrong with using your charged off card like it was going to pay itself off, then cry and whine when you're called on the carpet and told to pay it yourself.  Life happens lady...layoffs, illnesses, death...Again, if you had been a responsible adult that didnt use her credit card like she had carte blanche you wouldnt have found yourself in the irresponsibility laden mess you are in.  It's debtors like you that make it harder on the honest, responsible people that work out arrangements with their creditors. Its debtors like you that force credit issues to raise interest rates and charge additional fees as a way to combat the ever growing amount of unpaid debt they have to carry.  You crow and complain about how companies buy your debt at pennies on the dollar, however, the collections industry saves American consumers over 54 billion dollars a year.
