I have had my phone number since last Nov. I tried to explain and ask them why they keep calling for someone NOT here. OMG  what a RUDE person.. must be required to be rude when working there. Called the Plymouth, MN department given to me by MY States attorny Generals office. Another VERY rude female that would NOT even talk about it once she found out the reason for the call.  dial the number *67 then the number as they can find out who called.
Their contact infor is below:
Messerli & Kramer P.A.

This number calls our business multiple times a day and there is no one on the other side. I finally just started ignoring the calls but it got extremely annoying. I called one of their offices and asked what the call was regarding. It was for someone who has never worked here and we have no idea who this person is. I asked them to take our number off of the list so I'm praying they stop calling! These suckers are persistent!

Sorry to hear about your situation.  It is very complex and unique.  I would urge you too seek the advice of an attorney since the expertise of folks here are regarding unwanted phone calls (and con artists who use the phone).  It shouldn't take much time and cost you much money, and if you are in an area with a university law school near by, you can call their legal clinic.  Good luck

I was sued by Messerli and Kramer over an alleged credit card debt. I am suing them back for unlawful debt collection practices, autodialing my cell phone, and fraud. During discovery, they furnished a "bill of sale" which isn't even signed by the original creditor they claim their client bought the debt from. They also failed to disclose the original creditor's computers were hacked in the largest cyber-crime ever. The apparently create thousands of lawsuits from computer data and nobody bothers to check the information before they sue. The original debt collector also refused to respond to a debt validation request I promptly mailed them.

Bill collectors by law can not identify themselves until they know they are talking to the correct person. So John Doe your barking up the wrong tree.

Now.. They can call and as "Can I speak with John Doe" and you can reply "sorry. This is not John Doe's phone" and hopefully they will stop calling.

They should be professional when they call. No doubt about that. But please understand until they are sure they are talking to the proper person, they can not identify the company they are with or the nature of the call.

Many times they use the "important business matter" line.

You always have the option of disconnecting the call.

I hate bill collectors just as much as the next guy.

After answering the call, there is generally a brief 5 to 15 second delay before anyone comes to the line. Most likely an auto-dialed and computer connected call.

Caller does not advise that the conversation is recorded. Caller makes a demand to speak to (so and so...) Caller does not identfy themself or the company they work for. Caller does not use a greeting such as "hello, good day" etc.

The caller was told to identify themself as directed by national, federal, and local State laws governing telephone solicitation and caller identification laws. Caller indicated their name was Warren, and the voice sounded like a male's. Caller refused to identify who they were working for, or the company he was with. After 3 requests to identify the company he was working with he became abuseive and loud, barely refraining from using profanities. Caller indicated he had 'looked up' the address in connection with my phone number and 'knew' it was the number he needed to call.

Prior to reading the follwoing statement I try to find out the name of the company the caller is working for. I try to get the address of the company, and at least one or two names of the caller's superiors or colleagues. That information would then be used to pursue legal recourse in response to their repeated harassment and violations of Do Not Call/contact laws.

This same phone number, and contact person (Warren) has made several phone calls to my number. Since I started keeping track of the incidents, this marks the 6th contact he has made, with no indication that Warren or the company he is with will stop in their contacts. On each phone call I have clearly told him the following from a written statement I prepared:

" I own this phone, the property at this address, and the phone number is in my name, NOT the person you are looking for. I am not the person you are looking for. This number is not their property. This is a place of business. You are not recognized as a contact that I or my company do business with. You are not welcome to contact this establishment again. We will not divulge any further information to you, or the company you work with. You and your company are not to contact this telephone number any further. Cease, Stop, Do Not Call this number again. Remove this number from your contact list. This is the (x number of times called) time you have called this telephone number --in obvious violation of my previous instructions and applicable Do Not Call laws. I have recorded the date, time, and your name. If you contact this number again, legal actions will be taken against you and your company in accord with all aplicable Federal, National, and State laws."

If the caller refuses to give me the information I advised him to provide, I END THE CALL AND HANG UP IMMEDIATELY. You do not have to talk to him any further if they refuse to cooperate. Just hang up the phone. It is not impolite, and it is your legal right to do so.

Notes:

The caller is adept at arguing. He prefers to talk in statements, usually in a condescending manner. Caller exudes an air of assumed authority--however there is no proof to their authoritative claim. At times he has implicated that the sherrif is in route to my door to make an arrest. The claim has always been bogus as law enforcement has never been to my address. Caller is adept at talking over you while you instruct him in the Do Not Call advisement. He likes to talk at the same time you do, to provoke you into an arguement, whereby he may gain some sort of upperhand and convince you to take some sort of action in his favor.

Make NO promises to him. Refuse to identify YOURself. DEMAND that he identify himself AND the company he works with. If the caller does not do so they are in violation of the law. Giving you his first and last name is not sufficient. Caller **must** identfy the company he is calling on behalf of. Expect that the first and last name you are given are false. Always get the name of the company, it's telephone number, and physcal address.

Don't wait for them to hang up. YOU end the call & hang up.

Just got a call from that same 877 number. They've called in the past, usually during the day when I'm at work. They usually leave a message asking for a woman I've never heard of. Calls only started after we purchased a house in October and moved in (about a month or so after move in date).

For all the guys who say they are just doing their jobs, I say bull. I'm current (and in fact ahead) on all my loan payments (car, house, etc.). My credit cards are nearly paid off (as in less than $100 on any card) and I pay my bills on time every month. I never pay "minimums" of $20 or $30, I usually send between $100 and $500 at time for each payment (cards, loans, doesn't matter, I always over pay).

Why would they be calling me? My credit is good, and in fact because of my credit I got a better interest on my house than what the bank had otherwise listed, 0% financing on the new car because our credit was "...more than sufficient." I haven't done anything worng, am not currently doing anything wrong, and am not only financially very stable but on time, on top of it, and 'ahead of the curve' in every possible meaning of the phrase as far as my finances are concerned.

I have spoken to them before, when they first started calling. I informed them that this lady doesn't live here, we just bought the house, I've had this phone number (at the time) for just over 5 years (got a new number when I switched to Vonage) and I have no idea why they would be calling me. I asked them to stop, and after a few more calls and me asking them to stop, I just don't answer the phone anymore. I figure that after a few years, they'll eventually give up and call a better number for whoever it is they are trying to talk to.

Unless there was a judgment against her unpaid debt then the state of MN allows 25 yrs for collection efforts. Don't give out legal advice if you don't know the law.

Callers from Messerly leave messages asking for someone who does not live at my address and does not have use of my "unlisted" telephone number. The message states that "if you are not so & so then hang up". This would be fine with me if the call happened "once" -- but they keep calling and calling and calling. I am now really annoyed.

Whoever calls from Messerly usually does leave a name and return phone number. I don't know why they are calling, but I am presuming that it is for debt collection.

This attorney office just called me earlier today.  I spoke with a "Craig" and he gave me an attitude over the phone.  I was willing to make a payment plan and he stated that I refused to take their offer in paying $200.00 per month.  I have student loans to pay per month at a wopping $1000 a month + car payments and rent as well as support my 2 yr old daughter.  He stated that since I "refused" to pay, he was going to talk to their attorney saying that "we spoke" and that I refused to work it out.  I was also confused because there was another collection's company collecting for the same debt this very same month!  I live in Milwaukee, WI and this attorney office is located in MN seeing how they contacted me from MN I'm guessing the attorney's in MN will be handling?  Unsure what is going on and unsure if they even contacted the right person for this debt!  Now, I'm waiting on documents proving that I owe this debt.  I requested it from Craig and with his attitude, he hung up on me.  What a f**!  I'm contacting the legal representatives through my work place to advise what I should do next.
