Collections Departments must not attempt to make financial arrangements by telephone. A legal letter is to be served by registered mail, that MUST include proper name, address, account number of cardholder, collections file number, date, exact amount owing, and signature of a credible legal representative. Original creditor must also be able to verify the exact amount owing. Anything short of this, is a scam. Once the limitations has run out after 2 years, they are in violation of harassment laws. These termites are just attempting to extort people by the information the have gathered on some of us. Just don't answer numbers that you don't recognize, and never give out info if you do answer.

Benjamin Hoffman isn't a licensed attorney in the Province of Ontario, where NCR (National Credit Recovery Inc) is has its offices.
If it is more than 2 years (24 months) since your last payment, in Ontario the Statute of Limitations Act has kicked in and they can no longer sue.
If they're calling your cell phone, and it costs you money (such as airtime, long distance, or roaming to answer and/or pick up your message on voicemail) send them a cease and desist letter (via registered mail) and the calls will stop.
I Sue Collection Agencies 2014-06-16 23:02:17 Unknown
Anything over two years since the last payment in Ontario is a statute barred. They can't sue you.
It is also illegal for a collection agency to contact you in a manner that costs you money. If they're calling your cell phone, send them a cease and desist letter stating you are going to file a complaint against them with the Ontario Ministry of Consumer Affairs. The calls will stop.

I had a call 3 wks ago saying i had a balance of $321and interest built up so i owed $948 from a hbc credit card from 2007 and they were threatening to take me to court. I told them i had never owned a credit card and I told him to get his surveillance to show that I have been using one. I contacted Hbc and there is no recollection of me ever owning a card. So he calls again just now and says hes collecting from national credit something or another, lawyers name was Fredrick??, i couldnt understand the last name so i told him im reporting him to the police and he got mad at me saying he was going to direct me to them. Nedless to say,he hung up.

They keep calling for a Shelly Rudman. Although the person does exist, she had the phone number BEFORE I did and they just don't get it, that they have THE WRONG NUMBER AND PARTY!!! Can't be too bright. The number they are calling is mine now and it could be Googled quite easily to see who it is they are calling. Also the person they are looking for has a current address in the city. All they have to do is Google her! I did get quite testy with one guy that called and told him as much. He said if it wasn't me, why didn't I change the number. I said if it is me, take me to court so I can sue your a** off! He swore and hung up. Cowards!

Has anyone else had their names used in the message specifically as well?
Four 2014-06-03 20:33:13 Debt Collector
The "Office of Benjamin Hoffman" not the "Law Office of Benjamin Hoffman" called and left a message that me or my lawyer need to contact hem about breach of contract.
This is NCR (National Credit Recovery Inc) trying to collect on an MBNA Mastercard that more than 24 months have passed since the last payment, making it a statute barred debt, so they cant sue.
Tris Proir 2014-06-03 20:28:10 Debt Collector
The "Office of Brnjamin Hoffman" not the Law Office of BH. A very important distinction. This is NCR (National Credit Recovery Inc) called wanting mr or my lawyer to call about "breach of contract."
They are trying to collect on an MBNA Mastercard that is more than 24 months (Two years) since the last payment was made and is now statute barred.
Intend to drop a cease and decist letter on them.

if you got a call from 1877 670-8910 and tell you you owe money or in breech of some contract its all b***s*** these people say that you need a lawyer to scare you and make you call once you call they give another story saying you owe money from a past credit card debt from 2008 or 2006 or they say you owe money on a old cable bill. for one there is no lawyer named ben hoffman in canada and by law in canada no legel action can be taken for a debt after 2ys and no contact and when you start asking about the validation of the company or want some kind of proof they get rude and hang up..these people are scam artists they find old people or dumb people and try to scam money... if they call again tell them you will call the police and charge them with harassment ..trust me they wont call back

I too have received threatening calls, very hard too make out what the message is, also are contacting personal co facts by phone e and will not divulge how they got the phone #. They say they are collecting for hbc an old debt from years back. Would not give me any more info after I advised I had paid off a debt to them years back..he tells me to prove it. Funny after reading this is is quoted almost exact amount he claims that I had paid but still owe $491 more! I think we are trying to get scammed!

I had two missed calls today, both were from this number. Insisted I had an HBC credit card from 2008 with a balance of 928. Funny because I never had an HBC credit card. He was really pushy on the phone I said I just recently got a credit report and nothing was present. I also said that I wasn't the person they were looking for and to my knowledge you couldn't pursue legal action after 2 years. After that he became extremely rude. I said well if you send me documents in the mail regarding this matter we can figure out what is going on ' we wouldn't waste the money on the postage' ...was the reply and we will no longer contact you smucks.

Just dealt with the exact same thing. The people on the other end were abusive, belligerent, used profanity and at one point made a racial comment, all in response to me asking about the legitimacy of the company. I called three times and each time they identified themselves as a different company. They made the HBC card claim as well. I have never owned one. The third gentleman even attempted a three-way phone call with the Vancouver Police with me on the line and when the police answered the agent said he would call the officer back as I was making too much noise in an attempt to interfere with the call, even though I was sitting at my desk in a very quiet environment. The agent's plan was to get me charged with harassment for calling back for clarification! I followed up with the VPD shortly after and of course they had no record of a complaint despite the agent telling me the police have been dispatched to my home. The police did give me a file number and asked me to call them (the police) after every phone call received by "Benjamin Hoffman" who clearly does not exist. Senior citizens get targeted by these idiots all the time.

I have been getting the same call... If you google Benjamin Hoffman and HBC, you are not directed to a link for any law firm associated with that name.
I also checked the Canadian Law List and the Lawyer Directory for the Law Society of Upper Canada and neither brought up anything regarding a Benajmin Hoffman. Just keep ignoring the calls.

kathy 2014-05-22 03:44:28 Unknown
so is this totally a scam? the exact same thing just happened to both me and my husband today. random number saying they are suing us for an hbc credit card and that we had to pay by friday or they were taking legal action with Benjamin Hoffman.
Ashley 2014-05-21 23:32:53 Unknown
I called the number back right away, (had the same message as you) Apparently it's a collection agency now suing me for an HBC credit card that I had in 2002....thing is in 2002 I was 13 years old.
That and according to my lawyer friend, in Ontario, unsecured debt cannot be pursued after 2 years of no contact.
Such fools
Kevin 2014-05-21 22:45:55 Unknown
Cannot understand the recorded message of whom they are looking for...state that they are calling from Benjamin Hoffman because of a violation of a contractual agreement and that I or my lawyer should take action immediately...
