You're welcome. By all means, contact the original creditor. If possible continue dealing with them and only them.
And be aware, the state of NY (particularly Erie Co.) is the fraudulent collector capitol of the western hemisphere. It's even been speculated that the scumbags in India learned their bags of tricks directly from the "Buffalo-boys".
You have stated that you do owe this debt. Make arrangements to pay it off as soon as you can. Just be sure that your funds are going toward your debt, not into the pocket of some grease-ball who's been reduced to scamming people for a living. Links and resources are available here, to the right of your screen. There are always people here who are happy to help as well.
Be safe. Be aware.

Thanks so much for the info Gunnar!  These people have actually been the most "legit" sounding of all of them.  I get the same woman every time I call (they are in New York).  They emailed me a pdf letter from their "company" Apex Capital Solutions, LLC, address 247 Cayuga Street, Suite 5e, Cheektowaga, NY 14225 with a phone and fax.  website is www.apexcapitalsolutions.com. Their letter indicates an ID # (not my original loan number though), Original creditor (Cash Call) - which I do owe and the balance owed.  The fact that they will not send a letter through US mail is what was the red flag to me.   Wondering if I should just contact Cash Call and ask them who they are using as a 3rd party collector LOL.

Again, thanks so much for your info - good to know!

They are required by federal law to provide you with full, verifiable proof of their claim to be provided to you in writing. By mail. Not e-mail or fax. Their refusal is confirmation that their claim is fraudulent or invalid.
Inform them that all your calls, at home and at work, will now be recorded. Tell them that you have now researched your rights under the FDCPA and that all further communications with them will be turned over to a Consumer Atty. Instruct them that they will now follow federal regulations or that the only future legal matters will be directed at them, not you.
Live Well.

Debt Collector
Hi all - I have a situation with a payday loan company.  Yes, I took out a loan with Western Sky, which within 3 days sold my loan to Cash Call.  According to an attorney, since the loan was originated with Western Sky, the loan is indeed illegal and they cannot sue me (Indian tribe claiming sovereing immunity, etc.).  In any event, I have been receiving calls from Apex Capital Solutions (877-719-5203) as well as a company called ACS.  A man left me a non threatening voice mail saying his name was Matthew Dixon and he is a personal locator giving me a file number and various information to call back with.  When I called, I was transferred to this very rude woman (who was initially pleasant) until I started asking questions.  I asked for proof of the debt owed - they indicated they could only provide an email?  That can't be right.  Also, they know the amount of the loan, and the last payment I made (exact amount) last year.  They have a lot of information about my loan and about me.  Is this a scam?  I don't know if Cash Call sold their collections to this 3rd party collector, or if this is indeed a scam.  Help!  Anyone have this issue??  Thanks to anyone who can shed some light on this.
i beg to differ

New Variation on Telephone Collection Scam Related to Delinquent Payday Loans

02/21/12?The Internet Crime Complaint Center (IC3) continues to receive complaints from victims of payday loan telephone collection scams. As previously reported in December 2010, the typical payday loan scam involves a caller who claims the victim is delinquent on a payday loan and must make payment to avoid legal consequences.

Callers pose as representatives of the FBI, ?Federal Legislative Department,? various law firms, or other legitimate-sounding agencies and claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, or other Internet check-cashing services. The fraudsters relentlessly call the victim?s home, cell phone, and place of employment in attempts to obtain payment. The callers refuse to provide information regarding the alleged payday loan or any documentation and become verbally abusive when questioned.

The IC3 has observed variations of this scam in which the caller tells the victim that there are outstanding warrants for the victim?s arrest. The caller claims that the basis of the warrants is non-payment of the underlying loan and/or hacking. If it?s the latter, the caller tells the victim that he or she is wanted for hacking into a business? computer system to steal customer information. The caller will then demand payment via debit/credit card; in other cases, the caller further instructs victims to obtain a prepaid card to cover the payment.

The high-pressure collection tactics used by the fraudsters have also evolved. In one recent complaint, a person posed as a process server and appeared at the victim?s job. In another instance, a phony process server came to a victim?s home. In both cases, after claiming to be serving a court summons, the alleged process server said the victim could avoid going to court if he or she provided a debit card number for repayment of the loan.

If you are contacted by someone who is trying to collect a debt that you do not owe, you should:

Contact your local law enforcement agencies if you feel you are in immediate danger;
Contact your bank(s) and credit card companies;
Contact the three major credit bureaus and request an alert be put on your file;
If you have received a legitimate loan and want to verify that you do not have any outstanding obligation, contact the loan company directly;
File a complaint at www.IC3.gov.

i contacted this number, 877 719 5203, a message stated that i had contacted APEX CAPITAL SOLUTIONS. after doing some research, i found that this is a supposedly debt collector for payday loans. i contacted the company and spoke to a lady by the name of breanna. this company tries scare tactics of arrest if you don't pay off the loan. i asked for the documents concerning the "debt" that had been filed in my name and was given the run around. they did not come right out and tell me that they would not send me a copy of the documents, but was told that i would be transferred to her supervisor because she told me that i was lying. i have seen a plethora of posts on the internet that APEX CAPITAL SOLUTIONS is a scam company and to report any calls to the FTC on this website: http://www.fbi.gov/scams-safety/e-scams

Tell them you have contacted your state attorney generals' office and reported their phone number, names given to you and fraudulent file information... this is fraud! Also, explain to them that you intend to contact your local FBI office and report their information, phone number, names provided... this is extortion!
These (not very smart individuals) are a scam! They will attempt every trick in the book to utilize your information in order to EXTORT your monies and personal information. They are not very smart! They want to scare you, don't fall for it... report them to your state attorney generals' office and local FBI office.
These (not very smart individuals) called me recently, and trust me, my state attorney generals' office is looking into the matter.
This "Michael Thomas of ACS" (1-877-719-5203) is commiting crimes and they think they are being slick by calling from a phone number that comes up "unknown" ... once again, not very bright.
You would think they would be smarter than that.

It sure doesn't sound like they are a legitimate company!  You have a right to demand they stop calling you, and you have a right to demand they send you a debt validation letter.  Don't give them any of your personal information.  Any valid debt collector will have it already.

I just got a voicemail saying that he was from the "Firm of ACS regarding a pending legal matter" so they're obvioulsy trying to pretend to be a legal office, and hiding that they are a debt collector. Not really a good method for getting people to speak with you. Just scare tactics.

Called looking for Mr. Savage, reference legal case number 303-563.  I needed to call back to number given or a lack of response would indicate agreement with whatever the legal issue was.  Interesting approach though, but the caller ID showed "RESTRICTED", I never answer those.  Obviously I didn't call back

I also got that. Always give vague information. Most likely a result of a relative's information being stolen. Calls to me are referencing a relative who should be able to be contacted and who has had identity theft problems. This is most likely a phishing scheme.
