If your son is over 18 then he's committed fraud against you by using your name.  They cannot prosecute you for a debt you did not incur.  If you did not sign any documentation they do not have the legal right to contact you for your sons debt.

If your son was under 18 there is no legally binding contract.  They are trying to scare you for money.  Do not offer them any money it is a scam.  Look up the statues in you state and city regarding debt collection.  Tell them to contact you via email with all the documentation that identifies your son as signer on the document.  If they cannot produce documentation they cannot proceed.  If they try to affect your credit this is grounds for appealing the information.  There must be documentation by the creditor of you debt.  Again if you didn't sign any documentation for your son you will have the opportunity to dispute any information added to your credit report.

Do not verify your address or any other information they are collecting information about you for more fraud activity.

This is one of the biggest scams out right now, anyone who has taken out payday loans and have them even paid back all our info has been stolen and fake debt collectors try to collect a debt that does not exist anymore so DO NOT GIVE IN, DO NOT GIVE ANY MONEY!! In the past 2 weeks there are 2 separate companies trying to scam me. I am beyond sick of this why can't the authorities find these people???

I've been getting calls from this guy Paul Harris and he's using my maiden name which I haven't used in 6 yrs telling me that there are civil complaints against my name and social security.... I'm clear and have not check cashing issues and I don't know where this guy is coming from.... This is a scam........

I have been getting calls from "Lisa" and "Madison" (perfectly innocuous sounding American names, yes?) that show up on caller ID as originating from an 877 number, but the call back number they leave is (720) 636-8249 or a minor variation thereof.  The area code seems to be  Colorado; however, I have read that scammers can easily disguise their true locations and area codes through voice-over-internet apps & set up generic voicemail boxes to receive return calls.  Colorado is a favorite, as is any state with a relatively sparse population compared to its size, because it's unlikely you'll be familiar with the tiny town they claim to be from. Most likely, if you fall for it & are willing to pay whatever bogus fee they propose, it will involve an electronic banking transaction directly from your account.  

They never identify their company, and they never ask for anyone in my household by name.   Messages left  go something like, "Your name has come up in connection with fraud," and "we need you to send us documentation."  I've gotten four or so in the past several months.

Rest assured, if some legitimate company (a bank or a credit bureau)  (or scarier yet) the IRS really wanted to investigate/prosecute you for fraud, they would not hesitate to identify themselves.

These callers are not legitimate, just random opportunists. Who knows how they get peoples' phone numbers, but legitimate companies, and certainly US government agencies, DO NOT USE THESE TACTICS.  

These fraudsters count on the fact that a certain percentage of people who receive these calls will react with alarm and do anything to clear their names.  It's hard to ignore them, especially when they persist in calling, but if you DO answer, you confirm that your phone number is "live" and will only prolong the misery as they sell it to other fraudsters, years down the road. Moral of the story:  however hard it may be to do so, IGNORE THEM.

This most likely is the same operation just changing the company name often as most of these scams are coming out of New York.  This is an illegal mediation company (look at their website as it clearly shows they are a fly by night operation) and they call with a robot with a threatening message that their may be lawsuits or action taken against your social security number for fraud.  This company CANNOT do ANYTHING to YOU...Especially if payday loans are ILLEGAL in your state.  The litigation has to take place in YOUR STATE and if the LOANS ARE ILLEGAL no COURT in YOUR STATE will even hear the case and let it in the courtroom.  All they can do is continue to harass you and threaten you and call you names.  THIS IS A SCAM.  THEY WORK DIRECTLY WITH THE ILLEGAL PAY DAY LENDERS TO COLLECT ON ILLEGAL LOANS.  

EVERYTHING THEY DO ARE ILLEGAL.  They say they are a mediation firm....well guess what everyone...ANYONE can open up a mediation firm.  They do not have ANY LEGAL AUTHORITY and they cannot do anything to you.

This has been a big problem , so Mr Williams sent me corrispondence after nicely asking me to disclose my sons information.  Also said he has some co workers who are problem heads (apparently he's had some problems with a mark stafford).  Mr Williams actually took my offer of 125 on the table to settle this in full.  I did call CashJar , they are online lender apparently my son took this out because we have a joint bank account he told me it was a "student loan" I put about 500 in that account each month for him at school and traced it back to 2011.   This cashjar company deposits around 750$ after 9 days!!!! they want 640% interest I saw they nicely took out about 500$ from my bank account.  Now of course "no disclosure" it's in collections.  Cash jar are a bunch of jerks..... if you visit their website you are greeted by a nice po box address in cali and they basically set you up to be in debt.  Mr Williams basically middle manned he went as far as to send me a 18 page loan agreement that he owned the loan.  I cannot post this it has alot of confidential writing in my name.  These contracts are what get ya you sign these online and literally have no clue of the interest rates or apparently when you pay money on these you are "re-financing or re-instating your loan".  Mr Williams told me he was a paralegal for mr Jacobson and was very polite i must admit than Chris Sullivan took my payment.  I told him I would need a physical address and I write checks , sorry but if he cant take a check I cannot pay.  He did give me his address and I recieved correspondence back saying this has been paid in full , than cross checked my sons credit report and mr sullivan did pull it from the records for me, but also told me make sure to let him know that I needed this pulled or it wouldn't show up for a few months.  Let me tell you this has been a "headache" but Mr Williams was one of the most understanding people I have met, he and me had a personal talk very nice man.   He explained mostly everything to me and civil claims ,stated he would not actually be processing me but that they retain a processing server or they send out a summons to the courts and have lawyers retained in 13 states.  They mainly work in these 13 states only, he also stated he personally wanted me to settle this voluntarily gave me 30 days to decide I called back and he was there.  He gave me his personal number his, his email , and he sent me a 19 page contract via USPS,  he said to me they get alot of harassment because of the way that these loan companies work.  I have filed a complaint against cashjar and am sending mr williams a thank you card for handling this.  So if you do have to deal with this company I strongly advise you to speak with Tod or Chris , both are caring family men once you get them past their "attorney spiel"  these guys are nice at heart, which to me goes a long way in this business.  Personally this is how I got mine settled , if anyone would like to speak to me on this or see any of my documentation give me your email address as I do not want anyone to have public knowledge but can black out my name and signature so you can see my contract verification.  Just ask for verification ("notification must be sent out, once you are made aware you receive a settlement offer i requested USPS.  than it notifies you they own the debt which you can cross check with the creditor in my case cash jar, they verified my account sent me my original contract and I traced it to "in collections" than worked with this law firm to settle it.  He personally did not take any money but just helped me settle this and he called Cash Jar for me , called me everyday for 5 days until I got my contract making sure.  I just got real with the man and he told me all of this and helped me personally.  Again if you do deal with them just ask for Tod,  I have had a mr livingston answer and try to talk to me regarding my case but I told him not to contact me for I am working with Tod who had no idea , so make sure you follow up with your own paralegal in this firm seems there's some internal conflict as always with these law firms. Sorry for not responding but I needed this taken care of and boy is this sweat off my shoulders thankfully I was able to settle this for 250.00 since he verified with me I had paid most of it off already.  How I go this discount , I really don't know but he said he had legal writes to go 70% down on this if I could come up with the money within 30 days and I did and he did.  I wasn't happy but my son did verify and admit he did this when I called him, unfortunately my son has some problems drug related so I am very very protective of my information now.  He's done enough to me but I love him and he's pushing forward so I took care of this for him and told him no more.  Children will be children, how these loan companies approve a loan with a routing number and SS is ridiculous mr williams even told me personally they were scumbags and that he personally works cases like these because he hates the interest rates of these companies like cashjar, but my son received notification that he had a court appearance about 2 months after he wouldn't talk to the firm, than when I called in for him on his behalf and found out all about this due to a recording thankfully Tod found my # or my son would have been paying probably about 750+ in court as I called and talked to my county clerk about this she said since I did already claim identity theft and my son had basically been caught, we share the same name and he used my social and his address I would personally get out of it and he would be responsible she said up to the amount with accordance to my state laws in bad check penalties and recommended I call this agency back. Basically what I went through since my original posting sorry I am not a computer guy nor is English my best subject as I am from Russia but I hope to share this story with you out there that are confused  * , I am not proud of, but I am glad I was able to help him and get this all settled.

Is your son over 18?   He must be at least that age, more likely 21, to take out a PDL in most places.   Did you agree to cosign the loan?   Did you sign anything?    Did you have any knowledge  of the loan until this guy called?    If what you say is true, your son is not only liable in total for the loan, but may be criminally liable on any number of charges depending on what he put in that loan agreement.   If he did all of this without your knowledge, you are in no way liable for the loan (assuming you are in the US.)    Tell "Mr. Williams"  he isn't getting anything from you.   If you feel compelled  to pay this off for your son, who apparently can't pay anything, you could tell "Mr. Williams"  you'll give him $100.00 to settle in toto  IF he can provide the proof the loan actually exists,  can document he owns the debt, and is willing to document and sign the debt is paid in full.    

As long as you are sure you did not obligate yourself in any way to cosign this loan, threats of a civil suit are empty.

I forged my guarantor's signature when I took out a college loan. I'm not proud of that, but I was like 19, and my mom had bad credit so she couldn't help. Anyway, it was easy. Hope this helps.

How on earth did your son take out a loan in your name?  

You refer to a company calling you about this loan (and claimed you were sent correspondence from this company).  Could you please post the exact name and address of this company?

Whether or not you can get a discount is up to the debt collections company. You could probably contact them and ask them about it. I know some medical debts can be settled for less, so it stands to reason that this may be possible. Since the debt has been validated, I would definitely discuss that option with them.

I got a message from a mr Williams who was very polite and disclosed that it was an attempt to collect a debt from me.   I guess with these business's it's who you speak to, employees are all different, he was very polite to me and informed me that my son took out a payday loan in my name.   I received correspondence stating that they owned the rights, I also did some digging and found out that unfortunately my state allows them to process me in civil claims court.  My question is can you get a discount ?  My son only took 250 and they are asking for 700 with fees and pentlities  I really don't want to go to court over something minor and my son has the loan agreement sent to him, I just want him to get his life straightened out so i am going to see what everyone suggest do you think they would accept 250 ? I have heard that you can sometimes avoid the interest if your work with these creditor companies.  Please let me know as I just want to be done with these phone calls , my son took out the loan and than got in some trouble but is now on the right track in life.

I got a call from 866-719-6634 from a Mr Stanford today myself. It's the same old scam. I'm surprised that this scam hasn't gotten old or out of date yet. Someone must still be making money on it. For the record it's illegal in about six or seven different ways. Debt collectors are supposed to give you a notice allowing you 30 days in advance to dispute the debt. I doubt anyone on here got that notice from this company. In addition, the Fair Debt Collection Practices Act forbids any debt collector from using the threat of legal action in the collection of a debt. No local police department is going to go after you for a debt that you owe any institution. Companies like this will use words like fraud and prosecution in order to frighten you. Trust me, if you have a debt like this that is legit check your credit report. Whomever has the debt on that document is the party you pay the debt to; any other company is bogus.

I recieved a message from the toll free number 866-719-6634 from a Mr Stanford in ref to some advance I took out from 2006. That they had a fraud complaint. Said they werent here to remind me of the debt but to be final step before it was turned over to my county for prosecution. If I owed money back from 2006 from a cash advance wouldnt you think Id have heard from it before now. They proceeded to explain it was a bad check I authorized back then and it could be criminal prosecution. When I asked for them to mail me documentation of this they refused. They are the same company as the number listed above and I dont know what to do. I called the solicitor and know that a bad check can only be acted on for 180 days not 6 yrs later but the fact they dont want to send me any paperwork makes me very uncomfortable. I am tired of people calling me, being hateful with me bc I demand documentation in writing.

I just talked with Jacob & Wright to be informed that in October 2008 that Bank of America loaned me money and I haven't paid it back.  When I challenged them with my stolen identity and that BofA has never contacted me and I will not get a lawyer the lady hung up on me.  I am so frustrated.  Isn't there something that can be done about these jerks that call people and try and extort them out of money?

Called the # back and it goes to a Jacobson & Wright PA out of Jacksonville, FL. I must have called after they closed the office, because the telephone system sent me to a Mr. O'Connor's vmail and requested I leave a message with the file #. No file # was given on the recorded call

I keep getting a call from 8777203288 about every three months saying that I am being charged with fraud, but when I tell him to send me the documents and I will have my lawyer handle everything, this person Jacobs starts with the insults and calling me all kinds of names.
