Debt Collector
I have been paying legal prevention services for over a year, almost $1600 so far. I get a call this morning by another agency who actually owns mt debt. This company does not own my debt, I just gave them all that money for nothing. They are worthless and extremely rude!! Don't pay them!

Well, got a call from this Burke woman, who is beyond rude. Never gave the legally requireed "this is an attempt to collecet a debt..." schpiel, used a caller ID spoofing number and refused to give me the company's address so the NC Attorney General's Office can whip her out a cease and desist, since she's trying to collect on an illegal payday loan in the state of NC for that well-know scam company Triple Services. Let's see if she files, as it won't be ME she faces in court, but the NCAG.

Here is what is happening. This crummy little business has 9 complaints with the better business bureau. 8 have been resolved by the company backing down. 1 is pending. Everyone that has complained share the same problems you are having.
The BBB given address to this F rated business is:
Legal Prevention Services
485 Cayuga Road, Hangar Bay 4-2
Cheektowaga, NY 14225

I so far have found numerous phone numbers for them, you probably already have half of them LOL.

They have bought "zombie debts" (debts that are no longer legally collectable due to your state's statute of limitations). Chances are they bought these debts for less than the price of a cup of coffee. Once they have legally bought these debts, they try to trick you into admitting that this is your debt. Any agreement to pay (written or verbal) and any acknowledgment to ownership of said debt, will reset the clock on the statute of limitations. Bringing dead debt back to life. The statute of limitations differs from state to state. Chances are any debt 5-6 years old is no longer legally collectable. This particular company uses fear tactics and harassment to get you to panic and admit liability........and they are breaking the law.
You are protected from debt collectors under the FDCPA
Key points here:
~ They cannot knowingly contact you at your place of employment
~ They cannot threaten arrest or imprisonment
~ They cannot call a third party more then once, or discuss the debt with any third party (they can call a second time if they believe the third party is lying or if they believe the third party has new information as to your whereabouts)
~ They cannot call before 8am or after 9pm.
~ They cannot use profanity or harass you with numerous calls
~ They cannot threaten to take legal action knowing that it would be unlawful to do so.
~ They cannot pursue a debt if it is in the process of being disputed.
~ They cannot say a documents are judicial when they are not, and they can't say a document is not judicial when it is.
~ They cannot tack on extra charges and fees to the original debt without consent from you.

THEY HAVE TO:
~ Accurately identify themselves (names)
~ Accurately Identify the company they work for
~ Give you an address to the debt collection agency
~ Tell you what debt is owed
~ Tell you the accounting method of said debt
~ Tell you the original owner of said debt
~ Provide documentation that they are legally allowed to collect said debt
~ Tell you the date and amount of the last payment of said debt
~ Tell you if the statute of limitations of said debt has expired

I've heard they like to hang up when you start asking questions......the reason being is that they don't want you to send them a letter of Debt Verification. This type of letter disputes the debt and halts the collection process for 30 days. YOU MUST WRITE THIS LETTER WITHIN 5 DAYS AFTER INITIAL CONTACT FROM THE DEBT COLLECTOR. The crappy little tactic they deploy is to file a lawsuit against you before receiving this letter. It's best to send the letter to the address above certified mail with a receipt proving they received it. Also send a copy through regular mail. (they like to return to sender). Keep copies. Also state in the letter you do not wished to be contacted.....This will shut them up. If you do get sued.....and the debt's statute of limitations has expired....all you need to do is let the courts know that it is expired.....prove it and the judge will throw the whole thing out. You can also counter sue for illegal practices and violations of Federal Law $1000.00 free $$. A class action lawsuit will Award $50,000 free $$. If they report a zombie debt on your credit report or a disputed debt on your credit report you can sue for defamation of character on top of illegal practices and violations of Federal Law $1000.00 free$$ Complain to the BBB about Legal Prevention Services! They can and will help. Here is a copy of the letter I intend to send to Legal Prevention Services feel free to use it.

Re: Acct # XXXX-XXXX-XXXX-XXXX

To Whom It May Concern:

I am sending this letter to you in response to a notice I received from you on (date of letter). Be advised, this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested.

This is NOT a request for "verification" or proof of my mailing address, but a request for VALIDATION made pursuant to the above named Title and Section. I respectfully request that your office provide me with competent evidence that I have any legal obligation to pay you.

Please provide me with the following:
?What the money you say I owe is for;
?Explain and show me how you calculated what you say I owe;
?Provide me with copies of any papers that show I agreed to pay what you say I owe;
?Provide a verification or copy of any judgment if applicable;
?Identify the original creditor;
?Prove the Statute of Limitations has not expired on this account;
?Show me that you are licensed to collect in my state; and
?Provide me with your license numbers and Registered Agent.

If your offices have reported invalidated information to any of the three major Credit Bureau's (Equifax, Experian or TransUnion), said action might constitute fraud under both Federal and State Laws. Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent I will not hesitate in bringing legal action against you for the following:
?Violation of the Fair Credit Reporting Act
?Violation of the Fair Debt Collection Practices Act
?Defamation of Character

If your offices are able to provide the proper documentation as requested, I will require at least 30 days to investigate this information and during such time all collection activity must cease and desist.

Also during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my legal counsel. This includes any information to a credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate when in fact there is no provided proof that it is.

If your offices fail to respond to this validation request within 30 days from the date of your receipt, all references to this account must be deleted and completely removed from my credit file and a copy of such deletion request shall be sent to me immediately.

I would also like to request, in writing, that no telephone contact be made by your offices to my home or to my place of employment. If your offices attempt telephone communication with me, including but not limited to computer generated calls or correspondence sent to any third parties, it will be considered harassment and I will have no choice but to file suit. All future communications with me MUST be done in writing and sent to the address noted in this letter.

This is an attempt to correct your records, any information obtained shall be used for that purpose.

Best Regards,

These people have been calling myself and my family for the last three weeks. They threaten to take me to court if I do not acknowledge my intent on the debt.  Last I checked leaving more than their name, phone number and request to call back was a privacy violation since they can't confirm whether they have the right number.  And they claim to be attorneys?  Sounds like a scam to me!  Won't be calling them back.

Well they have moved on now they are using local call numbers.  They used the phone number 304-584-3021 and when I called it back from another line they told me it was Legal Prevention Services and when I asked where they were located they told me NY.  Scammers have sunk to a new level.

Well, newsflash -- they didn't fire Russ Hall, because this scumbag and his company has just started calling all MY relatives!  Robo-called my brother 3-4 times in this week alone before leaving a voice mail saying it was "Russ Hall" and provided a case number for a "filing against me", which -- surprise, surprise (Not!) - doesn't exist when I do a search on the L.A. Superior Court website.  Also, this jerk called my parents and spoke to both of them giving them information about me saying I was in trouble and owed $1,000+ and needed to (again, big surprise) settle up "tonight".  (Ever notice the urgency with which all these settlements have to be made?)  Also, Mr. Hall told my brother that they sent me docs 3 weeks ago.  Of course, that's a lie - I never received anything.

These people don't scare me at all.  I'm just completely beside myself with fury that they are harassing my relatives and also that people like this call and scare/threaten elderly people.  I wish so much something could be done to stop them.  Of course, I will be reporting them to the appropriate authorities, but they're everywhere among us nowadays.  Hate to say it, but I have my doubts they're going away any time soon!  One shuts down, but there are 10 others to take its place.

I got a call from this number at 9:48ish am.  As I'm a night shift worker I just ignored it.  The voicemail was a badly created computer voiced one.  Not only that I got maybe 1/3 of the message they meant to send.  Whatever!   I've gotten scam vm's before..  They were probably being directed at my b/f who lives in two states over.  They never ever contact him!  Nooo they have to contact me!  =*(   I have naturally zero intention on calling them back.  Their number is saved with no ringtone.  And any future numbers they use!

These people called me and said that they were from the courts and had a dockett number. I called them and spoke to a Russ Hall and he tried to say that I owed them $412 and that they filed a lawsuit against me for it. I called my local courts and nothing had been filed. I called them back and spoke to a supervisor, he told me that my balance was actually $168.21 and that he was firing Russ Hall immediatelly. I'm calling a lawyer! In my book this guy was trying to steal money from me!
