This company took $40 out of my account without authorization. They had my bank info and said that a device had been picked up by me at my post office. They had an address that I have not lived at for six years. My bank called them and they said they would refund the money, but my bank filed a report on them and said it is very suspicious so I got a new account.

Hello.  I was reviewing my bank statement and noticed a check withdrawal for $40.00.  I was unable to retrieve a copy of that check and requested a copy from my bank.  When I received the copy, it stated that the check was authorized payable to 877-805-8849SMS.  When I researched online this phone number, I came across other cases saying that this was a SCAM!  I contacted the number and spoke to an individual, David Williams, who provided me a SMS052-714-09 confirmation number that the money would be returned to my account in in 3-4 business days.  I am skeptical that this will occur and have come to terms that someone stole $40.00 out of my account.  I am reporting this so that others will not fall victim to this type of scam.

There was a penny put in to our bank account and then it was taken out. I think that somehow that is how they figured out how to get in our account. Then there was forty dollars taken out. We caught it and called our bank. The bank returned the money and has barred those people from doing it again.

And you are a shill - many people are signed up without adequate or legal disclosure for service programs.  Get your facts straight.  Also many of those "little boxes" online you're talking about are pre-checked.  And no, claiming fraud will not lead to felony charges - the company will merely (if they're legitimate) have proof the consumer did sign up.

So how do you know this isnt something your father took advantage of before he passed?  This company has been in business a long time.  Sounds to me like you are just upset that you couldnt defraud the business and get more money from them!  Shame on you for attempting to profit from the death of your father!

It is always best to work things out with the merchant direct.  Some people like ti scream fraud after they have taken advantage of a free trial and the problem is a false claim of fraud is a felony in every state ...when you take advantage of free trial offers trust me the company has enough information to identify you and the fact you authorized the free trial ... and business is starting to fight back against false claims if fraud they are actually pushing for and successful at getting charges against a false claim of fraud, no one needs that ALWAYS ALWAYS ALWAYS best to work it out with the company and READ READ READ terms of the little boxes you accept online.

They are a VOIP service that apparently I signed up for because it was hidden in something else when I made a purchase.  Signed up for 30 day trial and then they start charging your bank account.  

Here is a copy of the email I got after I called them:

Hello
Please be advised that your service with Smart Member Services has been cancelled and a refund in the amount of $40.00 has been generated. It will take 3 business days to reach your bank account. We hope this resolves the matter to your satisfaction.  If you need further assistance, please do not hesitate to contact us by replying to this email or by calling customer service at 1-877-805-8849 Ext. 1.

They're a SCAM!  They stole money from my father's account and they said it was for something he ordered but he's been deceased for 3 years!  SCAM ALERT!  They offered to "refund" the last two months but they've been stealing from his account for longer than that!  Beware!
