Consumers across the country report that they're getting telephone calls from people trying to collect on loans the consumers never received or on loans they did receive but for amounts they do not owe. Others are receiving calls from people seeking to recover on loans consumers received but where the creditors never authorized the callers to collect for them. So what's the story?

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

I probably was cocky as well.  They have not sent me any paperwork documenting the debt.   Don't trust them.

I think you should call the number 877-818-0144 and you will be able to find that they are using your name. I'm not sure why an attorney who represents people trying to get a new start through bankruptcy would suddenly be involved with an extortion scam.

If you use county officials and process servers, these individuals wouldn't lie nor block their numbers. Also they wouldnt threaten to send someone to jail as in what has been happening in our case. Calling a relative threatening them that they would go to jail if information wasn't given to the caller is bogus and against the law. This is why you people hide like cowards by blocking your number. A legit company would give there name address, website infromation etc nor become hostile with a consumer. I just got with my city officials, harris county, tx doesn't employ county process servers via the supreme court ruling. It is now done by private servers. They still have to attend a class and be certified and be put on public record for everyone to be able to look up. When asked they have to provide there first and last name and their process server id number. Where is the information huh?

As with MOST 3rd party debt collectors, they rely on tactics to get you to pay a debt that you may or may not owe. DO NOT agree to any payback terms with anyone that calls you.Make sure they send you verification of said debt. If they can get the original signed documents you may have signed, then they may have an opportunity to collect. if they cannot get this and chances are they can't. You should be ok.
If they end up serving you actual court papers, make sure you show up to court and make them prove the original debt you may owe. Most 3rd party debt collectors will not have it, they rely on most people not showing up to the court so they can collect on a default.
3rd party debt collectors rely on commissions, so they will try every tactic to get you to pay.
They buy these debts for pennies on the dollar. They Do Not represent the original client whom they say they are. The original client has already written/discharged this debt off, that is why it is given to these type of collectors.

Yes this same company called one of my family member with the same bull about serving papers at my job but they rejected it. A guy name David Martin called my cousin. People do not listen to that crap. If anyone or company is trying to sue you, the Sheriff department will just show up at your home. You get no warning. This is just a cheesy debt collection business trying to get money from super old cases that do not affect you anymore.

Ok so I just got off the phone with Robert Carter, well actually he hung up on me after I told him I was recording the call for my purposes for the refusal to provide me with name address of the company he supposedly works for. He says turn off the recording, I said no and he said good by. I hope these scammers are reading this. I know my rights:

While Texas is a one-party state, if you record a conversation without notice in which the other party is in a two party state, you can be prosecuted by that state.

The FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf treats the INITIAL CONTACT between collector and debtor (first call, first letter, first whatever) as a special event. Legit collectors per section 809 of the FDCPA *must* tell you at initial contact, or send you paperwork within 5 days of initial contact, the following:
1. $amount of debt,
2. name of the current creditor (which may differ from the original creditor who might have sold your debt),
3. a statement that that debt will be assumed to be valid unless you dispute in writing within 30 days,
4. a statement that that if you do dispute in writing within 30 days, the collector must mail you written verification of the debt,
5. a statement that if you ask the collector in writing within 30 days, the collector must send you the name and address of the original creditor if it's different from the current creditor.
If you don't get the 5 disclosures, orally or in writing (you do not have to ask for them, the FDCPA requires collectors to provide them), treat the collector like you would any SCAMMER.
Note that 3,4,5 must be done *IN WRITING* so you will need to ask an address from your collector. If s/he refuses to give you one for any reason, treat the collector like a SCAMMER.
The collector can threaten court action at initial contact but the FDCPA requires that the collector actually take you to court if the collector threatens it. Threatening court and not going through with it (coercion) is illegal.
If they say the FDCPA does not apply to them because they own your debt, the debt-owner exemption only applies to the original owner. Any 3rd party who buys the debt for the purpose of collecting debt is treated as a debt collector, i.e., ownership is irrelevant and debt buyers must obey the FDCPA as explained in this FTC Staff Opinion letter here http://www.ftc.gov/os/statutes/fdcpa/letters/arbuckle.htm

Collectors generally have to be licensed by your state to practise (collect debt) in your state and you can find out by calling your state Attorney Generals Office. Ask if a license is required and does this collector have one. If not licensed, don't pay and file a complaint with your state AG.

Ok so today I recieve a call from my mom telling me that someone called my sister inlaws parents house looking to speak to her. When my sister inlaw called back they said they were looking for my mom. I called the number back on behalf of my mom when I got off work and spoke to a Robert Carter. This guy was a real a** and I would can him for talking to anyone the way he talked to me. They refuse to give you names and addresses so that you can send a cease letter to, not to mention if you use the word laywer they really won't help you. They call my cell phone looking for my 3 year old austic child making it sound like they were trying to serve him papers. I called them back and they are no no...they are looking for my mother. The call was from a Mrs. Warner. I spoke to a lady named liberty and a Frank Silva who I guess is the Director(in charge). Absolutley no help. I repeatledly asked for the address and stated I needed this info to pass to my attorney if they didn't stop these harassing calls. Frank wouldn't give me that information only stating to forward his direct number to my attorney and he will show me that this is a legit debt. REALLY by law you are to provide this info. After several calls and request they stated they didn't have to because of a little thing called 911 and they wouldn't give this info to a disgruntled man. DIsgruntled....^&^&&^ yes I'm mad you people call my cell which I have no ides how you got it looking for my 3 year old which you refuse to admit you did. "WE don't make these calls its our process servers" If your a legit company give me your damn information. And if there was a law suit where the hell is the paper work you damn scammers. Oh by the way your lame apology isn't accepted. Why don't you tell your sorry for harrassing my 3 year old for something that isn't even his. I have the voicemail to prove it. I want to get to the bottom of this. Is this real or not? First a woman called from a blocked number and told me to call 877-818-0144. She gave me a case number. The man was very rude and he talked about garnish wages and that I had to pay the full amount owed on a credit card from 2007. I caHe said he woild email lled him back and asked for the mailing address and he said to go to Bank of America and write a deposit slip to Palmar & Assoc. He also gave me an acct number. He said he would email me the paper work but it has been 1 hour and nothing. Is this for real??

Hi. I got the called today. They said I have ignored all the papers they have sent to my house. I havent received anything. They said it was about a credit card debt. I called him back and a woman answered and she told me to hold on and the man got on the phone. I asked for the address to mail in the payment and he told me to go Bank of America and write out a deposit slip for Palmar & Assoc and to put down this Acct #-0750072432. I asked him to email me the paperwork and he still hasn't done it. How can I find out how fake or real this is???

These people have contacted several of my family members, trying to reach me. They already have my information on file and have continued to harass me. Do not setup payment arrangements, as they will not be able to provide you documentation to prove the payments. They are trying to solicit for already paid bills and certain accounts which have been dismissed on credit reports.  My suggestion is there with Annon.. Have me served!  If this is a true collection, than you will have the documentation.

These people are a joke.  I got a call from "Tiffany Williams" - said she has "sealed documents" to serve. I told her to go ahead and serve them!  She said they have attempted before.  Nobody came to my house - I work from home!  LOL!  I don't owe anyone money so not sure who they think they are kidding.  Folks...they do NOT call you first to serve papers.  I know from experience of serving my ex husband!  They just come to your house.

The problem is - these people call from a blocked number so you can't report them!

I got this call yesterday on an account that was charged off in April or 08 and they SOL has run out.  It worried me but they didn't even have the correct address to deliver papers to me.  It was a very old address.  i figure if they were real they would know where i lived right??  What did you do?
