Extortion Scam Related to Delinquent Payday Loans

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

They got me, they called stating they were a process server looking to serve me papers. I called them bk and she told me that I was being charged with 2 felonies, bad check and fraud against a financial institution. I gave them money but then called an attorney who told me that it was bull s*** and payday loans are not enforceable in nys!  Now I have to stop any debits from my account from them. What a mess. I made an initial payment to them, then they told me that they emailed a permission sheet granting them permission to debit my account for the rest that had to be signed and returned or they could not debit the payments, and I would have to go to court to face these charges. I never signed and returned the paper and they debited my account the next day anyway. What an a** I am, for $200 I've already paid bk over $800 and they want $475 more before they're done, NEVER again....lesson learned!

Tom Waters called a relative of mine and said that they had co-signed my loan (NOT!!) and that if they did not provide him with the information he was demanding by the end of the evening, that his company would file fraud charges against my relatives....what a joke!  Illegal threats and harassment..don't return their calls!!

This guy wont give any information on who has hired him to collect a debt....hes running a shady business says his name is Jeff Light and that he has been hired to collect a debt. Though he is very nice over the phone and says he wants to help you, DO NOT GIVE HIM ANY INFORMATION.

Are payday loans legal in Arizona?

The law allowing pay day loans in Arizona will expire on June 30, 2010. Consumer loans with annual interest rates over 36% (plus authorized fees) will be illegal as of July 1, 2010. The Arizona Attorney General?s Office plans to vigorously enforce the prohibition on payday lending.

I have an unpaid balance on a payday loan. Does the change in law mean that I do not have to repay the loan?

Probably not. If you borrowed money and promised to pay it back, the sunset of the payday lender licensing program will not, by itself, change that obligation. However, some consumers have worked out a payment plan with their lender.

Legit collectors per section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf *must* tell you at initial contact, or send you paperwork within 5 days of initial contact, the following:
1. $amount of debt,
2. name of the current creditor (which may differ from the original creditor who might have sold your debt),
3. a statement that that debt will be assumed to be valid unless you dispute in writing within 30 days,
4. a statement that that if you do dispute in writing within 30 days, the collector must mail you written verification of the debt,
5. a statement that if you ask the collector in writing within 30 days, the collector must send you the name and address of the original creditor if it's different from the current creditor.
If you don't get the 5 disclosures, orally or in writing (you do not have to ask for it, the FDCPA requires it), treat the collector like you would any SCAMMER. Scammers are using bought/hacked loan application data to extort payments for fictitious debts from victims and victims' families and friends.

He called me twice once last week and today, leaving me messages that I failed to reply to their letters (what letters?) and need me to contact him to verify my address to serve me. Yep, another low life third party debt collector.  They try to skirt the law anyway they can, and I live in Arizona where they passed a law last year prohibiting Payday Loan companies from operating in the state, and that includes collecting on old debts.

I really should talk to these guys so I can get their address, then I can send them a cease and desist letter via certified mail.  I just received a message on my phone from a machine, didn't say who it was, but left a number, 1-877-825-2842.  Also said there have been numerous attempts to reach me via the post office- I never received anything.  This has scam written all over it.

I got a call from a Jesse somebody or another. He left a a DETAILED MESSAGE saying something about me being a "third party arbitrator" and left a case number and his client has specific needs that need to be met in regards to the JUDGMENT filed against me!!?? I looked and this place is a debt collection company. Possibly third party. I have been in the collection industry for over 8 years. The messages they leave are against the FDCPA. Advising there is a judgment on you is also against the FDCPA. I can't wait to talk to them tomorrow! I dare them to advised me false actions against me. I will sue the ever living pants of of them just out of pure principle. The fact I have nothing in writing prior to a debt collection calling is against FDCPA. They must send you notification of a debt before it is sold and the agency that buys the debt MUST send you something in writing before verbal contact is made to advise you of such stipulations.. ESPECIALLY if you have a "case number" and " judgment" against you! I am calling them first thing in the morning and use my own " Legal verbiage " and see how they like it.

The guy who called left a message and said his name was Jesse Michaels.  He said I was named on a possible fraud situation and that I was to call him back at 877-825-2842.  The caller ID showed a number with a 716 area code.  Yet another debt collector using illegal scare tactics.  DO NOT give them any information- they're trying to trick you!
