Smart move! In the state of Ky. and in several other states, a payday loan operation has to be licensed in that state...in other words, they have to have a brick and mortar business address located in that state in order to legally collect on a payday loan. A number of online payday loans are illegal and so are the collection tactics that they use in order to collect debts. Make sure to contact your local attorney generals office. Unless they are licensed to collect in your state, there isn't much they can do. The legitimate means of collecting on a debt is to file a lawsuit but these people will threaten to file felony charges etc..., the truth of the matter is, you took out a loan. This is just a bad debt, not a bad check and there is a difference. When they slap on fees for instance you only owe what you borrowed...not all the extra fees that they add on. But remember that it is illegal for someone to threaten you with criminal charges etc in order to make you pay on a debt. Whether the person calling is a debt collector and or attorney, what they are doing is breaking the law, and the fact that it's the same people doing it should tell you that something fishy is going on. This is an illegal scam operation and they are not entitled to one red cent of your money. If you live in the state of Ky. don't give them a dime. The state attorney general stated that such phone calls and demands for payment are illegal.

I got the same messages from this number one after another, same lady, exact same message. I tried calling this number back and it gives me a message that the number isn't set up to recieve calls??? What does that mean? I know I do owe a loan, but I want to pay back the lender's not these people. Some people will do anything to scam those of us trying to make a living and make things right in the end.

I just talked to these jokers, its a total scam. Once I mentioned that I will not pay and I want signitures in writing to prove its mine he got real nasty, called me a scumbag and hung up. People they have to prove ots a real debt if requested and federal law states that they have to comply with requests to prove it in writing otherwize its b***s***. They can't arrest you and before anything they have to win in a court of law, and without a signature their case is dead on arrival. These places will never take you to court because. They know itz stacked against them and these a***oles stating on here that the company is good and legit, well they ARE thecollection company trying to scare you on this very page. Please read the federal fair debt collection act before you open up ur wallet to them, its there for your protection against these theifs and liers.

A private number called me it was a man who left a voicemail message saying he was trying to resolve a matter regarding a bounced check. He said he wanted to resolve this matter over the phone so that he didn't have to send a sheriff to the house. He said if I would like to know more about the company who has filed the complaint then call 877-410-0612. Where I live the sheriff's office comes out to serve papers. This is nothing but a threatening scum bag bill collector. I think these guys are worse than used car salesman. He said his name was James Griffen from Vickers & Associates.
Caller: VICKERS AND ASSOCIATES

A private number called me it was a man who left a voicemail message saying he was trying to schedule a time so that we could meet but since I didn't answer his call he would come to my house or my place of employment. Said if I would like to know more about the company who has filed the summons he was trying to serve me with then call 877-410-0612. Where I live at the sheriff's office comes out to serve papers. The sad part about I just got this phone number like 2 weeks ago so I don't know who they are trying to get a hold of but it sounds like some crappy bill collector wanting to scare someone.

I received a call from someone claiming to be investigator Walker calling for James Reed. Told me if I didn't call back a summons would be issued for check fraud. I am working with consolidation company to get payday loan cleared up, and they told me this is a scam call and to ignore it.

YES!! THIS IS A SCAM!! Do not give them any money! They called me too and the Federal Trade Commission told me that they are using people's personal information to get more money! Call the Federal Trade Commission and file a complaint. The more people that report this hopefully will catch these crooks. The phone number for the Trade Commission is: 1877-382-4357. Now another number to watch for from these crooks is 1877-410-0612. That number started calling me this month. Same deal. This company is called Baker & Associates attorney James Griffin. I will be reporting these people tomorrow. Good luck to you and be sure to cancel any credit card number that you may have given them if you did immediately. Best wishes.

Wow! I am relieved that I am not the only one who received phone calls from this phone number. Now I know it is a true scam. A woman processor and male attorney named David Phelps called me starting December 2010 until January 2011 harrassing me about an internet loan April 2009 that got paid. I found my bank statements proving I paid the loans in full. Attorney David Phelps (is that his real name?) told me I had pending criminal charges and civil charges pending against me. The loan amount was originally for $300 but now they wanted $963. They said a month ago around Nov 2010 that they summoned me at my address which turned out to be my previous address. I was staying at my uncles house back then. I called my uncle to see if he received a summons for me. No summons was received. I called my bank regarding this and the bank manager told me to contact the Federal Trade Commission. I then called and filed a complaint with the trade commission and since then the calls have stopped. I actually gave these people my preload credit card but figured out that night it was fraud so I never loaded the money on it. David Phelps called again to tell me the payment did not go through. Do not give these people your money it is a scam! Case closed. THIS IS FRAUD.

Bullsh!t. No one is going to show up at your door. No one is going to charge you with a felony. This *is* a total scam. Debt collectors do this crap all the time. You're being read a script. They're job is either to be a total jerk to you, or be a total sweetheart to you -- they do *whatever* it takes to get money out of you. Make sure that you get absolutely everything in writing. Do not ever, ever give them your debit card, credit card, or checking account information.

I have also received phone calls from Atty David Ross 877-834-4106, he stated he was a prosecuting attorney and he was going to contact my local police and have me arrested for a loan that I had with CashNet and have not paid. I did agree to pay me for six months but I wanted proof of settlement in full an asked him to email the info with his letterhead so I would know this was correct and not fraud. I havecalled him about 7 times since agreement and they were suppose to take money out of my account (prepaid credit card) on the 30th but I have never received an email...Every time I have called the number listed I get an answering machine..He called and left a message on my cell phone today and informed me that I have 48 hours to call back, I left a mess again today,,I have no idea who he is or where he is located but it is the same info that you have received. To me it sounds like a collection agency letting their collector falsely stating they are whom they are not and trying to get away with this.

I also had the same situation happen to me as well maybe 2 1/2 weeks ago....but the thing is I had included these pay day loans in a bankrupsty hearing back in MARCH...the company received notice that I was filing and had plenty of time to act upon it if they wanted the debt paid. Also, got the same girl investigator calling me but could give any real detailed info...I contacted my lawyer and told him what happened and it is actually illegal what they are trying to do b/c of the fact that they didn't act when they received that i was filing...so I left a message with "James Reed" stating that to either send me a bill or send my lawyer a bill...WHICH I never received and the phone calls have stopped. Same thing happened to my friend last year...they are just trying to make money.

Just on a side note. Once upon a time I had the same sort of thing happen only the people who called me were so very Indian but had names like Bob Smith. After the threats and lies got me upset enough to give them my debit card number and a promise to make a written statement for them agreeing that I owed what they said I did, I calmed down and started to think. I contacted my bank and canceled my debit card then called the debt collectors back in the morning and told them what I had done. The threats came on full force, "Please cooperate with the police when they come for you." But, fortunately, before I upset them, I asked for the the building in San Fransisco where I was supposed to be summoned. They gave me the name of the building and I looked it up and gave them a call. There was no court date set for me. So I called the Wyoming attorney general as well as my local police to tell them what had happened. The attorney general tried to call the number they had given me and I swear they answered the phone, "Joe's Plumbing." Then they stopped answering at all. The AJ told me that anytime I got a call like this I should just tell them that I only do business through the mail. That I was not obligated to make arrangements to pay any debt over the phone. This is why I'm so suspicious of Attn. James Reed's failure to send me anything when asked.

I received a call from a female "investigator". She left a voicemail with me and with my sister saying that she was notifying me of a pending summons for a bad check I had written to a payday loan company and that I would be facing felony charges as well as the other kind, I forget what she said now. Anyway, I called her back, she had a very distinguishable voice, and when she answered the phone I stated who I was and that I had gotten her message. She claimed it wasn't her and I just went on. The strange thing was that my sister had called her back as well and said that she told her that the investigator who left them message wasn't her. My sister said oh yes it is and told her to stop calling her.... She did. When I called I asked if James Reed would call me back, she said he would. I asked her what was usually done in this type of situation, she said she couldn't tell me what to do but she "advised" me to just pay the debt.
Later when Mr. Reed called me back... He was very nice and willing to work out payment arrangements. However, I asked to have documentation sent to me stating how much the debt was and to whom I would be paying it. I also set up a re-loadable credit card and gave him the number. He is supposed to withdrawal half the money I supposedly owe on December 31st and the other half on January 31st. The problem is that it has been weeks since I made these arrangements and I have received nothing in the mail. I have also never received anything to date in the mail from Attorney James Reed. I believe this to be a scam. I called and left a message at this number for him to call me back. We'll see if he does. When and if he does call I will tell him that I have contacted the Secret Service (who is responsible for protecting the country's financial infrastructure and payment systems from international and domestic threats), the FBI (to let them know that I am being targeted by extortionists over the phone), and that I have filed a complaint with my local police, the state attorney general and the Federal Trade Commission.
If he is a legitimate attorney, he should have no problems sending me documentation. Lawyers LOVE to print crap off and send it out. Just because someone is very nice doesn't mean they aren't a crook.
As I'm reading through dozens of complaints tied to the 877-834-4106 number, what shocks me is how EXACT the complaints are. Same guy, same female investigator with the board-out-of-her-mind voice leaving a message (Then when she answers the callback she claims it wasn't her. It WAS her, the voice was exactly the same.), same threat of fraud and arrest, same AMOUNT. This is weird no matter how you slice it.

Wrong!!!!!! He was an attorney! I researched him! He is now a debt collector! How can we verify that he is who he say he is! They never told me the amount of the check but I know the amount. My bank coldn't verify him. How do I know he's not someone that goes and take money out of people accounts. I want proof!!!!
| babykay 2010-12-29 22:38:09 Unknown |
I got the same call yesterday! When my mom called back, she talked to an Attorney David Ross. Who is he! I think they need to provide proof before any money is sent to them. True enough, I recieved 150.00 loan at the beginning of this year but a month after that, I was laid off! This doesn't make sense to me that I now owe 995.00! To who????? I'm totally confused!

I got a call from a woman who was a process server about a summons being issued out for me, i contacted James Reed after and it turns out he is the attorney retained on a case i had pending against me with my bank, i called my bank and they verified that they did retain his office for a bad check i wrote. I talked to Mr Reed and he was very nice and helped me get this resolved before it went any further. I would strongly suggest contacting him because my bank told me if it doesnt get resolved i could face criminal charges.

xics-
I just spoke with Mr. Reed, he was a very nice man and is willing to work with you, this is not a scam and is a very serious matter if not taken care of, if you had an online loan and you know the charges are yours I would suggest that you work with him and get it taken care of to avoid criminal charges against you. They can show up at your door and arrest you on the spot and you can be charges with a felony if this is not taken care of. Good luck.

I got the same call but did not say why or what it was for, did you ever get a call back? I left him several messages and no one has called me back.
