They're scammers.  Debt is civil, not criminal.  Scammers also "spoof" numbers - make them look like they're calling from somewhere else.  There is *no* jail time and no arrest for defaulting on a loan.  To threaten you with this is a violation of federal law.  Per the FDCPA, you should not pay any caller who refuses to mail - do not accept email or fax - proof of debt/proof they have the legal right to collect said debt.  Refusal to mail this documentation within five days of their first contact is another violation of federal law, and you should not pay them. Bottom line - no written, verifiable proof that you owe your callers money - do NOT pay.  Per the FDCPA.  More info here:

Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

? filed under: Press Release

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

Getting non-stop harrassing calls from this # also. The next time that I can answer when they call (they usually call while I'm at work and only sometimes leave messages), I am going to talk to them and ask them to stop harrassing me. If they do not cease, I will file charges.

The problem with call blockers, especially commercial ones, is that they can only block a number that is put into it. The way around it is to just mess with the people until they stop. :D

Invest in a call blocker, first thing.  Secondly, do not answer calls from numbers you do not recognize.

Go to your local police and attorney general and make complaints.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

-is seeking payment on a debt for a loan you do not recognize;
-refuses to give you a mailing address or phone number;
-asks you for personal financial or sensitive information; or
-exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a  law enforcement agency.

If you think that a caller may be a fake debt collector:

Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.

If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate but you think the collector may not be, contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

Receiving calls 865-935-9286 Advance Capital Solutions. Saying I received a payday loan from CMS Group, LLC in the Bahamas??? That they will pursue me with further action and serve me at home or my job. Screamed at me. I was asking for a copy of the debt and paperwork and they could not provide. I live in East TN and now they somehow have gotten a local number to start harassing.  I know prior i had to file a police report as the person was headed to my house, which I know they cant do it, but I was afraid for myself and my children. How do we make these people stop harassing us. I DONT OWE  THEM ANY MONEY.

This number, 281-569-4560 (the # on caller id), called me today.  The message was cut-off, but told me to call their (?) office at 877-845-5988.  Their is no company name stated on the message.  The reason that i should call them back is "... a decision on this matter is going to made and you need to contact us immediately so that the decision is not made contrary to what you intend for it to be...".  The 281 number is spoofed, because using Google, that number belongs to a legitamate business in Houston, a CPA's office.  As with the other comments prior to mine, this has to be a 'scammer' calling for information, either to scam you, or steal your ID.  When i see the 281 number, i just let it go to vm, but most of the time they do not leave a message.

This number leaves a recorded messege saying the same as above but wants a call by a certain time the same day. The guy on the recording says its in regards to an active file and Delivery of information packet. Failure to respond may result in immediate expedition of the case and decisions being made on your behalf without consent or knowledge. Thats the exact same messege thats left everytime.
