Debt Collector
Got a call from a Paul Curry. He called me using a local Long Beach number but in reality this company is somewhere else. He said he had some paperwork related to my name and SSN and needed me to clear it up before he proceeds. Who knows what they want but my guess is to collecton on debts that are over 10 years old and past the statute of limitations. I recommend you don't call them back nor give them any information about yourself. Whatever you give them will probably be used against you to try to extort you for money that you are not legally obligated to pay anymore.

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

  This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

I receivd a call from 877-851-7773, they wanted to collect on an old credit card debt since 1999.  Do not talk to this scam collection agency.  They are way beyond the statue of limitations.  Their employees need to get honest jobs and try to find pride and dignity within themselves.  I know we are in a recession and everyone is feeling financially strapped.   Do not sell your soul to the Devil d2managment employees.

DO NOT post info in here that may further lead them to you. They are Troll liars and scammers. Masters at ID theft. They use a GEO targeter to get your LOCAL number (area code) and threaten you, Calling out your  name and that they have your SS#. DO NOT FALL VICTIM. They have to use an 877 number for you to call them back and not the local one they called you on because they call outside the US use generic names that sound to them COMMON lol. It's insulting to think we would be stupid enough to give them any of our info muchless PAY them. Saddly people who are elderly are prayed upon. If they call your cell..SCAM, if they threaten legal action.. SCAM. They DO NOT have anything on you. Tell them to remove you from their call list and register on do not call list if you have not already. Report all info to the registry. Hope this helps

Telemarketer
Jonathan Day just called me, woke me up. Called from a CA number (408) 680-2772. I have a CA cell number but live in New England. So right away I knew it was fraud. He addressed me by my full name, said "I have some paper work that has been filed over to my office today under your full name and SS#. I need to speak to you before proceeding forward Call my Law offices  at 877-851-7773." Knew it was telemarketer scam crap. The only reason it bothered me, was he was extremely intimidating and forceful made it sound like I was headed to court LOL. It was the Tone that made me even bother to look it up. I knew I had no business in CA much less with any LAW office and no one calls my cell from CA unless it is a wrong number. Thank you for above info. I called them back told them remove my number.

I got a call from a local number here in KC. When I called it back I got a recording stating they was finding my records and to please hold for next person. I talked to a lady who did not say what company she just said legal dept. I asked her what they wanted and she said it was about a pay day loan I took out seven years ago. I don't recall taken any loan out at that loan company. When I asked her what company she worked for she did not want to tell me at first but then said D2 management and asst.
I told her she would need to send me a letter stating that I owe them money. She flat out said NO. The only way was to pay then they would send a letter.
She broke the law when she said she was going to file legal papers and sue me (garnishment and then she was going to file a 1099c with the IRs) they can not threaten to sue you or to file a 1099c with the Irs. Going to have my atty deal with them oin Tuesday.
Oh she kept telling me three dif amounts that I can pay. SCAM

I too, just received a message from a local number 951-8467548, and he stated, "Mr. Coby, I do not know if you are aware of what is going on, involving your information, but I need to a statement from you regarding this matter."  Thanks everyone for your informative posts with the exception of STEVEN May 22 (which is clearly a lie and a statement from an agent of the collection agency).

Everyone, keep the truth alive through your honest and accurate posts!

Thanks

I've gotten several calls from D2 Management from several different phone numbers.  They claim that they have my name and my social security number and that I need to return their calls immediately to avoid legal action.  I Googled the company name and they appear to be a group of scam artists who try to get people to pay debts that they don't owe.

I received the same call.  Had my id stolen several years ago and each year I find another fly by night company has purchased the "debt" that some one else rung up.  So tired of them.  They seem to pop up after I file a complaint with the credit reporting agencies.
