I got a call from a Nicole from and unknown number.  After stating every name I am known by including maiden name, middle name, etc, she stated that "I'm contacting you regarding an issue that does warrant your immediate attention..."  Went on about a case IN THE PROCESS of being filed with the county I live in.  That police were due to be sent to my place of employment tomorrow.  That it was in regards to fraud.  I advised the woman that I was currently in the hospital and being discharged.  She never confirmed what hospital, my address, where I work (I'm a full time student, so I'm unemployed!).  She called my sister who lives in another state.  She called my ex husband who lives in another state.  I asked WHO was filing.  She said, "There aren't many details, but that I could contact the company filing and handle it that way.  The  contact information she gave me was an Anthony Stan @ 855-229-0883 x 021.  She provided me a docket number which doesn't match anything on my state's governments website....

Seems fishy...
I'm going to call my court's general number and go about it that way.  I'm not calling that number....

They've called numberous times, I had a settlement with them, they called again and threathened me with another summons. Now I'm worried?!?

Same as everyone else. Been getting numerous calls from (877) 866-1312 about some summons and threatening to come to my home and work. Totally Made up stuff---I have no problems with the law or creditors.

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

Got a call this morning from 877-866-1312, close to the numbers above.  A recorded message was left stating that someone would be coming to our home or to our workplace to deliver a summons.  It was not stated what the summons was for or for whom it was to be delivered.  We called the number back from a cell phone (mistake) and a woman answered saying, "Legal Services, may I help you?"  I made up a persons name, asked for Tom, she said, "One moment please." At this point I hung up.  Regretting giving them access to my cell.  Anyone else get a call from this number?

I just had the same voicemail left on my phone as well. Only this "lady's" name was Terry Johnson from "the State". Same thing as all you guys, she was going to deliver a court summons to either my residence or my employment. I have had numerous calls the past month or so from an "unknown" number, and they have never left me a message. I am leary on responding back to this number as I do not know what the "debt" is all about. I am definitely reporting this number to the attorney general in my state to have them investigate further. If anyone has an answer of what happened after their call, please share. This is getting ridiculous!

Hi,

I was just listening to my voicemail, and seem to have come across the same situation as you have.  A man name Tony Baker said I was being charged with financial fraud and he will serve me at work or at home.  He left me the plaintiffs number...877 446 4399.  When I call it, the answering service's intro says its Allstate...and then I'm just led to leave a voicemail.  They haven't called me back yet.  The guy that called me never left a number and I can't retrieve the number from the message he left in my voicemail.  I have no idea what's going on.  I've never had Allstate so I'm worried somebody has stolen my identity or something.  I really don't need some guys showing up at my work for this crap.  If you have any incite into this situation...if you can tell me what you foundout about your matter I would greatly appreciate it since this is really stressing me out.

I had a Robert Fisher call today and left me this message. I am contacting you about an issue, this should warrant your immediate attention, the plaintiff has filed a complaint against you once again in reference to multiple pending bad checks. I was able to get into contact with you; I want to get this summons out to you now. I have had a little bit of trouble locating you, therefore I will be in route with a couple lists of addresses for you, possible places of employment, or some family members were not sure yet. Prior to that being said if you got any questions or concerns regarding to your case, which I doubt you do, but you can contact your plaintiff anyway. The telephone # is uh? 877-446-4399 and your case # is *******. Other than that now that you are aware of the situation go about your day, I?ll catch up with you. I will serve you your paper work to appear in court. You have been notified, good luck.

About a week ago, I had a Jonathan Hobbs that I spoke with, telling me to call 877-866-1310. Saying much of the same thing that Robert Fisher did and adding that he worked for the State of Texas, which I reside in.

I asked Jonathan, who is the plaintiff? He said he did not have that information.
I asked, whom was the check written to? He said he did not have that information either.
I told him every check I have written the bank clears it. He said he didn?t know anything about that.
The only information he knew was a phone # to call and the case #.

They must be looking for another person with the same name as mine.
These debt collectors sure have changed their collection tactics over the years and getting to far in to that gray area of legal and illegal collection habits.

My best friends mother, who is also my neighbor recieved a message from this company looking for my best friend on the 17th of this month. It was actually them looking for me about an unpaid debt with a rent-to-own company. They said I needed to pay something ASAP or the sheriff would be at my home to arrest me & then extradite me back to the state in which I owed the money in. I gave them my debit card info & they said on the 31st they would take the first of 9 payments off of my card. But if I didn't pay I would go to jail. I dunno if it's a scam or not.

This company is a scam. They claim to be out of Arizona, yet they are not registered with the state, nor are they listed with the State Bar. Debt collection agencies must register in AZ as well, yet they are not listed. They call themselves All State Litigation. They refuse to give a street address--why would a legitimate company refuse this? If you speak to them, tell them you know they are a scam. Maybe that will get them to stop calling you. Or you could ask for a street address, ask them what state they have registered in as a corporation, and tell them you will call them back once you have confirmed with that state that they are registered in that state.

I got a call from this number today. The man said he was Bobby Fitzgerald, and the same thing I had a complaint and had been notified of a bad check and bank fraud! Also told me he was coming to my place of employment or my residence. Well I agree a summons has to be delivered by the sheriffs dept and I also think they have to notify you by certified mail! I also will report them.

I just got a call today from this number. The person identifies himself as Ted Williams. He stated he had a summons he was trying to deliver for check fraud and possible bank fraud. Funny thing is, I haven't written a check in 8 years. He stated that he would come to my place of employment and would wait at my residence to deliver this summons. However I could maybe avoid court by calling this 1-877-866-1310 and talk to the plaintiff. First of all, the Sheriff's Dept delivers summons. They do not deliver summons for criminal charges nor do they call your house.They come with an arrest warrant and arrest you for criminal charges.
Anyway, they can go pound sand.

this number called my mom and left a threatening voicemail saying I have charges filed against me. One is how did they get my moms number and not mine when we're in the same home by address, I have no mail from allstate. And none of my three credit reports show any litigation against me. someone is up for a nice lawsuit just simply for spilling tmi.

This person called with a so called summons, and looking FOR ME scaring my grandfather away. With that in mind they can go f themselves...they tried this a while back. Anyone legit can find someone the right way not looking with threats. Have a great day Mr. Marty Kaplan.
