Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Can a Collection Agent Call My Cell Phone?

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

I GOT A CALL FROM THEM TODAY ON MY CALLER ID CAME OUT 210-388-8168 SAYING THEY HAD A FILE WITH MY NAME ON IT AND THEN THE RECORDING STATED TO CALL THIS NUMBER 1-877-873-8509. THEY WHOLE TIME IT WAS A PRE RECORDED MACHINE THAT WAS SAYING MY NAME THEN AFTER PRESSING 1 TO GET A LIVE PERSON NEVER GOT ANYONE ON THE LINE.

I also got a call from 210-338-8168 thinking it was a local call and then when I heard the message it was all broking up a voice of a man saying I needed to call right away and left this 1-877-873-8509 to call back. Never got the man's name or the company names. BEWARE sounds very FISHY!!

The company who has been calling you is probably a scammer. There is no evidence that they actually exist. They are probably criminals who have found your information online. Unless you receive written notification there is no reason to treat them as a real company. They may threaten you to scare you into paying them, but there is nothing they can actually do. Do not give them anything they ask for. File a complaint with your state attorney general's office or contact the new government agency which has been set up to handle consumer complaints:

Payday loan sites get hacked on a seemingly regular basis and  scammers use info hacked from these sites to illegally collect money from unwary consumers. They will often know  personal info such as your last four digits of your SSN, DOB, address etc., all taken from the stolen records.  They use that info to get even more info on you from personal info sellers like Choicepoint. Unless you know for sure you owe the money, be very careful about giving them any personal info, especially bank account information (they will clean you out,).  Record the calls if legal in your jurisdiction, and demand a mailing  address so you can send them a "cease and desist" letter (see FDCPA Sect 809.)   Since these calls almost always come from overseas, there isn't much the authorities can do to stop them.  So protect yourself. The scammers use many scare tactics to force you to pay:
?    Threaten jail time, to "serve you at work or home" or " arrest you at work or home" if you don't pay by a specific hour
?    demand pre-paid Walmart card or Western Union tranfers to pay the supposed debt
?    Tell you "there is a case pending  in the courts".  Check your local courthouse and see if any company has filed a lawsuit against you.
?    Say they are federal agents, government agents, law enforcement, ie; "Officer Smith", ""Special Investigator Jones"
?    Say they are a lawyer or law firm. Ask for their exact company name, address and the names of their lawyers so you can look them up in their state bar association (this can be done online).
?    State a fake company name: again, get the exact address and look them up in their state's Division of Corporations:. If they are not listed there they are not a real company, and therefore, a SCAM!
?    Tell them by law they are required to send you a collection letter within 5 days of the first time they call you. Be suspicious if they refuse to give you their address or won't send the letter through the US Mail. Many scammers email or fax collection letters to skirt the Mail Fraud felony laws.

Unfortunately there is nothing we can do against scammers since they are  not legitimate and not much you can do either other than hang up on them. Keep telling them you know they are not real, they will not get anything from you, and are wasting their time.  Also, tell them you have reported them to the FBI.  Eventually they will leave you alone when they realize they will not be able to trick you into paying them.  Please see this ALERT  from the FBI:

I rec'd a vm from the computerized voice guy 678-327-0094 saying I rec'd a notorized affidavit w/ my name and ssn (I didn't) where I am the primary person of interest and they need a voluntary statement of intent to review w/ their client to determine if any other action is needed.  I was supposed to respond by 11/1/12 (ummm it's 2013).  If I don't call 888-878-5206 by the end of today they will file a commencement of activity.  Don't hold your breath!

This company is continuely calling my family and harassing them saying they need to talk to me. When i call the company it just rings until it come up with a messsage saying error. The company is a fake need to stop harassing the wrong people. If they would ever pick up the phone I would have a name to go with the number, but they never say who they are or who they represent.

Have been getting call after call from this company threatening to to file a "Commemcement Activity Claim" (which does not exist) and if I don't call back by the end of today, they are going to make a decision regarding my file, LOL. Sleeze, Sleeze, Sleeze. These are a group of people that hack local phone numbers ( so it seems like they are a local call) then make what they think are "scary" threats to try and get your money. Well, these scammers are at it again - they called me back in July - same computerized voice - but today a "new sentence" had been added to the thread - and the new line was -  they had a "certified" complaint and if I did not call them back by end of day they would processs paperwork.   I AGAIN called my Attorney General's office - told the lady what had happened and gave them the telephone number they had asked me to contact. - the lady in the Attorney General office said "You called here in July" - I told her indeed I had and had NOT called these people - but I guess they were starting to call all over again.  She laughed and said "same instructions - DO NOT CALL THEM BACK' - THEY ARE STILL "RED FLAGGED" - NOT A LEGIT COMPANY - IF THEY WERE LEGIT THEY WOULD HAVE GIVEN YOU A COMPANY NAME. - SO -  

So - I will give everyone the same advice she gave me " Do NOT call them back - Do NOT give them any information - Do NOT give them your Social Security Number and DO NOT GIVE THEM any information about who you bank with.   They are SCAMMERS !!!!!!!!!!

Rdvd automated call today at 12:38 pm, a recording press 1 if you are (my name).  So i pressed one and a Brandan Jennings got on the phone.  The first thing he said to me was why did i not like to pay my bille.  Ok so right away i am p-o'd!!  So i asked what bill are you talking about?  He mumbled some info really fast and i asked him to slow down and repeat it so i could understand.  He refused insisting that i pay $698.35 in full by 5 p.m. today 10/23/12 or they would be filing a suit against me.  I told him to do what he needed to do..he told me i must be lazy becuz i was able to answer the phone call during working hours!!  Then kept saying that I called them to tell them i wouldnt be paying them what i owe..what i didnt call them they called me..he then hangs up on me.  So i call the number back...309-282-0590..also number 877-873-8509 was given to me to contact.  So when i call back  i asked the receptionist if i could talk to Brandan Jennings. She started yelling at me telling me i was acting like a child and then hung up on me!!  So I call back again...i said i want to talk to Brandan Jennings supervisor, lucky me i get the biggest errogant jerk on the phone refusing to give me his name and he is telling me i am lazy and need to get a job to pay this bill as well as all the others he knows i have and dont pay.  he could hear my minor son in the background and told me if i was to lazy to get a job i should make him (my son) get a job to pay off my debt.  Needless to say....i told him where to go several times and eventually after chewing some major a**...i hung up on him!!

Same message several times in last few weeks.  Some at home, some at work.  Stating I was a "person of interest" and had until 10-18 to reply or a "judgement of activity claim" would be filed.  Gave no company name or any other identifying information.  Said they had my social security number, etc.  Will file a complaint with the FCC.

WelI I called them back and got hold of some woman who would not give me her name or the company and she refused to answer my questions. I insisted several times and she hung up on me. She then had the gall to call me back was EXTREMELY RUDE and NASTY and I told her where to shove it. SHE CALLED back AGAIN, so I cussed her out and hung up on her when she said, and I quote, "... you speak to your mama like that you Mother F#@KER!" I was shocked! She continued to call back several times. I refused to answer phone.  I still would like to find out who these scum balls are. >:0

II received a voice msg @ work after hours just like everyone else gargled, cumputerized. My voice msg. gave me the number & I live in TN - 558-0404, but the gargled computer voice gave me telephone # 877-873-8509. I switchboard both telephone #'s and it came back as blank, also tried calling the both numbers - 558-0404 - music was playing, then after a few minutes it said that the person that I was calling was on another call, to please leave name and #.... but then it said that the voice mail box was full, then it said their was an error.. (?)
I also tried calling the 877-873-9509, and received voice msg. that person you are calling is on another call, pls leave name and number and they would call me right back... then it said.. also mail box is full ... then that their was an error. SO, needless to say I dont know what is going on... I do not owe any $'s to anyone !!! I pay all my bills immediately when they arrive - in full, if I don't have the money to pay, I don't buy. SO I have no idea what this non-sense is about.. would like to find out who the scammer is though...
