Debt Collector
Returned a call to me from 877-877-6129.  Spoke with Yesenia Ferros and she offered to help settle me account. I had been in settlment talks with the original creditor, but learned today that the account was transferred.  Why?  Anyways, the total debt grew by a few more hundred dollars from $1600 to $2100.  I was in negotiation to settle for $1100.  Ms. Ferros offered a settement of paying $477 today and then when I could pay more, to call back and they would talk to their client regarding a settlement.  Paying the $477 would leave a balance of approx. $1600.  Ms. Ferros stated that she hoped to reach a 50% settlment of the balance when I could pay the 50% settlement amount.  I continually explained that I had no more than $1100 to pay at this time. Ms. Ferros talked really fast and kept going back to get my checking account number to get the $477 payment, all the while, I kept asking why not talk to the client now to reach a 50% settlement on the whole balance - which would have been the amount I was willing to pay.  Next thing I knew, a supervisor got on the line - unannounced.  I explained that I had not received any written communication from this company.  It was then that I was told that they just sent me a notice today.  I then stated that I would wait for the notice and then forward to them a Verification of Debt letter.  It was at this time that the male supervisor became sarcastic with me.

What's sad is they could have settled this account had they not kicked into the usual push made by collection agents to get all they can - greedy b*****ds!

I am in Arizona.  Now I have to wonder if they can collect against me if they are licensed in California.  The original creditor was based here in Arizona.  More research to do....

Any information about this company would be greatly appreciated.

no, better yet, read up on the collection agencies, and know ur rights..
California has a lot of protections with pond scum collection agencies.. KNOW YOUR RIGHTS..
and
visit, budhibbs.com

I have had two scum of the earth collections lawyers, who have attempted to collect a paid debt, the debt was paid directly to the credit card companies, not through the collection agency.. And since the collectors won't make any profit off it, they want to collect a second time.. They still can not provide me any proof, on the debt still owed, but they can make lots of empty threats to try and collect.

no, I don't work for bud hibbs.. but he might be able to help ease your worries a bit.

ANYONE Who says anything nice about a collections law firm, is a fake...
No one trusts your kind. Because there is nothing good about rancid dead meat, except that maggots, like Alan M. Laskin and the lackeys that work for it, that feed off those dead rotting corpses.

People, get a real job..

not the best advice especialy if the creditor has all evidence they need to prove you signed the credit agreement. Also asking them to provide a contract between them and the original creditor thru discovery is not going to get you anywere. all the attorney needs to do in this case is object to that questions since it has nothing to do with proving the debt is owed.

Your entry is extremely curious.  First you state that you apparently owe debt, then you state that you had thousands of dollares to pay this "attorneyfirm/debt collector" over the internet.  That is highly questionable and I believe this may be an entry from "attorneyfirm/debt collector" trying to get people to pay them money.

DO NOT PAY ANYONE ANY MONEY OVER THE INTERNET THAT CALL YOUR HOME ASKING YOU TO PAY "DEBTS"

First of all anyone can call your home and state that you owe them money.  There are con artists out there that specialize in getting money from people in financial hardships, those are the people they prey upon like vultures.  If anyone calls your home demanding that you pay them or commit to making a payment to them for an alleged debt, hang up your phone and contact the police.  Most likely these are con-artists trying to get money from you.

In your entry you state that you paid someone thousands of dollars by the internet - as a result of this great folly you were probably conned out of thousands of dollars.  You do not have any proof whatsoever that you payed off any legitimate debt that you legally owed to anyone.

Further, a legitimate attorney would never put a consumer at risk for being ripped off in this manner.  An attorney who receives any money whatsoever, MUST PLACE THAT MONEY IN THE CLIENT TRUST ACCOUNT, any violation of this rule is rigorously enforced by the State Bar of California.

Based on inforamtion and belief, I understand that this is a debt collection franchise of Collect America which is the owner of CACH, which is also known as CACV, and other creditors.  Basically these "attorney/debt collectors" get people to admit to having a debt with them.  They then get the person they claim has a debt with them to make a payment or enter into a "settlement" with them.  The reason they do this is that at that point any statute of limitations that may have existed which would have barred the action in a Court of law begins to run again.  If that does not work then they file a lawsuit in court.  The service of process in these actions is highly questionable - therefore people are not aware that a lawsuit has been commenced against them until it is too late to defend.  If there is no answer filed by the Defendant within a certain number of days they are able to enter a default -these "attorney-debt collectors" are able to secure a defualt against almost each and every action.  A default judgment goes on your record for what I beleive is 10 years at which point they can attach things you own.  The cost to hire a lawyer to defend you in these actions can be extremely costly.  However it is crucial that you seek the help of an attorney if these people or any other debt collection "law firm" contact you.  Call your local bar association for help.  Many times there are volunteer lawyers that can help you.  Be sure that the lawyer is knowledgeable about the tactics of these type of lawyers and that they will be made to comply with fair debt collection practices.  Make sure that they prove through the discovery process that an original contract exists between you and the original debt holder, that contract should have your signature on it "cardholder agreement", they they should proove that they own that debt through the process of assignment of that debt- they should provide a copy of the contract between them and the original creditor - (usually a credit card company) that contract should show the consideration that was paid e.g. usually a few pennies on the dollar, and then they should proove that you authorized each and every transaction for which they are seeking money from you, that means they need to provide you with all statements and transactions.  You should also be sure to check that the debt is not barred from any form of collection by the statute of limitations.  The statute varies from state to state but if the last payment ever made on that debt was over a certain number of years they cannot collect on that debt, period. These lawyers claim to be personal injury attorneys in Calif. and memebers of the Trial Lawyers Association which is an association of lawyers that is devoted to consumer rights and protection - debt collection and the prosecution of consumers on behalf of creditors is not part of this extremely prestigious organization goal for attorneys.  There is something of great concern with respect to the information which this firm puts out to members of the public in California.

First Off I would like to say that using a website  is the best way to Pay any bill!!!!Safe and well Secure!!! I got a call from a guy from some Law  firm in California..about my Credit Card I opened under a different bank name he said it was sold bought resold and now there....I did get a letter but I did not know anything about Metris or somthing I thought I had a Discover thru HSBC... So I was very leary about the call and the letter... After the guy explained how my credit card account was purchased  and re purchased I felt the safest option would be through a secure paysite... He told me that I can pay via Western Union.. but I wanted confirmation immediatly.. So asked for ther website and paid off the 6500 that I owed for a lesser amount..they saved
my wife and I 500.00 dollars.. Trust me I really needed that.. Now I get tons of calls for me and my wifes bills daily at least these guys saved me money and were pretty cool. The guy who helped me talked a little fast but was really good he picked up my sprits by his pure attitude .. When I asked how he was he said somthing like he coludnt be better if he were twins ... that was funny it made feel a little better about dealing with my bill

Law Office of Alan M. Laskin.  Legal attempt to rectify an outstanding debt that defaulted in collections.  Avoiding their calls will only send the debt to court where you'll face litigation ...the outcome is never in favor of the defendant.

They're really great people to work with if you're calm, respectful and fully honest about your job and financial situation.  Willing to work with what you have, and understand that you need to keep a roof over your head and food on the table.

The important thing to remember is that avoiding them will only land you in court.

Hope this helps.
