They called said my wife had a loan, return call number 855-942-6682--hadn't seen that number on here yet. I used to work for a small regional loan company and much of my day was spent calling back customers that were late on payments. So when I told the dumb a** on the phone that he was crazy, talking criminal charges on a loan that had been paid off already, he got nasty and continued to threaten me. I hung up, and started looking this crap up, which is what got me here. Don't pay these scammers a cent!!

How To Spot A Payday Loan Collection Scam

1.  Introduction

Even if you have never taken out a payday loan, simply by providing your personal information in an online application on a payday loan website will subject you to this scam. What happens is that your personal information - ALL OF IT - gets sold to third parties who may or may not have malicious intentions to make use of it. That is why these callers can be very convincing. Often the calls start with the caller asking if this is John Doe, DOB xx/xx/xxx and SS# xxx-xx-xxxx. If they have all this personal information, they must be legitimate, right? WRONG!

Many of these third parties are overseas companies from whom you will never recover your money if you pay them. While there are legitimate debt collectors out there attempting to collect legitimate debts stemming from payday loans, I hope this guide can at least help you weed out potential scammers that want to do nothing more than separate you from your money. With that in mind here are the tips to spot a potential scam.

2 .  The caller threatens you with arrest if you don't pay.

One potential victim recounted that the caller told her a sheriff was ready to come to her house that same evening. Of course, that never happened. This may also be a false and/or misleading representation under the FDCPA. Specifically, 1692e(4) states the following to be a false and/or misleading representation: "The representation or implication that nonpayment of any debt will result in the arrest or imprisonment of any person or the seizure, garnishment, attachment, or sale of any property or wages of any person unless such action is lawful and the debt collector or creditor intends to take such action."

3.  The caller fails to identify the name of his collection agency.

There is no legitimate reason for the caller to withhold the name of the collection agency he/she works for. Furthermore, even if he/she does name the collection agency, it may often be a fake name, or nothing more than letters. Ask what the letters in the agency's name stand for. Often you will not get an answer. If the caller does give the name of his collection agency, put the name in google and see what comes up. You will often see reports of others who have been victimized by the same company.

4  Did the caller state he was attempting to collect a debt?

Often these callers will violate so many provisions of the FDCPA that it becomes clear that you are being scammed. Sections 1692e(11) states the following to be a false and/or misleading representation: "The failure to disclose in the initial written communication with the consumer and, in addition, if the initial communication with the consumer is oral, in that initial oral communication, that the debt collector is attempting to collect a debt and that any information obtained will be used for that purpose, and the failure to disclose in subsequent communications that the communication is from a debt collector."

5.  Did you get a validation notice in the mail?

Typically, this collection agency will fail to send a validation letter within 5 days of the initial phone call. The FDCPA requires that, within 5 days of the initial phone call, a debt collector must send a letter to the alleged debtor containing the amount of the debt, the creditor to whom it is owed, that you have a right to dispute the validity of this debt within 30 days of the notice or it will be presumed to be valid by the collector, and that if you do dispute it in writing, the debt collector will obtain verification of the debt. I have yet to see any victim of this scam receive this required letter.

6.  Google the phone number

If you have caller ID, enter the phone number of the caller into google and see what comes up. Again, you will often find reports of other people who have received similar phone calls. If you don't find any useful information, don't worry. The other tips in this guide may provide you with enough information to assess whether you are being scammed by the caller. If you still have concerns, consult a local consumer attorney in your area or go to www.naca.net to see a list of attorneys in your area.

7.  Caller refuses to provide you an agreement in writing for any payment arrangement, prior to payment.

Do not ever agree to any payment arrangement without getting it in writing. I cannot stress this enough. Payday loan scams involve getting your payment information as fast as possible and putting it to use as fast as possible. NEVER EVER GIVE OUT YOUR CREDIT CARD OR CHECKING ACCOUNT INFORMATION OVER THE PHONE TO THESE CALLERS. If you believe it could be a legitimate attempt to collect money from you, you should still consult with a qualified consumer attorney in your area or go to www.naca.net and search its directory.

8.  Caller won't provide address to mail payment. Only accepts payment over the phone.

This is a huge red flag. Don't fall for it. The caller may even offer you a reduced amount if you pay right away over the phone. While many legitimate debt collectors will press you to make payments over the phone, they will also accept payments by mail. Do not trust any caller that tells you that payments can only be made over the phone. I cannot say this enough: NEVER EVER GIVE OUT YOUR CREDIT CARD OR CHECKING ACCOUNT INFORMATION OVER THE PHONE TO THESE CALLERS. You will never see this money again.

9.  Is this debt collector registered in your state?

Many states require consumer debt collection agencies to register prior to engaging in debt collection within those states. Check to see if this company is registered in your state. For example, in Florida, consumer collection agencies are required to register with the Florida Office of Financial Regulation. You can search that office's website for information on any specific collection agency that has registered, when it has registered, and whether the registration is still active or has expired.

10.  Did you receive what appears to be an official summons and/or complaint?

Some payday loan collectors use fake legal documents to coerce their victims into paying. It might show up as a civil lawsuit or it may be a criminal complaint. But it may be very, very fake. As someone who has represented clients who received such fake legal documents, I can tell you it really does happen. Don't ignore them. Consult with a consumer lawyer in your area to see if the summons and/or complaint are real. If they are fake, you may be entitled to damages under the Fair Debt Collection Practices Act.

My youngest son received similar call from the same number 877-892-7219 regarding his brother's old debt.   They told him to inform my middle, they would serve him at work if he did not call by end of day.   My son then called me since I have been a paralegal for 28 years to see if they could actually do what they have indicated on the phone.   1.  Serve my son at work; 2.  Contact family members/friends and let them know party has delinquency debt/or any info on account; 3.  Threaten with garnishing wages; 4.  Place my son in jail; etc...

When I tried to call above number, it was blocked.  I then called the number they gave for return calls (855-576-8628) which is a collection agency out of "Upscale" New York.  The lady indicated they were called UCG and were a claims processing firm and had processors in Texas.

Now she would not discuss the issue with me and referred me back to blocked #.   I have indicated to my son to turn these people in to the AG's consumer division Department and would recommend all do the same.

Now she would not discuss the issue with me and referred me back to blocked #.   I have indicated to my son to turn these people in to the AG's consumer division Department and would recommend all do the same.

Here actions which are a violation of the Fair Debt Collection Practices Act.

1.  Determine if debt collectors are violating federal law when contacting these third parties.

Debt Collectors are allowed to contact your friends and family members if they do not know how to contact you. However, when they contact them, they are only allowed to attempt to acquire your location information. If they already know how to contact you, or if they are disclosing to these people that you owe a debt the debt collectors have violated federal law. You likely are entitled to file a law suit against the agency and force the debt collectors to pay for your legal fees in bringing the suit.

2.  Determine which debt collector(s) are making illegal telephone calls.

To successfully sue the debt collector and get the telephone calls to stop, you'll need to determine which debt collectors are breaking the law. Ask the person that was contacted if they know what company called them. See if the person obtained a telephone number.

3.  Document the date and contents of the calls.

You'll need to document the date and the contents of the illegal telephone calls. This can prove rather difficult if there are more than one collection agencies calling your friends and family members. Visit www.debtcollectorshateus.com for a collection communication log to assist you with this step. Speak to the person that was contacted and get a summary of how the communication went.

4.  Contact the debt collector. (Optional)

This step is optional but I advise completing it. If debt collectors are contacting your friends and family members, they may state that they are doing it because they don't know how to reach you. In my opinion, this is simply not true. However, to contradict this argument, you may want to contact the specific debt collector and give them your current telephone number. While it is true that it is likely you'll start getting collection calls on that telephone number, it is better than being embarrassed when they call your friends and family members.

5.  Determine if you have a FDCPA case.

Step #4 is, for the most part, irrelevant in determining if you have a case. Feel free to proceed to this step after Step 3. If third party debt collectors (a company that doesn't work at the company that gave you the loan) are calling your friends and family members and you believe its likely that they know how to get in touch with you it is likely a violation of the FDCPA. If third party debt collectors are disclosing to your friends and family members that you owe a debt, they have likely violated the FDCPA.

6 Hire an Attorney

If the debt collectors have violated the FDCPA, you are entitled to sue them and the debt collectors have to pay your legal costs and fees incurred while suing them. Most likely a lawyer will take your case on a contingency fee, meaning you don't have to pay the attorney unless they win the law suit. Just got a call from this company. As I was talking to them I was researching their number and company name (UCG). I decided to read to them some of the comments I was seeing. They promptly started telling me that I was dumb and probably used Wikipedia to do research papers. I quickly ended the call. Now they call me every 10 minutes. Looks like I will be filing a harassment claim soon.

Received horrible phone calls from this company.  Threatening to sue me for fraud for an old payday loan, very forceful and very rude.  After I hung up from them and started to think about the address on file they had for me I then realized they didn't have my complete file from the payday loan company.  They had very old info on me.  They mentioned trying to contact a family member who I haven't spoke to in years and never mentioned the references on my original application.  I explained to them that I had been doing business with this company for over 10 years and always made timely payments in the past and when they accepted my check they knew it was bad at the time so fraud couldn't be proved. For every comment I made he made 2 more disputing what I was saying.  Now they call me every day to the point I have to turn my phone off.  I guess I'm going to have to change my number.  I truly believe they are scammers.

Also; the number that the UGC LCC locator call me from last week - showed up unknown, but today it came back as 512-647-1000, and the number to reach UCG, LCC was a different number 855-880-7673, however; the claim number was the same.... funny thing is that I told the lady from UCG (New York) that they need to let their locators know that it's against the law to call anyone here in Texas at work.

I guess they don't care if their locators get in trouble for harassment charges.

Last week I rcvd a call from this person stating that had legal papers to serve me at MY JOB, but she did not like doing that, to stop her - I would need to call this number 877-892-7219 - I did call, I spoke to a MR MILLER, who assured me that this was not a scam and claim from Impact USA Cash that I was in fault... back in 2008 - are they Kidding me... he then transferred me to another person to confirm payments options... UCG LLC based in New York... once I hung up - it occurred to me, that I don't remember ever taking a pay day loan from IUC - after investigating further I was right...
Now the locator just called me again - why? because I did not put money in my card for them to take out and the locator stated that the order has now come back to her for me to call UCG and take care of it or she will be forced to come to MY JOB and serve me papers... HUMM, do you think she will be surprised when she shows up, and I have the Police here.

Harassing phone calls from this number saying they have taken over collection for Archway Holdings. I have emails from Archway saying that National Credit Adjusters have the account. They are threatening me and telling me they are sending the police to my job. They first called at work. It's embarrassing. The number comes up in a google search as a cell phone in India. They called again telling me I was a low life washed up office clerk. Said to give them the information so he could locate me. I hung up. He called back again and used foul language telling me that I was uneducated and a baby.
I told him does he kiss his mother with those lips and to stop calling here,
I hung up.
He called again and continued to say horrible put down words and reasons to scare me.
My last words to him was...show up and bring a box so when you leave you can carry you pieces of yourself back home!
The nerve to call at work and talk to me and my fellow employees like this.
He said his name was Daniel.
So if you get a phone call like this tell him Jenn said Hi and "f*** you".

*Funny how he commented that I'm a washed up office clerk, didn't know college offered degrees in a***ole collection agents. Single Mom making ends meet each month.
