Thank you princess!  You were absolutly right! The "process server" that called was a fake as there is no peding case aginst me. I checked with the clerk of courts my county. I also contacted the loan originator who Capital said they were hired by and they stated the did not hire anyone to prosecute me for fraud.

I called Mrs Davis at Capital back and at first she spoke down to me like she had previously but once I informed her I checked with the court and there is not court date set for me or pending case like she stated she quickly began to fumble over her words and then hung up. I called back because I also wanted her to know I reported them and their phony process server to the FTC. She stated that I need to stop calling them and harrassing her.  Me? Harrassing her? This is the same lady who told me the police were going to show up at my office.

I'm glad there are places like this where citizens can warn eachother of these scum bags!

you need to go on the FTC.GOV website and thoroughly read the fair debt collection practices act...FDCPA...these people are scary as hell, but what they are doing is illegal. cancel your credit card immediatly and notify your bank's fraud department. also place a 90 day freeze on your credit with the credit agencies. they havfe to notify you, IN WRITING VIA US MAIL of the debt within 5 days of initial contact with you, expecially if you request it. you have 30 days after receiving the information in writing to dispute the validity of the debt and send them a cease and desist letter (registered mail, return receipt requested). but since they are already using underhanded and highly illegal tactics it will probably not stop them. it will however give you a deeper legal edge against them, and you should notify an attorney. there are dozens that specialize in cases like these, and they can advise you further.

I rec a call from Mark Little who claimed to be a process server. He called the main number at my place of employment. He stated that we would be serving me papers to apper in court for a fraudulant check but if I wanted to settle it out of court I could contact the client who retained him and see if they would allow me to settle the debt out of court. I called and spoke to a Mrs Davis who claimed to work for Capital Assoc and she stated that I had to pay at least 10% by Friday and I could split the remaining balance into two bi weekly payments. She kept stating that my court date was already scheduled and if I did not pay the process server would show up at my place of employment with law enforcement to serve me a notice to apper in court.
She also stated that if I did not pay or set up an arrangement there would be a $2600 fine plus legal fees.
The debt was a P$) I took onlline and payed several payments on. I payed more that the principle back to the company I took the loan from. I was advised by my bank to close my account so I could settle the debt without them having access to just take money from my account.
Mrs Davis stated that me closing the account was considerd fraud and ithat is why I was going to be served papers.
I gave her my card info and set up the payments. Am I an idiot for doing this or were they really going to take me to court over a 300 dollar loan that I already paid like 500 on?

Scam-a-lam-a!!!! I just got off the phone w/them. Talked to May...their number is listed on a list of scammer phone numbers. Do Not give them any info!!! Oh and she said she works for Capitol Assoc. and is located in VA.

they are also calling posing as an attorney's office...they claim they are representing the state of illinois, city of springfield, in a lawsuit to be filed...but if i wish to settle out of court i can pay them over the phone by credit card in the next 24 hours or i will be arrested. um...yeah...i don't think so...
