Beengarnished, And All others, get a clue already!!! The reason it's called a CREDIT card is this FACT OF LAW. (canada) Bills of exchange act sec. 155 or there about. U.S sorry not sure but it's similar. States that the signature creates the money.  Wait a minute if a signature creates the money on the AGREEMENT(not a contract) / Promisaary note. who does the money belong to the signature created? WHY OF COARSE it belongs to the owner of the SIGNATURE or YOU. the scam is the BANKS, card issuer never lent the money in the first place! In Fact your signature gave the bank/card issuer the credit of what ever the amount was. Hence the name CREDIT CARD.

So these people have called me the past two nights after 6pm harassing me for this money I owe them!! When asked if miss dabney could send me a fax containing this information she sent me an agreement with my name on it but the wrong address, as a matter of fact a completely different state!! She then contacted one of my neighbours claiming to be a law office and wanting information on me my mom and my father! I do not recall using this creditor cash net before. But I was a victim of a scam before and they kinda did the same thing but were foreign and told me that I had to pay money or the police would pick me up the next day! I got scared as anyone would and tried to settle the case and gave them money! A lot of money lost and days later realised it was a scam!! What do I do about them continuing to call me and bothering my neighbours? Please help, this is a lot of stress I don't need right now. They are calling me from theses number 716-362-6397, 1888-254-0874 ext 329 fax number 716-332-0706

It's a scam from a supposedly legit company called CashNet. Never have any business with them, filed reports with the police department and faxed and mailed them documentation several times disputing the claim, which they of course never receive, but still the guys at this number hound us. Too bad they can't visit me in person. I'm sure I could clear all this up with my documentation.

They've been calling me for months! The woman who's been initiating the calls has told me her name is Theresa Duda.  She also gave me 716-332-0706 as a contact number for the Law Offices.
I plan to follow your instructions and hopefully, together, we can all stop this insanity.

Please read below.

In October of 2010 I was contacted by this company in relation to a debt which I owed Cash America a payday loan company. I owed $766 to the original creditor. I could not be reached so North East Capital called my parents 7 or 8 times a day trying to find me. I proceeded to contact them at that point and I dealt with Greg Trider. Mr. Trider was very abusive towards me. He threated to sue me over the debt and make it a $1300+ debt instead of a $766 one. I had no money and was only working part-time at the time. The conversation got heated and Mr. Trider ended up telling me to look at myself in the mirror and say DEBTOR DEBTOR DEBTOR. I then hung up on him. After calming down I called back. I spoke with Jon Bomberry who seemed reasonable. I setup a payment plan with Mr. Bomberry to make 6 payments of $83.33 per month. I also had a letter e-mailed to me stating same and that all payments must be made by the 22nd of each month and the final one was due on March 22. I kept to these terms. I sent Western Union Moneygrams usually 1 to 2 weeks before my payments were due. My 5th payment was made over the phone via credit card. I called last week to setup my final payment of $83.33 I could not reach anyone at the company and my calls were not returned.

I finally spoke with Mr. Bomberry on Saturday the 26th. He told me that he was handling the case for another agent and that he did not have my info and  could not reach his boss to close out the account. He told me to call on Monday the 28th in the afternoon and that being a few days late would not be a problem. I told him again that I had been trying to pay since before the deadline but nobody would take my call. I called him on Monday 7 times with no answer and no return. I left repeated messages on their switchboard and I sent an e-mail to them as well. I then sent another e-mail on Tuesday the 29th and called repeatedly and left repeated messages again with no response.

This morning I finally reached Mr. Trider who told me that they were no longer North East Capital and that I owed the entire balance due of $766. I said that I had a written agreement and they had been dodging my calls. He then told me that the debt had been recalled by Advance America the original creditor and that I would be contacted by them. I asked for his supervisor which he refused to let me speak to. I asked for Mr. Bomberry but he was not in the office. Mr. Trider said I should stop calling and sending e-mails harassing him and not to call him ever again. I feel that this company has played a bait and switch. They took my payments in order to reset the 4 year SOL dealine. They never had any intention of allowing me to settle my debt with them as Mr. Trider told me that my agreement was not a signed contract and that I owe the full amount. He stated that many other people were now in the same boat as well. I have been lied to and abused by this company. They are bottom feeders!

Deborah. Come on. You operate a law office. Right? You advise consumers of pending lawsuit. Right? You sue debtors. Right?  You know it takes time to prepare and gather information to properly file a lawsuit proceeding against an individual. Considering the overwhelming evidence (documents) being considered. Furthermore, you make mention that my employment was terminated for lack of production (lol) and attendance (lol) and other issues (lol). However, you also made statements that I had resigned my employment. So, which will be your defence? Resignation or Termination?

All the elements of your business will be exposed before the courts to be adjudicated with merit before a proper forum. This may have negative impact against you. I am prepared more so than ever.

I have documentation otherwise. The signed letter of employment that bears your signature indicates that I have exceeded my monthly performance. Also have records of ALL production efforts since McKelvey Law Offices. And clearly if these were of concern (production and attendance and other issues), have you any record or documentation that bears my signature that I was notified and given an opportunity to correct? NO! The employer is ONUS to support such evidence.

My money is in my wallet. Your money is in your mouth, hence the excess skin. Again, Ms. Maloney, as owning and operating a law office (assuming you are a barrister/solicitor or other) that it is time consuming while gathering and preparing for such a legal proceeding. In this case, according to prior case law rulings, the damages are for maximum compensation. You failed to comply with The Employment Standards Act. Also, Terrance McKelvey also failed to comply with contract for employment.

PS. I have located copy of the employment contract which is what has delayed the action. Be prepared. In the next few weeks things will begin to develop.

And Remember. THINK CLEARLY. FEEL DEEPLY. ACT WISELY.

the law offices my be closing very soon.. they have only 4 debt collector employees left working for them and are desperate to keep there operation functioning.  it is understood now they are offering loans to pay payday loans?...seems like another method of fraud or a scam. whats going on with this office. seriously needs to be investigated and indicted for felony fraud. FBI in Buffalo has already been alerted.

Companies do not have to disclose their names or location unless they are asked and especially by a 3rd party ... also note that as a bill collector they are not obligated to give you their last names more than one time during the entire call!!

I think payday loans should be illegal. You want to know why people take out payday loans? Because they are desperate. People don't take out payday loans to try and screw the system. No one gets rich off of not paying back payday loans. People get stuck into the cycles because when you can't pay it, they have you take another one out to pay the first, then you are screwed for more interest. They prey upon people who have no money. These poor people wind up paying the payday loan companies obscene amounts of interest. Then they shut down their bank accounts because they become desperate again. Payday loans may spell everything out in a contract for you, but they make it seem like it's so easy to pay off. Not true. They are financial vampires. Sucking the life out of people. And jail time for debt? If that were to happen you'd be on here complaining about paying the taxes to cover that expense in this country. Use your brain.

I think you are very one sided in your opinions of people who get themselves in debt. Just because you've never been in trouble with money doesn't make you any better than any of us here. Get off your high horse and clean up your language.

BUFFALO, NY (WKBW/RELEASE) - Attorney General Andrew M. Cuomo today announced the filing of felony charges against the owner of a debt collection company that targeted military personnel and harassed active members of the military and their families.

The investigation led to the filing of criminal charges against Stephanie Lowinger of Anderson Place in Buffalo, owner and operator of Neimen, Rona & Associates, formerly Morgan, Stone & Associates and now known as Gordon, Cappolli & Associates, all debt collection companies based in the Buffalo area. In addition to the criminal charges, the Attorney General has also filed a civil lawsuit seeking to shut down Lowinger?s operation and secure restitution, penalties, and costs. The action is the latest in Attorney General Cuomo?s ongoing probe of illegal practices in the debt collection industry.

The investigation found that Lowinger specifically targeted military personnel, referring to their alleged debts as ?special accounts.? Lowinger instructed employees to find out where the military members were stationed and identify their commanding officers. Lowinger had employees threaten to call and, in some cases, actually did call the commanding officers, both of which are illegal debt collection tactics.

According to a former employee, Lowinger also contacted the military
personnel?s family members in order compel them to pay, another
illegal tactic. In addition, the investigation uncovered that Lowinger
falsely told military members or their families that she worked for the
Department of Justice and illegally demanded immediate payment. She
allegedly said that if payment was not made immediately, the active duty
family member would be arrested by the military police and would face a dishonorable discharge.

?This individual is accused of operating her businesses in a lawless
fashion, instructing her collectors to do anything necessary to collect
on an alleged debt, even if it meant harassing and threatening members
of the military and their families,? said Attorney General Cuomo.

?We will continue to investigate debt collectors who try to take
advantage of unsuspecting individuals facing hard economic times and we will bring them to justice.?

Among the allegations detailed in Attorney General Cuomo?s court
papers, Lowinger and her collectors:
? Falsely claimed to be lawyers, investigators, detectives, and
mediators
? Threatened consumers with arrest, jail, and lawsuits
? Threatened to seize the assets of consumers
? Inflated the amount allegedly owed
? Attempted to collect debts from consumers not knowing if the
consumer actually owed the debt
? Targeted family members of consumers, wrongfully disclosing the
existence of alleged debts to family members, and attempted to collect
the alleged debts from family members
? Harassed consumers through repeated and constant calls, using
abusive language
? Levied unauthorized charges on the credit card accounts of
consumers

The civil case against Stephanie Lowinger and Neimen Rona & Associates is being handled by Assistant Attorney General James Morrissey and Senior Consumer Fraud Representative Karen Davis under the supervision of Deputy Attorney General for Regional Affairs J. David Sampson. The criminal case is being handled by Assistant Attorney General Paul McCarthy under the supervision of Deputy Bureau Chief Richard Ernst and Bureau Chief Gail Heatherly of the Criminal Prosecutions Bureau.

I would like to think that everyone could be more professional than this and stop all the back biting. We are all in a very difficult industry as it is. When one collector speaks poorly about another collector, doesnt it just make everyone involved look guilty? and offering peoples home addresses? thats just asking for a problem. People have children that could be put at risk by doing that.

Also, Alan...Please dont ever suggest that you know anything about what is happening in my life or career. Saying anything illegal would happen with me under a roof is silly, and you know it. But you always did have a habit of using statements like "rumor has it" actually, now that I think about it, that sounds an awful lot like the way Bud Hibbs writes too.

According to Bud Hibbs Consumer Justice. The Law Offices are Scams, liars. Anything goes. Avoid at all costs. Many do not have have the requisite state license or surety bond, required by state law. Serial FDCPA violators. Many will lie, impersonate law enforcement and lawyers in an attempt to extort money. These are the worst of the worst who care only about taking your money.  Many hide behind phony names, dummy corporations,  mail drop boxes, etc. They prey on consumers as scammers and con artists to rip off money they may not be owed.

The law binds attorneys and law firms who engage in the collection of debts and the collectors that work for them.

The Law Offices engage in the collection of debts. One recent scam involves sending mail from the United States in which they are actually prepared in Canada at 94 Jarvis Street., Fort Erie, Ontario CANADA.

The Law Office employees are sometimes quick to blur the line in collection activity. Calling your firm "The Law Office" doesn't make you a law office, especially if your business is exclusively collections. In Ontario, this collection agency is licensed as "DMG Consulting" under the name of Deborah Maloney.

They try to impress you with titles such as 'Head Legal Assistant to Attorney Smith', or use the most intimidation to force payment with such classics as, "the paperwork is ready to send to the courthouse for suit."

One of my favorites: "We don't have time to play games with you. Are you sending the money today or not?" They get their kicks convincing debtors that they have life and death power over them. Fear cannot be relieved by giving someone your bank account information. Don't let them use the phone as a weapon of terror.

You almost never allowed to speak with the attorney who sent you the letter because he is always "in court." You are told they never take calls from debtors. Well that's not correct. The law states that if an attorney places their name and/or letterhead on a collection notice or represents as a law office, and attorney MUST make themselves available to talk with you and they MUST have some knowledge of the debt. Don't be intimidated by these tactics. THEY CAN BE HELD ACCOUNTABLE UNDER THE LAW! If you feel that your rights are being abused by The Law Offices - a debt collection agency, file a complaint with your State Bar Association, the New York Attorney General Office, the Federal Trade Commission, the Ontario Ministry of The Attorney General, The Law Society of Upper Canada, The Registrar of Collections for Ontario.

The Law Society of Upper Canada has IN FACT determined this collection agency/law office is in violation of both lawyer regulations pertaining to law firm ethics and practices and prohibited debt collection practices. PROHIBITION AGAINST USING A NAME OTHER THAN THE NAME A COLLECTION AGENCY IS REGISTERED UNDER - Ontario Collection Agencies Act, R.S.O.

It is illegal for a collection agency (DMG Consulting) to communicate with a debtor (US consumers) using any name (The Law Offices) other than the name (DMG Consulting) under which the collection agency is registered. (Section 135)

Therefore, it is illegal for a collection agency employee to hold himself out as calling from the creditor, a law firm (The Law Offices), or some government agency.

You are a victim and your co-workers and family should be made aware.  It could just as easily have happened to any of them.  

I have been tracking the tactics of these scam artists for a long time.  This type of thing is now happening all over the US, but, as usual, national and local authorities have been slow to react.  

The "Law Offices" is simply trying to extort you.  It is the same as if they had a gun to your head or to the head of a loved one. They will likely keep calling because this is a scam.  They don't care about the law.

They also don't care about threats of law suits because every six to eight months they will just dissolve the company and reorganize with a new name and letterhead.  Usually when they do this they don't even bother to change their office location or telephone numbers and all of the "accounts" that were being collected by the old company are "sold" to the new company.  In the sham false debt collection industry this is normal operating procedure, so you shouldn't lose any sleep over this.

Suggestion: You may want to try to use the free computer program "phone tray free" from cnet.com to screen ALL of your bogus calls.  When I get an unknown caller, I look the number up on 800notes.   If I don't recognize the number, i.e., a scam debt collector or other scammer, I simply block the number using phone tray free.  Works like a charm and simply requires a telephone line splitter to connect your computer modem to your telephone line.  Works with either a voice or data modem, but has a few more capabilities with a voice modem.  This is a very nice piece of work.  Simple, yet totally effective.  One thing I have done is block ALL calls from the Buffalo, NY, area code of 716.  Buffalo is the scam headquarters and stinky armpit of the world, so anything coming from the 716 area code should be examined carefully.

Suggestion 1: Cut way back on the meds.

Fact 1: The people involved in this collection scheme are likely crooks.

Fact 2: If you are a so-called "honorable debt collector," why would you want shady people like these to give governments an excuse to pass even more laws to regulate your wild west industry?  Some day the debt collectors will look at these days as the good old days when they could get away with anything.

Fact 3: When you look in the mirror, do you see a crook or an honest person?  If it is a crook, you need to get that fixed or "you will eventually end up destroying you."  It always works that way.  Law of nature.

Suggestion 2: Fix your caps lock key.  Your implied yelling makes you seem like a child, or at least someone you is unfamiliar with Internet protocol.

Fact 4: Many people who are chased by junk debt collector never owed the money in the first place.  You're just doing skiptraces and trying to attach someone else's old debt to anyone you can find with the same name or a similar name as the person you are looking for and who is gullible enough to fall for your tricks and attempts at extortion.  This agency is likely doing this based on the documentation on this website.
