Debt Collector
I have recieved a call from these people two days in a row now and it always shows up as a local number in my city but they give me the 888 number to call back and all they say is they need to verify my address and tell me they are from ncr and her name is Christine Williams.
I have had calls similar to this before and they refuse to send me any paperwork. Do I  call them back?

I received a call today from an unknown number. They left a message saying they were NRS but looking for a different person (who happens to be my brother who I have not seen in years and lives in a distant state). When I called back and said it wasn't his number, they said he gave them the number and it wasn't about a debt but they couldn't tell me what it was. I'm guessing it's a scam. Very annoying to be calling my cell phone while I am at work.

Debt Collector
Received a call today from unknown number.  They left a voice mail stating they were from NRS and they have made several attempts to contact me.  Don't know what it is about, my payday loans that I did get were paid off a year or so ago, and I have yet to receive any type of documentation from them in the mail.  I know debt collectors are required by law to send something in the mail...if they have my phone number, they surely have my address too.

This is supposedly from a debt collector, attempting to collect on a debt that does not exist.  Various numbers have been used by these people, to include unused/available for use, numbers in the calling database of the state I reside in,  (I checked)  They are scammers  that are somehow making calls through phone numbers of other agencies and companies around the country.

You will have to receive some type of notification from the court.  The Plaintiff will file suit (i.e., "sue you") and you are notified of the suit.  Although it differs by state, the defendant is given a period of time (like 30 days) to file an "answer".  At that time the court may schedule a hearing for the case. Now, occasionally there are a few "firms" that hope the defendant won't answer and won't show for court, thus they win a default judgement.

Everything reported in this thread (including the vague "shill" or "fake" posts at the top) has the hallmarks of a scam.  They will bill themselves as "mediators" or "process servers" to confuse consumers.  You can always call your local clerk of courts to see if you are a defendant in any "civil suits".  In fact, most "clerk of courts" office have a webpage, and you can actually run your name to see if you have been sued.

It is not typical for some "mediator" to call and ask for payment so a suit is not filed.  People generally just sue.  BTW, if I were to file suit against you, I would sue for "costs" as well.  What would it benefit me to settle for less before a hearing?

However, any legal advice you get on the Internet is worth what you pay for it.  If you have used a lawyer before, call him/her, they can probably answer your question on the phone.  You can also call "legal aid" or a "law clinic" for free advice from an attorney

Its illegal to do so! Legally you must be served by a real server with a court summons.  You should also have received a debt validation within 5 day's of the first call phone call..  This is sounding like a scam operation. Close your account asap! File fraud, file reports with the authority's.

Do not give them anything. Follow the steps in what you need to know and read up on your rights:

Can a law suite go through the court system without notifying the person being sued? I am being told that I am being sued by a title loan company and the person that is calling me from this number is claiming to be a mediator paid for by the loan company, but working to settle before going to court and I am affraid that I trusted too much and gave him credit card info to take care of this. This guy calls me several times in a row on the day that was scheduled for payment and my money hasnt came in. He is bugging the piss out of me for a date of payment that I cant give him.

You are correct - I have payday loans that have been discharged in bankruptcy and I still get calls from collection agencies - or someone who says they are part of one - threating to have me arrested and charged with a felony.  This is a big load of crap and highly illegal.  I reported them every time I received one of these calls - one came from Texas and another from Georgia.  They won't give you their name or location, they can't tell you exactly what they are referring to and they generally try and go around and scare the hell out of people so they get money.  I cannot remember what company I had my payday loan through but when this happened the first time (actually I had 3) I called all of the companies and they all told me that they do not sue.  First of all, they may have bought the debt but that doesn't mean they can sue.  AND there are statute of limitations on how long they can bring a suit.  If you get a call from anyone threating this make sure you report it.  One of the companies even had a link on their main website page re these.  It is a truly sad day to think that they probably do get money out of people by scaring them like this and they don't know any different.  Always, always, always, you need a name, number, the debt they are referring to and if they are legit they should be able to provide you with all that.  Bottom feeders is too nice a word.

... and this should tell you all you need to know!!!  A legitimate company would have NO problem sending proof.  These scammers think that they can use scare tactics to get money out of poor, unsuspecting souls.  Don't send them a penny; whenever I have ever gotten a call from any of them I always tell them that I welcome my day in court with them.  They usually hang up or try to further engage me.  One of the other things I do is to give the the number of my local sheriff's office and them that our local sheriff will assist them in 'delivering my papers'.  By the way folks, it is ILLEGAL for any creditor to discuss your business with anyone but you!!!!!

Most sock puppet's are not so obvious. Allmost all payday loan schemers lack standing as legitimate lenders and are unable to put a hit on your credit score.  When you ask them to mail you a written statement, They explain that they are a paperless company and refer you to their website where you find that they operate under the laws of Belize or that loans are made by "our Honkong Partners."  They'll get money from me when the Army of Belize lands or when the Chinese Triad sends a man around to cut off my thumbs.

I received a call from this number today at work. They asked for my supervisor,  which was very embarrassing.  They told him they were going to send papers from the county I live in and press criminal charges against me.  He was very upset.  I tried to explain to him...I took the call and the lady on the other end hung up on me 3 times before she gave me the # to call.  I called it and it was National Recovery Service.  Surprise, Surprise...

You are very correct! Of interest may be this warning on payday loan scams:

Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

First off make sure you owe money. Chances are you do not owe on any payday loans but these crooks will try to convince you that you do. People sell your information and scammers call people on their list saying they owe when actually they don't.
Ask for proof of debt. Do not pay on anything you do not have proof of. It is the law so stick to it. Demand proof to be sent in the mail, not your email because they can make that look like a real debt too.
I have been getting many calls for unpaid payday loans over the past few years and no one has yet to send me any proof.
They called me today. I was not home but looked up this number after seeing it on the caller ID.
I do not owe on any payday loans so I will now block their number with help of Phone Tray.
My personal thought but I think Larry who has also posted on here is one of the scammers.

This is the telephone number of Natinal Recovery Services, a debt collection agency.  Their specialty is Pay Day Loan repayments that are delinquent, but, they do all sorts of loans and debts to include utilities, vehicles, card, medical, etc.  If you are getting calls from them and you do not know why - call them to find out.  You may have been hit with ID Theft and do not know it.  Check your credit report at ANNUALCREDITREPORT.COM and NOT the "Free" places.  Annual Credit Report is the authorized government avenue for checking your credit history.  Good luck and hopefully it is an accident and not fraud.
