These people called me threatning to send me to jail if I did not send 300.00 within 24 hours.   I am on a fixed income and do not know who they are.

So who is really driving the bus? Is it the debt collector or "the court"? Or was it you, before you surrendered control in the face of what were most likely empty threats. The whole point of that jerk-around was to extract money from you and keep you from thinking straight about which of you is the true abuser. Luckily for them they found someone who can be confused about legal process.

The "court" doesn't prosecute you, a plaintiff does, and you don't have a plaintiff until someone files a lawsuit. Where's your copy of their summons and complaint? Where are the dunning letters from a local attorney? If the first you heard of this mess was from some dodgy stranger on the phone, shouldn't that raise suspicion before you reach for that wallet?

Not even when Hell gets its own ski lift should you allow a debt collector, fake or not, to dip into your bank account. You want validation and a paper trail or they get nothing. You want fair and honest treatment as is your right or they get nothing. No compromises, no margin for error. If your rights are denied, and I'm pretty sure they were, you paint a target on their office and blast them in a *real* lawsuit.

Also see your states statue of limitations and also realize that most of the posts here are in regards to bills attempting to be collected that where discharged in bankruptcy which is also illegal to do. If you gave them your CC card numbers, get it changed asap! Same goes for any Debit card or checking account. Get them changed..

Email, phone nor fax are legal BTW.. Demand they send valid proof of debt via the US mail as required by law! See the full  laws and read up on them. Links below.

They are breaking FDCPA laws here:

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

I recently received a phone call by this man name Chris price. He said there was a complaint about me regarding a debt I had 3 1/2 years ago. He said I owed 1,300 but would settle for 950.00 then he proceeded to say that he will get the court to stop charges on me . So he sent me an email with an agreement to pay . Then he told me to print and fax the signed document so I faxed it but I asked him to call me when he receives it so I didn't hear from him for an hour so I called him and I asked him if he received the fax and he just sounded really strange. He said , " oh , well I'm going to go check so he kept me on hold for a long time and then came back on the phone and said," the person who receives the fax isn't is out of the office so no can get into it. " I just thought that answer was weird . After all that time on hold you came up with that? So I said , " oh ok well when you receive it call me and let me know and he never called me back. However he wanted a credit card number to ensure my payment for this month so I gave him a card that is a reloadable one because I was scared and he sounded scary . But now I'm reading all these reviews and its really scaring me if this company really is a scam . How could anyone do this to someone and scam them and how the heck did they get my phone number and my information . Then he. Said he was going to garnish my wages. This company is actually Four Star Resolution, LLC (filed with New York State as 4 Star Resolution, LLC). They always call themselves F.S. (fill in the blank - Mediation, Legal, etc.). They are collecting on PayDay loans that were issued in New York and Maryland where they are illegal. Report them to the FTC, the CFPB and the New York Attorney General. Save the letters they send with a Canadian return address, they are an FDCPA violation by themselves (keep the envelope they are mailed with a Syracuse NY pre-sorted mail permit). A class action attorney could have a field day with a written threat of legal action on an illegally originated pay-day-loan.

They actually operate out of a boiler room at 1839 Seneca St., Buffalo, NY 14210.

File a complaint with the BBB that describes the company name and telephone number they are using currently if you receive a letter or a phone call. All of the names they use are totally fake and bogus: Frank White, Mark Johnson, John Ford, etc.

The company is actually owned by Travell Thomas. Travell likes to hide his location and doesn't come into the office much, but his mother Cynthia Thomas lives at 56 Fennimore Ave., Buffalo, NY 14215. You can give her a call at (716) 837-2858.

They are fraud! Calling family and threatening to have me arrested for not paying a loan. My family was so scared that something had happened to me. I called them and they said they had an old loan and said I needed to make a payment or I would be arrested. I asked for proof which they said they would send, but I needed to make a payment right now or else. I gave in and gave them $200 which they stole. Never sent proof and I kept calling them. Finally I called them fraud and asked for their address which or course they would not give me. I have never heard from them again.

I received a call from Candus (unknown caller) saying I had been served and to call 888-830-7145 with a ccase number? I filed chapter 7 bankruptcy in 2009, this debt is from 2008, do these people actually not have to abide by Federal Laws?

I received a call from 888-828-0867 from doug daniels.  I called back and spoke with a lady who claims i owe a payday loan from 2008?  She said I need to pay it or go to court.  I asked her the name of the company she is from because I was going to look it up.  She said they do not advertise??? Then I asked where she is located and she said Arizona.   I then said ok so if I were to go to court where would the court be if she is in Arizona ????

Of course she could not answer that one.  Or could she fax me over proof I took out this loan which I never did.  She said no she couldnt.....Does she think that I am going to make payments to someone I don't even know????

Recvd a call yesterday stating they have a law suit against me on.  They gave me another number to call 888-314-4021.  I called them told them that I had bankrupted and this debt was on the backruptcy.
They would not take any of my case information.  I had my attorney call them and the man said they didn't accept bankruptcy and we wasn't taken the information.  My attorney asked him"do you think you are above the federal law?" he would not answer.  She informed this group of people if they contact me again they are going against the federal bankruptcy law and she will file a law suit against them and they will loose thier jobs.  My attorney really gave it to them.  They would not give me or my attorney any information about their business. They would not give us their address, or name.

I am just waiting to see if I get anymore calls!!  I did make a complaint to the FTC

i also received the same message by a gentleman named doug daniels saying they have been unsuccessful in locating me and to call this number for my court date, and to consider the phone call as being notified, i am going to notify the ftc and state attorney general office and file a complaint for harrassment
