I've gotten three or four calls from who's obviously the same company (they must read off a script).
The usual "call us in three hours OR ELSE" speech ... well, it's been 3000 hours or so and nobody's ever come by to serve papers, no case has ever been filed. I haven't taken out a loan or even got a new credit card in a couple of decades and my credit reports are spankin' clean. Likely some scummy company issued credit to someone using just my name and maybe phone number, but not my SS# or other valid data. Time for class-actions against card issuers and stores that are too unprofessional to check into who they're giving money to IMHO. It's professional malpractice, like a doctor who cuts off the wrong leg. Gotta be some lawyers willing to organize that sort of thing.

They've got nothing, less than nothing - which is why it's all threats designed to scare old ladies. I can't imagine many of these accounts being worth hiring a lawyer across the country - and if met by my lawyer they'd be trashed anyhow. (could I collect court/inconvenience/defamation fees ?)  These vultures never seem to get penalized for illegal/unethical/fraudulent tactics. Who are they paying off ? Where are CNNs investigators ? Where are the cops (oh yea, laid off, I wonder if they'll get these calls when their savings run low ?)

So these people just called my work and informed my receptionist that if I didn't call back within 3 hours a sherrif would be here to serve me papers.

I called the number back and they say they are collecting on a credit card from '05 that I don't even remember having, however I'm not saying I never did have it, just don't remember it.

She went on to say they would settle out of court for the full amount OR 25% of the cost ($519) I explained I did not have that money to pull out of my account and would not until next week.  She explained that if I wasn't able to pay anything they would take me to court to sue me.  It would be the debt on top of $2500 in legal fees.

Of course I was extremely nervous and anxious and maybe I do get summoned I am not sure .. however reading everyone elses story makes me a little less anxious in regards to this number

Got a call, same number...3rd one today. She said it is the last call and referenced my graphics website. Not sure why they would reference this??? I am currently unemployed / self employed (struggling designer). Someone stopped by and asked for me but I was not home. Wife saved Me.

If they do serve me, does it have to be by the Sheriff or can it be an individual?

We need to band together to fight this company for Harassment.

Debt Collection FAQs: A Guide for Consumers
If you?re behind in paying your bills, or a creditor?s records mistakenly make it appear that you are, a debt collector may be contacting you.
The Federal Trade Commission (FTC), the nation?s consumer protection agency, enforces the Fair Debt Collection Practices Act (FDCPA), which prohibits debt collectors from using abusive, unfair, or deceptive practices to collect from you.
Under the FDCPA, a debt collector is someone who regularly collects debts owed to others. This includes collection agencies, lawyers who collect debts on a regular basis, and companies that buy delinquent debts and then try to collect them.
Here are some questions and answers about your rights under the Act.

What types of debts are covered?
The Act covers personal, family, and household debts, including money you owe on a personal credit card account, an auto loan, a medical bill, and your mortgage. The FDCPA doesn?t cover debts you incurred to run a business.

Can a debt collector contact me any time or any place?
No. A debt collector may not contact you at inconvenient times or places, such as before 8 in the morning or after 9 at night, unless you agree to it. And collectors may not contact you at work if they?re told (orally or in writing) that you?re not allowed to get calls there.

How can I stop a debt collector from contacting me?
If a collector contacts you about a debt, you may want to talk to them at least once to see if you can resolve the matter ? even if you don?t think you owe the debt, can?t repay it immediately, or think that the collector is contacting you by mistake. If you decide after contacting the debt collector that you don?t want the collector to contact you again, tell the collector ? in writing ? to stop contacting you. Here?s how to do that:
Make a copy of your letter. Send the original by certified mail, and pay for a ?return receipt? so you?ll be able to document what the collector received. Once the collector receives your letter, they may not contact you again, with two exceptions: a collector can contact you to tell you there will be no further contact or to let you know that they or the creditor intend to take a specific action, like filing a lawsuit. Sending such a letter to a debt collector you owe money to does not get rid of the debt, but it should stop the contact. The creditor or the debt collector still can sue you to collect the debt.

Can a debt collector contact anyone else about my debt?
If an attorney is representing you about the debt, the debt collector must contact the attorney, rather than you. If you don?t have an attorney, a collector may contact other people ? but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney.

What does the debt collector have to tell me about the debt?
Every collector must send you a written ?validation notice? telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don?t think you owe the money.

Can a debt collector keep contacting me if I don?t think I owe any money?
If you send the debt collector a letter stating that you don?t owe any or all of the money, or asking for verification of the debt, that collector must stop contacting you. You have to send that letter within 30 days after you receive the validation notice. But a collector can begin contacting you again if it sends you written verification of the debt, like a copy of a bill for the amount you owe.

What practices are off limits for debt collectors?
Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:
    use threats of violence or harm;
    publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
    use obscene or profane language; or
    repeatedly use the phone to annoy someone.

False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:
    falsely claim that they are attorneys or government representatives;
    falsely claim that you have committed a crime;
    falsely represent that they operate or work for a credit reporting company;
    misrepresent the amount you owe;
    indicate that papers they send you are legal forms if they aren?t; or
    indicate that papers they send to you aren?t legal forms if they are.

Debt collectors also are prohibited from saying that:
    you will be arrested if you don?t pay your debt;
    they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
    legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action.

Debt collectors may not:
    give false credit information about you to anyone, including a credit reporting company;
    send you anything that looks like an official document from a court or government agency if it isn?t; or
    use a false company name.

Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:
    try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt ? or your state law ? allows the charge;
    deposit a post-dated check early;
    take or threaten to take your property unless it can be done legally; or
    contact you by postcard.

Can I control which debts my payments apply to?
Yes. If a debt collector is trying to collect more than one debt from you, the collector must apply any payment you make to the debt you select. Equally important, a debt collector may not apply a payment to a debt you don?t think you owe.

Can a debt collector garnish my bank account or my wages?
If you don?t pay a debt, a creditor or its debt collector generally can sue you to collect. If they win, the court will enter a judgment against you. The judgment states the amount of money you owe, and allows the creditor or collector to get a garnishment order against you, directing a third party, like your bank, to turn over funds from your account to pay the debt.
Wage garnishment happens when your employer withholds part of your compensation to pay your debts. Your wages usually can be garnished only as the result of a court order. Don?t ignore a lawsuit summons. If you do, you lose the opportunity to fight a wage garnishment.

Can federal benefits be garnished?
Many federal benefits are exempt from garnishment, including:
    Social Security Benefits
    Supplemental Security Income (SSI) Benefits
    Veterans? Benefits
    Civil Service and Federal Retirement and Disability Benefits
    Service Members? Pay
    Military Annuities and Survivors? Benefits
    Student Assistance
    Railroad Retirement Benefits
    Merchant Seamen Wages
    Longshoremen?s and Harbor Workers? Death and Disability Benefits
    Foreign Service Retirement and Disability Benefits
    Compensation for Injury, Death, or Detention of Employees of U.S. Contractors Outside the U.S.
    Federal Emergency Management Agency Federal Disaster Assistance
But federal benefits may be garnished under certain circumstances, including to pay delinquent taxes, alimony, child support, or student loans.

Do I have any recourse if I think a debt collector has violated the law?
You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can?t prove that you suffered actual damages. You also can be reimbursed for your attorney?s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector?s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.

What should I do if a debt collector sues me?
If a debt collector files a lawsuit against you to collect a debt, respond to the lawsuit, either personally or through your lawyer, by the date specified in the court papers to preserve your rights.

Where do I report a debt collector for an alleged violation?
Report any problems you have with a debt collector to your state Attorney General?s office (www.naag.org) and the Federal Trade Commission (www.ftc.gov). Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General?s office can help you determine your rights under your state?s law.

My grandmother received a call about 30 mins ago stating that they have been trying to get a hold of my mother and that if she did not call within 2 hours she would be arrested and have a bench warrant. The person on the phone stated he was from the sheriffs office and wanted to know if my mom would be home for a few hours to be served. My grandmother told them they had the wrong number. They asked how did she know they had the wrong number. She told them that they were looking for her daughter. They asked her to get in touch with my mom and have her call 888-332-0080 and gave a case number. She also got an ext. number but did not get it written down and can't remember what it was. She walked down to the house in a panic. I do not know what all was said to my mom when she called but I can safely assume that they threatened to garnish her pay check, take a lien on the house, and/or sweep the bank accounts because she kept telling him that everything has been mortgaged and they would not receive much from her pay check considering she is a school bus driver for a private school. The person that answered my moms call is named Cassie Hunter.

While my mother was on the phone with this lady I decided to get on the internet and look up the number that had be left with my grandmother only to find this site and many others with complaints of illegal scare tactics. These people, I believe, are a real collections company. They were calling on a credit card debit my mom owes. Yes we know exactly which credit card it is and will not be doing business with them after this crap is settled.

These people have no right calling our family members and pretend to be a police officer. It is against the law

It is also illegal to threaten to garnish pay cheacks, taking liens on personal property, and sweeping bank accounts.

808 6) Taking or threatening to take any nonjudicial action to effect dispossession or disablement of property if ?

(A) There is no present right to possession of the property claimed as collateral through an enforceable security interest;
(B) There is no present intention to take possession of the property; or
(C) The property is exempt by law from such dispossession or disablement. (also found on ripoffreports.com)

They will stop at nothing. Here is a story I read about the person had already paid the debit owed with proof of payment consisting of and I quote "express mail deliver confirmation and signature and cashiers check stub" and P.M said and I quote "it did not matter I was going to be sued if I did not send the money the next day."

Person from this company called saying they were from the Sherrif's Dept and wanted to know when someone would be home so they could serve a court summons.  They were very forceful and would not believe that the person they were looking for did not live at this address.  They used bullying tactics and threatend with arrests and job loss.  Sorry for them, they picked on the wrong family.  This will not be tolerated.

First I had a message on my cell phone from this company looking for my brother in law.  My brother in law said he knew nothing about it, so I ignored it.  They called again and said they were a process server and that my brother in law had supposedly given my number as a contact number, which isn't true.  And they informed me that they were looking for him for a criminal case pending against him.  That they would serve him with court papers at the address of my cell phone which is my home address.  I informed them that he doesn't live here and they used scare tactics stating that the Sheriff would be on their way to serve him.  My mother in law lives with me and has high blood pressure and an enlarged heart, which is not to be aggravated by any means.  Me without knowing this was a fake company, called her and told her the Sheriff's were on their way, and you can imagine what that did to her health.  Something needs to be done about this company.

Caller left number and case number at my dad's house...looking for me apparently. legal matter.
Called back (i blocked my cell number)...found out they were looking for another person and i asked how did my name come up...and they said i was an associate...they say if i am not that person, i should be good.
anyhow, that person, i didnt really know...so i told them i dont know him...somehow that person is using my dad's home address...they say the Sheriff will be there within 3 days to look for him...

can they do that even when that person doesn't even live there? sounds pretty messed up...and calling my dad's home number for a person that doesn't even live there and claims that i know him...?

A debt collector cannot just serve you papers and then BAM your wages are garnished.  Thats hilarious.  Hello, what about going to court?  What about the fact that its the LAW that the debt collector MUST give you verification that they own the debt.  they have to prove that the statue of limitations have not expired.  They have to also prove that they are licensed to collect in your state.  They have to also provide complete pymt history and a copy of the original signed agreement AND name the original creditor and what the debt is for.  

If they do not do these things THEY are in Violation of the Fair Credit Reporting Act, the Fair Debt Collection Practices Act, and you can sue THEM for Defamation of Character.

My father was called about 2 days ago by "a process server" and was given this 888-332-0080# and urged me to call in because of some legal matter. I called to find out what was going on because I have never been in trouble before and have never even had a ticket. They did ask for a "case number" that was given to my dad. I denied any help they were offering due to the research and comments I found on this website. My father recieved the papers today and had to sign for them, my court date is Dec. 19, 2009. Thanks people.

They must file in your county district and they would never tell you in advance that the Sheriff is coming to your house nor Job!!!!!!!!!!! number also used is a private phone number in cali. I also got a call from this number.  I have been avoiding their attempts for the past month until they got a hold of my dad who was in panic mode wondering what the hell was going on.  I don't even know how they got his number.  This was so embarrassing.  Use my family to get to me?  Really?  I finally called them back.  I talked to Tim Adams who was handling my case.  I told him to f*** off, I didn't have the money and do not call my parents again or any of my family.  They served me at work.  This company is relentless, they will do anything and everything to take you to court.

Check the social security numbers before panicking.  My husband just had the same situation, they called his job and said if he didn't give them a call by 6:00, they would put a 24hr hold on him.  He called back, and the social security number they had for him, WAS NOT his real one.  PLEASE VERIFY the social with anyone you talk to.

I also recieved a call from this company.  He started off the conversation by asking if I had been served today and got a "Mr. Freeman" on the phone.  Mr. Freeman spoke breifly about his "case" and began to be very pushy and aggressive.  When I stated "the statute of limitations has run on this debt and do not contact me again". He began to get rude.  I repeated "The statute of limitations has run on this debt and do not contact me again" twice more before he got extremely rude and started yelling at me "Are you a parrot?  Your answer shoud be yes or no!  Are you a parrot?"  I informed him that all I had to state was what I had already said and he hung up on me. This is a Scavenger debt collector.  Scavenger debt collectors are notorious for using illegal and unethical methods to collect "time-barred" debt.

I tell him that don't have that type of money, I am told that I will be served within 3hrs.
Looked up Pacific Management and David Freeman at x 17 and found that they are using scare tactics to get people.
