Hey there Felix,
If Brock and Scott sue you, they have to send the legal paperwork to the court and then a sheriff has to serve you with the paperwork. Check your county court house to see if they actually DID open a lawsuit on you. If they did, request the paperwork that Brock and Scott sent and find out why the sheriff didn't serve you. This law firm is VERY shady. They live on the far outskirts of the law and unfortunately get away with what they do because barely anyone challenges them. I have gone through all of the Brock and Scott entries in my home county hear and yes, they win 80% by default. They have probably 300 cases that they  submitted. I looked at them all online. They make an absolute FORTUNE on this and I bet 60% of the lawsuits they file are bogus, out of the statute for collections, not owed or have no verification for it.

Def get a hold of the clerk of court in your county.

I'm curious as to where you got the "Brock and Scott win over 80% of there cases due to default...People NOT showing up in court to tell their side"

I was screwed over by B&S.  Bascially, they didn't send me a letter telling me there was a court date.

I'm curious as to how many other people didn't get a letter as to when he/she/they needed to show up.

Brock and Scott is a law firm that represents Bullhead Investments, Comprehensive Legal solutions and Chanel Group. The last 3 are junk debt buyers (and are the same company as Brock and Scott) Bullhead, Comprehensive Legal Solutions and Chanel are the business front names to buy junk debt (debt that has been charged off by the original creditor) for pennies on the dollar, then it gets sent across the hallway to Brock and Scott. Once it's at Brock and Scott? A canned letter will be sent out to the name and address of the debtor (known as a miranda letter) demanding payment. It will say that if you don't pay, they will file suit against you, win and then have a sheriff come to your house to repossess your belongs. LMAO! Totally against the law. Just a few weeks after that letter is sent to you, The info goes to Richard L. Jackson because he is licensed in all the South East states... Convenient hey? Instantly, his paralegals will work around the clock printing out template letters for 100's of lawsuits, they are stamp signed with Richard Jackson's signature and then sent out to county courts. The sheriff will deliver it to you, and at this point it's up to you to answer within 30 days... 2 words DO IT!!!! If you don't answer? Brock and Scott get a default judgement and they will own you for the rest of your life.

Send a certified letter to them AND to the court asking them for debt verification and validation. Including original signed contract, statements with purchases, when the last payment was made, how they came to the total owed AND a complete chain of ownership from the original creditor till it landed on Brock and Scott's desk.

At this point, they will send you yet another premade letter stating "They are the proper custodian, blah blah blah... THIS is not validation or verification. At that point, make a copy of that letter, send it to your county court with a letter to have it dismissed as they did not supply what you asked for. Being that they can't prove they own it? They can't collect on it, end of story.

However, Richard Lynn Jackson(Rick) and his paralegals will not stop there. Next you will be mailed interrogation and discovery papers. DO NOT answer any of them. Just write "Does not apply" on each question, photocopy for your records, typed up a letter stating you will not answer them and send it to B&S AND to the court. Trust me, at this point? They still won't stop, they will send you admissions/discovery paperwork along with production of documents stuff. Again, do not answer any of it, "Does not apply", etc. At this point, Mr. Jackson and the paralegals will either submit a request for summary judgement or a motion to have the judge MAKE you answer the paperwork. Don't let this scare you. You still have the upper hand as they have not provided the verification/validation. All they are doing is building YOUR case to win as at this point they are breaking Fair Debt Collection rules (as they are accustomed to) If you get the paperwork that is asking the judge to grant a ruling for you to answer, just respond with a "It's not relevant" letter and submit it to the court.

If you get the notice for "Request for summary judgement" this is great news for you! However, you MUST show up in court. THIS IS A MUST! Brock and Scott win over 80% of there cases due to default...People NOT showing up in court to tell their side. If you are a no show? B&S automatically win and the judgement is in their favor against you. If you DO show up? The judge will review all the paperwork, he/she will see where you asked for validation/verification/chain of ownership and then ask the paralegal if he/she has the info. Chances are? they won't. The judge will either dismiss it right then and there OR continue the session 30 days later. Within that time, just sit back and relax...B&S will file a voluntary dismissal (rule 41a) before the next court case. This is because, to locate all of the validation info and the chain of ownership info takes A LOT of time, and they aren't gonna pay lawyers big bucks to do this. They figure, hey? If we dismiss it...what are we out? a few hundred? Mere drop in the bucket compared to the 80% cases they win by default all on autopilot.

So recap,
NEVER admit to any debt!
NEVER talk to them on the telephone, get it all through the mail
NEVER make a payment on the account until it;'s all said and done and court ordered.
ALWAYS answer every communication with 30 days
ALWAYS send it certified mail and save the return receipts
ALWAYS send ansers to B&S AND the court.
ALWAYS check the statute of limitations. If it is passed the statue they cannot collect. For instance, the statute for collections is 3 years in SCarolina. If the last payment on the account happened prior to 3 years? It's dead and they cannot collect/sue you.

Once you win your case (and you will) photocopy all of your paper work from Brock and Scott AND all of your answers and seek out a consumer rights lawyer. Have them look it over to see if and what FDCPA Laws were broken and you may have a great case which will put money in YOUR pockets. For each violation they do, it's $1000.

Received phone call from Brock &Scott was not home and received two threatening letters from them stating they were going to place a judgement against me, send sheriff to my home, judgement against my property.  This is against the law according to SOL as this loan is over 5 years old!

It is Brock & Scott of Winston-Salem, North Carolina.  They are debt collectors for junk debt buyers like Unifund CCR Partners.  Before you pay them one dime check your statute of limitations for credit card debt.  Do a search on google for statute of limitations.  Another good web site to visit is "creditinfocenter.com"--this one has ver,very good information.
