The address on the website states its 927 Deep Valley Drive #195, Rolling Hills Estates, CA 90274

Google map it, with "street view" you can see a creepy old business complex in a bad area.  Ignore the number or numbers or block them.

So I have had this personal trainer at Gold's Gym and money was getting tight.. I only owed them around 1,000 or so left since the original investment was a more than 2,000 almost 3. I have a job but don't work my actual full time hours because I'm full time in college and I have been trying to give school most of my time. My card got declined for one of my payments and I didn't exactly receive a letter. I'm sure if they actually contacted me since I was busy with school work. The company sent it to Swift Funds and that's when they started to call me. A man by the name of "Valentino" called me and urged me to make a payment. He had set up a settlement plan with me and that was that. I then made a payment the day after the next and then I called so I could make sure I knew how much I owed which was around 3,400. A man by the name of "John Banks" answered and said "Valentino" was not in at the moment. He then said he had asked "Valentino" to lower my balance and started to say "Valentino" only wants to make commission off of me and doesn't care about anyone etc. "John Banks" Said he would lower it down to 2,000 and get rid of the loop holes, interest, late fees, remove the red flag and get a "release" and documents to me so that my contract wouldn't be sold off to mom and pop shops. He said he was concerned due to my age (19) and that he was sick of seeing how corrupt the debt collection industry was and always tries to help anyone he can. He then realized that I had made a recent payment with "Valentino " and said he couldn't do anything since it was already in "Valentino's" hands and that the only way for him to help me is if I would make no more payments with "Valentino" so that the account would go into an inactive state which he would then be able to take control. He asked me to get in contact with him after 35 days which by then the account would be inactive. I kind of thought this was weird, sketchy or something. .. I wasn't sure. I felt like maybe they are working together to scam me or something.  Anybody know about this?

I have had issues with both Golds GYM and Swift Funds.  When I was first notified by Swift I as advised them that I had cancled my memebership due to injury and was told to contact Golds Gym to dispute it.  I then called Golds was told they could not talk to me about my membership and to read my contract.  When I informed them that I did and that I followed it, they told me that I did not and I had to talk to Swift to dispute the account.
Since I have filed Bankruptcy and told them of this. They continued to call and when I called to give them to give them my attorney's name and number they refused to take the information and told me that my attorney had to call them and hung up.  I called back and was hung up again.  I finally had to have my attorney call.  Now to wait to see how many more calls I will get.

I have never had a membership or owe anyone associated with Swift Funds.  They call me about a person named  ____ James.  And, when I finally called back, the reps are extremely rude.  I have informed them I am not this person they are looking for.  I've had this new phone number for less than a year and they have been calling me for six months.  The rep today said my number is on an autodialer.  I asked her to have it removed since I've worked with a call center and know that the number CAN BE removed!  She finally came back and said my number would be removed.  I asked how long will it take and she said 2-3 days.  If they still call after that, I am going to call the news stations, inform FTC.   I should be able to get results since they have the WRONG person they are trying to contact.

Its not just the BBB you report to, and if they where legit, they should have mailed you debt validation within 5 day's of the first call! Thats the law! They are also in violation of other FDCPA laws with the harassing threatening phone calls.. You need to file complaints with your states attorney general, the FTC, and the CFB minimum..  You should be able to google the BBB also. Also google your states Statue of Limitations.

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

After months of countless calls from a Mrs. Wilson, I paid my "debt" to them two days ago because I couldn't deal with the harassment any longer. She called me a liar and kept talking over me. When I asked to speak to her supervisor, the man who answered also accused me of lying and said that the whole situation was my fault because I don't pay my bills and if I continued complaining he was going to escalate it. I'm trying to report them to the Better Business Bureau but I can't find an address for them.

I wonder if swift financial the debt collectors loop hole is that if we call them back they can use any tactic they want and use it as defense in case anything occurs in the court of law. I believe thats why they use an automated message telling you that its something important and that you should contact back that number ASAP. Like that if you call they can do as they please for they are receiving the call not viseversa.

I got 2 calls from this group with an actual area code. One was a 619, California area code, the other 403, New Hampshire area code and a New York area code; same message, 2 different guys and a lady, sweet as can be stating that they are concerned that I have a seriously over debt to be paid or its going to collections. Googling the numbers, i saw that they are debt collectors for Golds gym, I ignored them. The last time I was a member of Golds gym was in 1979-1981 and was a month to month, non contract member. I left LA and the state of California in 1989. While there is a Golds in my town, which I refuse to mention due to their harassment tactics, I have never been a member and the gym I did belong to this past year, I. terminated from for medical reasons and have a SIGNED WITNESSED TERMINATION document from that facility, their own company form stating that I was paid up and didn't owe any money to them.. So that being the case, I have no idea what they are looking for and i am not about to answer or return the call to find out what they are talking about. Since I haven't responded to the 3 live voices, I'm now getting automated calls from various 888 numbers that all say the same thing and when googled, all come back to this company 4/5 times a day or more,, usually 5-6 minutes a part. I'm adding all their numbers to my reject list and keeping track of the times and frequency of them all. If any one starts a class action suit against them, I'm ready to join in.

I informed Brenda Olsen, manager of Golds Gym in Palm Springs, CA. of my new credit card number about two months ago. She took the credit card from me and changed the number in their computer system at the front  desk . What she changed only affected the revolving membership fee and not the monthly training fee in their computer system.

Juan Juarez the assistant manager attempted to help me and did inform me of the problem after I requested an explanation of why I was being harassed by Swift Financial at my home phone. The outstanding monthly bill for training was paid by check and given to Juan Jaurez over a month ago.

No one at Golds gym is able to do anything to stop the harassing calls from Swift. I talked to another manager in Scottsdale,AZ. because I was told by a Mr. Tom Adams at Swift financial that they were the ones directing Swift to go after me. The manager, Kevin Haag , told me this was not true and that the corporate/franchise holder is in Phoenix, AZ.  I suspect that there is a long trail of untrue claims  from Swift.

The telephone calls from Swift Financial Collections started over a month ago. They are threatening, rude, and completely uncalled for. They continue and have affected my ongoing health issues. I have contacted the California dept. of Consumer affairs at the state attorney generals office and will keep them informed.

Can anyone recommend the next step to take? Can we collectively go for some legal assistance here in the Coachella Valley?

Wow! I want to thank everyone who posted on this site.  I received a message from Mr Green calling from Swift.  with a phone number to call him back.  I don't know why but I was suspicious.  I Googled the number that came up with the caller ID and blam straight to this information.  I have already cancelled my credit cards that they have access to.  A month ago, (suspiciously 1 month after giving
Gold's Gym my debit card # and information), Chase Fraud Department contacted me telling me that someone had tried charging my card in Africa.  They didn't believe I had flown to Africa overnight, so they were notifying me that they were closing my account and sending me a new card.   This was the first problem I have ever had with my card being used fraudulently.  I have an appointment with the Manager tomorrow at Gold's Gym and I will be, thanks to all of your dire warnings, informing them I will only deal in person and pay the dues I owe with a check.  Thank you again. Oh, and FYI Mr Green said nothing in his message about an attempt to collect a debt. So on my voice mail I left him a special message that "If this should be Mr Green from Swift, you may call XXXXX number (Golds Gym, branch managers number) my account is current and if I receive another call from you your recorded message not complying with the law will be forwarded to the...Consumer Finance Protection Bureau(CFPB) immediately.

I just received a voicemail from Troy Green from Swift Financial, told me to call him back at #310-499-4086. It was just dead air, so I called the phone number that came up on my caller id 831-250-6126. I got a hold of a lady there that was able to pull up my account, I guess I had a pass due balance from a gym membership that my husband was suppose to take care of. Well anyways, she disclosed the balance due without stating "This is an attempt to collect debt, any information may be used for that purpose" which is part of the FDCPA, which I thought any time it is a collections call they have to state that. I asked her if she's able to send me something In writing of the balance due & a breakdown what is owed. She asked for my email address & said she will email it to me. She also told me to callback to setup a payment arrangement because it will be reporting to the credit bureau as of the Nov. 15th. It's been about 10 minutes since I have gotten off the phone call & haven't received the email yet.

I've worked in collections for about 6 years, and just to let everyone know about the numerous phone calls a day...collectors are able to call between 8am-9pm (local time) & are able attempt to contact you up to 6 times per day. If they make contact with you then they shouldn't call you for the rest of the day, but can start calling you again in less than 2 days depending on the company. If they're calling your cell phone you can request no phone calls to your cell phone under the TCPA guidelines or you can request a Cease & Desist, then have all communication done in writing. Hopefully this will help.

After writing this I still haven't received the email of the balance due. I'll most likely call them tomorrow.

They told me to fax my "do not call" request. I did. They still called. They claim they never received my fax despite the fact that I have a receipt showing that it went through. If you call and tell them you want them to stop calling they say they'll connect you with a supervisor and then hang up on you.

I thought consumers were protected from such abusive practices? These people get away with it repeatedly.

I am a debt collector who has gotten fed up with the way this industry is , believe it  or not, it's just as bad on the inside and I have been jaded by a few comapanies tring to give my all and most polite and easy ways to collect a debt so this seems like a good forum to start this and see where it takes me, If you really want to get results and minimize your efforts in doing so then litsten up kids...Consumer Finance Protection Bureau(CFPB) These are the new heavy hitters on the block you can easlily go on to their website and there is a 3 step complaint process that takes about 2 minutes and from this complaint your same complaint will be circulated to all the other governing agencies for collections on a debt i.e.FTC, FDCPA,and possibly THE ATTORNEY GENERAL'S OFFICE  for your state..this is who they are of afraid of , in fact next time you have one of those bulldogs on the phone then throw the call letters CFPB and see if you get results and if it doesnt work dont fret ..just go make the report and watch your tax dollars in action..good luck...give me feed back ..internetchoices@yahoo

I just received a call from Valentino at Swift and he said Custom build personal training has a claim against me for $4800 but I only owe $1300 as I found out from the corporate office. But this guy from Swift said if my lights are still on and I have water in my house and a phone I'm not in bad shape, wtf??? He doesn't know what I have going on in my life!!! Anyway every time I call him he says, oh I just got out of court, yeah right. Anyway I asked him to send me a bill and I got nothing, then he says I can get on a hardship program which I don't qualify for and pay the $166 a month. Or they are taking me to court for breach of contract and then I'll owe $7000. I real don't know what to??? And he was rude as hell to begin with.
