The really hilarious thing about this, is they are calling for the person that had my phone number before me.  It's not even my debt!  The truly stupid thing about the callers, is they refuse to understand, I'm not the guy they are looking for. Well, they paid for their idiocy in court. I obtained a law firm, and prevailed.

Did they say how much you owed?  Did they say that over time, the amount you owe has tripled?

Have they taken more out of your account than you agreed to?

Did they send you a debt validation letter, proving that you owe this debt and to them?  By LAW, they must send via MAIL (not email or fax) a debt validation letter showing original creditor, date debt occurred, date of last payment and if they are legally entitled to collect said debt in your state.

If they did not send you proof that you owe this debt to them, I would call Kay Jewelers and find out if they sold your account to a collection agency.  Even if they did, they have violated the terms of the FDCPA by not sending you proof of debt.

If it turns out that Kay Jewelers did NOT sell your account to these people, you should call your bank immediately and let them know about this fraud.  You will need to close your account, and have your bank put a fraud alert on it.  You should also call the three credit agencies (Experian, Equifax and TransUnion) and have them put a fraud alert on your credit records.

They are not attorneys.  Nichols and Grant is not a law firm.  If there is a lawyer working at that place, I have yet to hear of him or her.  stopnandg.blogspot.com

There are several reasons to suspect this operation.  I list a few of them on my website.  With recordings of voicemails and research into their supposed address, which, funnily enough, keeps changing.

They are a mediator?  Where is their office physically located? What's an original debtor? Do you mean original creditor? Do you work for the company or are you someone who gave your bank account information to some strangers who called you on the phone?  If it's the latter, I recommend that you check your bank account/prepaid card/credit card -- however you paid these people.

I also encourage anyone who can pay an outstanding debt to do so, provided that the debt collectors follow the law and respect consumers' rights.

Who did you work with? How do you know your debt is really paid off?

When you think you may owe money, and a debt collector tells you you owe substantially more, you should really get the amount in writing from the person trying to collect the debt, including the amount from the original creditor and whatever terms of the agreement caused this number to grow so much,   If you already made an arrangement to pay them, I recommend you keep an eye on your bank account and also check your credit.

I got called with the same information, it was very threatning phone call and they stated the same thing.  I noticed everyone had really generic easy to remember names Like Jim Jones and Jenny Smith and the letter the sent me was improperly phrased.  It sounds like BS but I did have to close my bank account for fear of them withdrawing my money.  I call Bull****.

No wonder you can't spell "legit" since you obviously don't know what it means.

This is a legite company.. They just worked with me to pay off a debt..I did a paper trail of my bill, and tracked it back right to them as the mediators.. I actually spoke with my original debtor-So if any of you have out  standing debt, then make arrangements to pay it. Go back to your original company an make good on what you owe..
They are not snakes. We incurred the debt, so we should pay it!

I was called about a week ago thought it was a scam not really telling me what i wanted to know. So today i got a call giving me more info so I called back .It all sounded good taking off 900.00 from a pass due credit card (Credit one Bank) Saying I had a balance of 2,278.98 down to 1338.98 if i paid so it would not go to court. Make a long story short i know i had a balance with the card from 2007. but not how much so i am having the money taken out next week . Now after reading everything is my debt being paid or not .this is a new york firm i am in California. ?

The FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf treats the INITIAL CONTACT between collector and debtor (first call, first letter, first whatever) as a special event. Legit collectors per section 809 of the FDCPA *must* tell you at initial contact, or send you paperwork within 5 days of initial contact, the following:
1. $amount of debt,
2. name of the current creditor (which may differ from the original creditor who might have sold your debt),
3. a statement that that debt will be assumed to be valid unless you dispute in writing within 30 days,
4. a statement that that if you do dispute in writing within 30 days, the collector must mail you written verification of the debt,
5. a statement that if you ask the collector in writing within 30 days, the collector must send you the name and address of the original creditor if it's different from the current creditor.
If you don't get the 5 disclosures, orally or in writing (you do not have to ask for them, the FDCPA requires collectors to provide them), treat the collector like you would any SCAMMER.
Note that 3,4,5 must be done *IN WRITING* so you will need to ask an address from your collector. If s/he refuses to give you one for any reason, treat the collector like a SCAMMER.
The collector can threaten court action at initial contact but the FDCPA requires that the collector actually take you to court if the collector threatens it. Threatening court and not going through with it (coercion) is illegal.
If they say the FDCPA does not apply to them because they own your debt, the debt-owner exemption only applies to the original owner. A 3rd party who buys the debt for the purpose of collecting debt is treated as a debt collector and not an owner and must obey the FDCPA as explained in this FTC Staff Opinion letter here http://www.ftc.gov/os/statutes/fdcpa/letters/arbuckle.htm
Has the statute of limitations for your state http://www.fair-debt-collection.com/SOL-by-State.html expired on your debt? If expired, don't pay.
Collectors generally have to be licensed by your state to practise (collect debt) in your state and you can find out by calling your state Attorney Generals Office. Ask if a license is required and does this collector have one. If not licensed, don't pay and file a complaint with your state AG.
Read useful debt-collection FAQs from the FTC here http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre18.shtm
