I have been receiving these exact same calls only from Jack whos boss is Mr Martinez. The number that appears on my phone is 2132936075. It started about a month ago with "Jack" who would not give me his last name or company name, telling me that i was being sued for not paying a payday loan and writing bad checks to said company. Thing is I do not have any pay day loans out there! Today I receive yet another call from Jack saying that there is now a warrant out for my arrest. Now, I'm in the military so this could get me in a lot of trouble! Has anyone else been contacted from this gentleman? Thanks so much.

These people are horrible. I received 9 calls this morning (back to back)! I get on average about 12 calls every couple days!! I even tried debt consolidation- they gave the company a hard time & refused to settle on payment. They insisted on having my bank account number. I refused.  I would like to see Paul Martinez & his idiot minions sued to the wall! They should owe everyone they've been harrassing.

These idiots have been calling me constantly for several months. I have received threats about being arrested for committing fraud and having to go to jail because of loan owed to Cash Advance Now/Cash Advance USA. Have told them to go ahead and take it to court. seems they are more in the harassing business and need to be shut down.

Today I received an email threatening me with arrest. It looks like a bogus warrant paper that they created and put in the email. They're threatening me to take this up with the local police. It looks bogus to me. Does anyone recognize this tactic? I don't think it's legit...

Got a call today from this number by a foreign sounding man. Said he was going to call my references to demand payment from them.  HA HA HA  Obviously this guy doesn't know its against federal law to discuss your debts with anyone other than the debtor. So he basically threatened me, again against federal law. These foreign people just dont get it.

Received a call from this jerk today advising I ws under investigation and he was from some legal department. He called twice within a half hour of each other. I don'nt think its legit since I have gotten a call from another jerk sometime last year and reported him to the Attorney General in my state for the Consumer Department. I never received another call after they got involved.

Prayerfully, this will work.
thank you everyone for all your info because i had started to feel intimidated by their company as well. But I said a prayer and gave it to GOD and that's the deal. Why pray and worry, why worry and pray. Good luck everyone. GOD BLESS.

A man from this number just called our office phone, looking for a former employee. He pretended to be a friend of hers and asked if I had any of her new contact information because he had something very important he was supposed to send her. These people are shady and should be stopped. I understand the frustration of someone owing money but to stoop to the levels they do is disgusting.

West Virginia Sues Eight Payday Lenders
Firms charged with using Internet to circumvent state law

August 24, 2010

West Virginia is one of a handful of states that have banned payday loans. So when lenders use the Internet to do business with residents of that state, the state's attorney general goes to court.
West Virginia Attorney Darrell McGraw has filed suit, asking the Court to order the eight companies, which have refused to cooperate with his investigation, to surrender the records of their West Virginia-based accounts and to halt lending activities in the state.
Payday loans are high-interest loans or cash advances with interest rates that reach as high as 600-to-800 percent APR. The loans, typically made for 14 days, are secured by a post-dated check or an agreement authorizing electronic debits from the consumer's checking account.
"When a company sets foot in West Virginia, whether in person or over the Internet, my office has a duty to ensure the enterprise complies with state law," McGraw said. "Any company that makes payday loans must halt its usurious business and produce records identifying its victims."
The companies and principals sued by Attorney General McGraw's office are:
? Payday Loan Resource Center LLC and Moe Tassoudi of Scottsdale, AZ;
? DirectROI d/b/a Cash West Payday Loans and Mike Brewster of Chandler, AZ;
? First American Credit;
? LoanPointe LLC, Joe E. Strom, Benjamin J. Lonsdale, James C. Endicott and Mark S. Lofgren of Highland, UT;
? Eastbrook LLC d/b/a Ecash and GeteCash of Provo, UT;
? National Title Loans d/b/a National Cash 12 of Elsmere, DE;
? Payday Financial LLC d/b/a www.LakotaCash.com and Martin Webb of Timber Lake, SD;
? Payday Loans-ACH d/b/a www.ACHLoans.com of Emeryville, CA.
End run
McGraw says Payday Loan Resource Center attempts to circumvent state law by charging West Virginia customers a monthly fee to help them obtain Internet payday loans. A suit filed earlier this year by the Federal Trade Commission (FTC) charged Ecash and GeteCash with attempting to garnish wages without a court order. Lakota Cash claims to be an Indian tribe and therefore not subject to the laws of any state.
Since McGraw began investigating the industry in 2005, his office has reached settlements with 107 Internet payday lenders and their collection agencies, resulting in $2,452,979.87 in refunds and canceled debts for 8044 West Virginians.
"Payday loans are predatory traps for the many West Virginians facing difficult times," McGraw said. "We will continue to ask the courts to intervene whenever companies refuse to cooperate with our efforts to protect West Virginia citizens."

TROLL ALERT

YOU CANNOT BE ARRESTED FOR DEBT - MAKING THE THREAT IS ILLEGAL..

15 states have banned PAYDAY LOANS and COLLECTIONS on those loans - So the STATES have said YOU DO NOT HAVE TO PAY THEM BACK - ITS THE LAW.    IF you live in one of these states - check with your State Attorney General.

High cost payday loans are illegal in 15 states.  As of the end of 2008, the following states outlaw these very expensive loans:
    Arkansas
    Connecticut
    Georgia
    Maine
    Maryland
    Massachusetts
    New Hampshire
    New Jersey
    New York
    North Carolina
    Ohio
    Oregon
    Pennsylvania
    Vermont
    West Virginia
Payday loans are also illegal in the District of Columbia, the Virgin Islands and Puerto Rico.

In November 2008, voters in Ohio and Arizona soundly defeated payday loan industry ballot initiatives to preserve lenders? rights to charge 391% APR.  Read the Center for Responsible Lending?s webpage about these victories.

In addition, Congress banned payday lending to service members and their families.

ARIZONA BANNED PAYDAY LOANS AS OF JULY 1 2010.

False threats:  Payday lenders/debt collectors sometimes threaten borrowers with criminal prosecution for writing ?bad? checks.

In fact, there is nothing illegal about writing these checks (if there were, payday lenders would be  aiding and abetting a crime each time that they told a borrower to write a post-dated check). .

Nevertheless, many consumers are terrified by these false threats of criminal prosecution.

Received a call on my cell phone today from 888-579-8904 - X 107.  Caller identified herself has Lisa Lopez with Capital Corp. and she was calling about a fraud investigation into a bad check to Cash Advance Now. She said my name is on a contract, and that I needed to call her immediately because they were getting ready to take the case to court.  I've never had payday in my life!  I called the number back, the man answered the phone "legal department", I asked for Lisa Lopez and they asked who was calling.  I told them someone they didn't want to mess with.  I told them I work for the federal court (which I do) and that they were playing with fire if they continued to call me.  I then reported them to the local police department.  My purse was stolen last July, so it's highly possible there's some identity theft here.

It seems like something could be done b/c they have a post office address. You have to have i.d. to get a freakin post office box so don't tell me they can't find out who rented the box- that's BS. These people are scam artists! Furthermore, I recently found it is it illegal for them to even loan money online to many states so how the h-e-l-l they gonna get someone for fraud? In most states you can't even be arrested for failure to pay debts- only sued- and of course they can't do that because THEY committed the fraud by loaning people money on the internet illegally. DUH.

They are calling my job still, my family and friends. I wish that they were in town so that I could make a visit and get all of this straightened out one way or another.

I too am being harassed by these people. I asked for proof of the debt which of course I did not get but then they proceeded to call my family and friends and also my job.  I just processed a complaint to the Better Business Bureau but from what the other posts said I hope this helps. Are these people for real? I worked in collections for years and these people are not following any of the laws. They need to be arrested for some or all of the stupid threats that they make.We really need someone to make a class action suit against them and also take this to the news and get thieves or crooks like this prosecuted.

I take it no one knows if these people are not but the majority feel just as I do that this is a scam.

No proof of debt, no paperwork, I say no money.

I received a call from this number a couple of days ago.  The dumb bi*ch that left her number said her name was Linda/Lisa Lopez and told me to dial extension 107.  When I called the number, she started asking me if I was related to a friend, whose information they had.  Then she accused me of sharing a joint account with her, which was completely BOGUS...  I told her that I had already been warned by my friend about this, and that wasn't offering any information.  She told me that my account would be "hit" if I didn't cooperate with her, and hung up on me.  When I called back, a guy answered... I told him to tell "Linda/Lisa whatever the f**k her name is that she's not hitting sh*t and that she could go to hell" and hung up.  Then I called again and asked to speak to her supervisor.  She told me he wasn't there and to call back and hung up on me again. Then I called back on three-way with the friend they accused of fraud on the line and pushed "4" to "make a payment". When I did, the same stupid chick answered.... (I thought she was supposed to be at extension 107... *scratching head*)  Anyway... I preceded to pretend I was someone else, and asked for the address to send my payment... she told me I was lying.  So I called her out and said "What Lisa? Picking up every extension are you?" She said "I knew you were lying".  I cursed her out and couldn't believe she was taking it for as long as I was dishing it (about 4 or 5 minutes).  Then she told me she sent me a fax with my face on it... (um... to what number?) I told her to get a real job... she went back and forth with me, and still never gave me any info.  I guess she really wanted to get paid... I know if I was expecting a check, I would give the address in a heartbeat!
