Debt Collector
They called saying they are PCS Carrier Services and I need to be home from 1-3 to sign papers. I asked what it was regarding, he could not say. The phone automatically forwarded me to a Verizon Wireless call center then hung up. Vanessa Reed called me right back said her company is "Asset and Arbitration." She then gave me details on a loan I have and said I had to pay 600 right now or they were taking me to court. I asked more questions and she hung up on me saying I was putting it off. I called back to ask when these papers are supposed to be delivered. She said from 1-3 today. I was home during that time and no one ever showed up. The number she gave is 855-393-9028 x 101. I can't find anything nline except this is all a scam. FYI - She was definitely black and the guy did not sound too smart.

Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

I too received a message from an unknown number saying her name was Tonya Upton from PCS Courier Services and they will be sending out a process server to serve me legal documents and will be at my home between the hours of 1 and 3 and I am to have 2 forms of identification. If I am not at my residence then they will be going to my place of work in which my supervisor would have to sign as a witness. They said if I had to reschedule or if I had general questions to contact the "filing party" at 855-666-8851. When I contacted the "filing party" it went to voicemal stating, "You have reached DRW & Associates. We are currenlty closed but leave your name and phone number and we will get back to you. " I then called PCS Services to which they said they are based out of Washington State, they had no record of any scheduled delivery for me, no record of Tonya, and they do not serve this side of the U.S. (I live in Ohio). Needless to say, no one ever came to my home or my job. From what I see from other posts they get your info because you have had past dealings with payday loans. I can say with 100% certainty that the pay day loan I HAD has been PAID a year ago. It served its purpose when I needed money in an emergency but just because I used it doesn't give anyone the right try to extort even more money out of me. You have been paid. Leave me alone. Please be aware of this scare tactic! In addition, know that when they say they are "serving you" that means the "complaint" would have been filed in court. Check your county's court view website.  Search for your name there and if there is anything pending against you, you will find it there. It even posts if you have had any traffic tickets. This tip hopefully will help ease your mind also as it did me.

Getting the same thing from DRW and a Vanessa Reed - but cannot find a lawyer that will help with harassment charges because they have no physical office!  Have talked to my original creditor and they told me they are on their "preferred" vendor list.  The figures they give me keep changing each time and they are brutal.  I will pay my debt but no more than that - did get an email from her as a word doc. wondering if I should respond and dispute in that form.  They will not verify anything thru the US Mail.  Nasty peeps!

DRW & Associates (855/895-8951) is a clever scam.  They even gave me a case # 615282.  I called them and respectfully (at first) asked them to remove me from their fictitious list. She told me no, and said that someone will be at my house between 2-4 to collect. I informed her that WE and our ( problem solver) will be anxiously awaiting their arrival.

Ugh! I just got a call from these people. They don't change their tune much because I heard the same script that everyone else had - tried serving me at home, then would come to my work and have my supervisor sign as a witness, blah blah. I got a call first from Ashley. I should have known it was a scam because at the end of the voice mail, she said "good luck" - huh?!? I called them back and spoke with Darnell White. He had my address and the last 4 digits of my SSN. He kept putting me on hold and going back to the attorney. I do acknowledge that I still owe on an old loan I took out and they had the name of the company so I assumed it was legit. I should have said that I would call them back and done some research. Instead, I gave them my credit card info and they charged me $175 for the first payment. They caught me off guard and called me at work. He said he would call me back with a confirmation number as soon as it went through. The second I got off the phone them, I did some research and found this and many other threads. I called my back and tried to stop the payment from going through. Unfortunately, they beat me to the punch and ran my card right away. FORTUNATELY, my bank was understanding and cancelled my card because they said that my account had now been compromised so they WILL NOT be getting my money. I should call Ms. Ashley back and tell HER "good luck" this time!

They also currently switched their number because of the notes that were being posted about them on the internet. If you call 888-518-6337 it's going to ring through to the same office. Most of the time these people use an alias instead of there actual name. It's just another b***s*** collection agency acting like a law firm. There is no PCS or legal paperwork. If you tell them f**k off and Don't pay them NOBODY will show up. These scammers are full of it

This company is a scam. Yeah you may owe the old pay day loan debt but this company tries to make you pay back a lot more than you owe. Yeah they can send you emails faxes and letters demanding you pay a certain balance but half the time they make the balance up to get more money. Also this company does not exist if they are a so called law firm or legal division how come you can't google them or get a better address then a PO box. Nobody calls before they serve you papers they just do it, they use tactics to scare you into paying by saying someone will come to your job. For the people that has not payed have they ever shown up (pcs) or whoever they are. In case you haven't noticed pcs courior service does not exist the so called pcs people work for the same company DRW and associates and they use the process serving thing as a scare tactic. Call your local county to see if you have any court cases pending or if the charges that they are going to say you have even exist. the employees at this place get pissed if you ask a lot of question because they are fraud!! They aren't a limited liability company call the BBB and see if these people exist. They say they have a office in chicago but they don't that company in chicago is a real law firm who has nothing to do with pay day loans. You can't go to jail, they won't garnish wages all they are going to do is threaten you into paying don't fall into that trap. If you have payed them already go to your bank report these people as fraud and have your bank reverse you back ALL of your funds. It does not matter what these people call and tell you they don't work for a real attorney if they do call, them and ask for there companys attornys name and bar numbers. I bet they won't have that either. Need more info Im the one to talk to about these people just comment back and I will keep you posted as far as helping you get your money back from these SCUMBAG SCAMMERS

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

I called the number back, and talked to a young man. He was very rude! He told me this is internet payday loan that I had got aprox 2011. He said told me that I am a criminal, and a bum! I told him that I used to be a bill collector, and that he is breaking the law by the things he is saying to me. He told me "Shut the f**** up!"
