Except they tried to collect on one that I had already paid off two years prior.  I remember very well because I had to start paying it a week before my wedding and was freaking out. And if these debts are past the statute (which if I had still owed on this card, it would have been), then why did they threaten me with a lawsuit?  When I told the rep that I had already paid this debt, she said she couldn't guarantee that I wouldn't get a summons in the next 48 hours.  Sounds like a pretty shady business.  You should be ashamed of yourselves.

888 649 9023 has been harassing me. just got a call at 12:15 a.m. I bought this house thirteen years ago. William woods was a tenant here BEFORE that. somehow these jerks can connect an address to a phone number but can't do a search on the phone number to see that the phone number has nothing to do with William woods. I have been harassed since I got this phone number thirteen years ago. deadbeats have been using it since then. it stops for awhile then some new jerk buys the list. if I ever meet William woods, james lichteiter or Deborah Johnson  I will punch them in the nose.

A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section:
(3) The false representation or implication that any individual is an attorney or that any communication is from an attorney.

(4) The representation or implication that nonpayment of any debt will result in the arrest or imprisonment of any person or the seizure, garnishment, attachment, or sale of any property or wages of any person unless such action is lawful and the debt collector or creditor intends to take such action.

(5) The threat to take any action that cannot legally be taken or that is not intended to be taken.

(7) The false representation or implication that the consumer committed any crime or other conduct in order to disgrace the consumer.

(8) Communicating or threatening to communicate to any person credit information which is known or which should be known to be false, including the failure to communicate that a disputed debt is disputed.

(10) The use of any false representation or deceptive means to collect or attempt to collect any debt or to obtain information concerning a consumer.

(11) The failure to disclose in the initial written communication with the consumer and, in addition, if the initial communication with the consumer is oral, in that initial oral communication, that the debt collector is attempting to collect a debt and that any information obtained will be used for that purpose, and the failure to disclose in subsequent communications that the communication is from a debt collector, except that this paragraph shall not apply to a formal pleading made in connection with a legal action.

(12) The false representation or implication that accounts have been turned over to innocent purchasers for value.

(13) The false representation or implication that documents are legal process.

§ 809.  Validation of debts   [15 USC 1692g]
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing --

(1) the amount of the debt;

(2) the name of the creditor to whom the debt is owed;

(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;

(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and

(5) a statement that, upon the consumer's written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor.

(b) If the consumer notifies the debt collector in writing within the thirty-day period described in subsection (a) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector.

(c) The failure of a consumer to dispute the validity of a debt under this section may not be construed by any court as an admission of liability by the consumer.

SERIOUSLY! laughing so hard my sides hurt!  ... can't help but ask, "Now...when are ya gonna tell us what you REALLY think?!"   (sorry. NO offense! Guess it was so nice to REALLY laugh!)

I'm not going to name any names, but there's some other collection agencies in the Orlando area that try to pull the same stuff.  They could care less if they're harassing the correct person or not, doubt they can spell "FDCPA" much less read it, and can't remember the whether they're atty, federal agents, or collection agency-- sometimes they change "job titles" in the middle of a call.
(Point being,  bet that group and the one discussed on this page are all big partying buddies.)

I'm not surprised they're ripping off employees...they think they're great thieves and will never get caught, and that no one is as brilliant as them.  Lol, heck, I could be in a coma for 6 months and still be smarter than this bunch!

This company never sends out documents. They hardly ever have the correct info on their screen. Ask them to verify your address they can't. All they have is the name, social security # & the debt amount. The reason for desperation is they have to meet quotas. They want 4 callbacks daily which will turn yellow & if someone pays the debt it turns green. Each green they get is $2.00 extra on their check. They pay on the 1st & 15th of each month.  $8hr 10am-7:30pm they post hiring ads on Craiglist. Most of the employees are high, drunk & dressed like their going to the club. Very unprofessional. All you have to do is tell them their being recorded & request everything in writing so your lawyer can review the documents. Just sit back & relax. That'll never happen & don't worry they can't take you to court the debt is to old. I went online to freecreditreport.com & got the company info and/or disputed it off my credit.

I just received a call from this company, I too gave them my address and they knew my last 4 digits of my #ss but I told them I wanted to speak to my lawyer before I made any decision, the young man was very nice and tried to get me to pay on the spot. I spoke to my lawyer and he said to have them send everything in writing because we have know idea who these people are. I then called the company back and explained that they were over the statute of limitations for the state of Florida and that my lawyer would like everything in writing. He said that he does not have the list of statutes of limitations, i said i am looking at them now. The young man then informed me that I will be getting legal papers that could put a lien on me, I told him that is okay, I will have my lawyer handle it. I asked him to please not contact me again and he said that he would not, he wished me the best of luck. He then called back 15 minutes later and asked for a fax number it was important. Seems to be getting desperate, will keep you updated.

I never ever fall for these things, but i fell for this one. They called about an old debt that I had with an old boyfriend. They knew my last four of my social and they were trying to settle the debt. Joshua Clark(rep) said that he was communicating with the lawyers via email and that basically he was the middle man. We went back and forth a couple of times negotiating what i could pay. We finally agreed on a sum and they agreed to take monthly payments. The thing is i felt comfortable during the conversation, but he was supposed to email me a confirmation with the terms of the agreement after we got off the phone, that never happened, which raised my antennas. So the next day i didn't receive anything either, today i called them and their phone puts you on hold and then hangs up after about 3 or so minutes. I googled them and found this, I am so grateful I did. Thank God they didn't take any money and I had to call and cancel my bank information.

Wow, glad I found this post because I just received a call from these yahoo's on a 'supposed' debt over 10 years old!  As I was talking to the guy, I goggled the company and came across your post!  Thank you so much!  The scary part was they did have the last 4 digits of my SSN and my address.  Everything else they said was a lie.  They tried to get me to pay today, I told them no, they could send a DEMAND letter and we would go from there.  We'll see what happens but thank you again for letting me know they were a SCAM!  I wish I had not verified my SSN or address tho!  That part scares the crap out of me!

Now we have these idiots, not only, training good people to believe in them, and then teach them to scam other good people!!! Oh, What the heck is going on in this world?  It is so out of control, I sure hope there are other people that they hire, realize that this co. is a HUGE SCAM!!!!!!  I KNOW ALOT OF SO CALLED DEBTS, IN THEIR EYES, THINK ARE LEGITIMATE!!!  They are trying to collect from VERY,VERY,VERY OLD debts from ELDER people (HOSPITAL OR APTS.) or something that will freak and scare the heck out of them! They might have had problems at that facility that was not right?? These people don't know the situation!!  I have been a victim of scam!!  I was petrified, Thought , I cannot believe this is happening.  I also have had  my tax returns done for me !!! How sweet!  NOT!!!! I now have alerts on all my accounts. Hopefully, they will catch these people, that is trying to take our HARD EARNED money from us.

Here are some tips to remember for you folks experiencing this.... First, there is a statute of limitations on debts. It's between 5 - 7 years. If someone is trying to collect on a debt older than this, IT'S A SCAM. Legitimate third party collections agencies have to abide by a code of practice; no more than 2 calls per day and only within specific hours (I believe it's 7am to 8 or 9pm). They are NOT allowed to threaten you, imply that they can repossess your belongings to cover the "debt" or claim that they are "sending the sheriff/bailiffs to your home". They may not use abusive language, slurs, etc. You can also send the collection agency a "cease & desist" letter.

Remember that you are NOT responsible for the debt of another party unless you are a signatory to the debt.

The most powerful piece of info though, is that under the Fair Debt Collections Act, you do NOT have to deal with third party collections agencies AT ALL, Instead, insist that you will work ONLY with the original creditor. A genuine collection agency has to abide by this and return the debt file to the creditor for follow up. CALL THE ORIGINAL CREDITOR AND CONFIRM THE DEBT, and then work out something with them.

Finally, NEVER, UNDER ANY CIRCUMSTANCES give your sensitive personal information to someone on the phone calling out of the blue! You have no assurance of who they are or if the "company" they work for is in any way legitimate. Time is on YOUR side. Ask questions; the name of the collection agency, their physical mailing address, the collection agent's name and/or identifying employee number. By law, they must provide you with this info if asked. If they get skittish, try to get more intimidating or try to get off the phone in a hurry, it's a scam. If you get info out of them, RESEARCH! Look up the company in question, contact the BBB, whatever is at your disposal. If you discover a scam, you can report it to local law authorities or even your Attorney-General's Office.

Just because you dont pay your bills , doesnt make us crooks. As you see we dont wipe accounts, we try really hard to help consumers settle their debt. We only charged you $84.00 since we figured there is a $3.25 activation on the pre paid cards...which btw i adviced to you. I told you to get a pre-paid because you were concerned about the company charging you more. Its alright, someone else will buy your account and collect on it.

It's a 3rd party collections company based in Orlando, FL and like any other collections companies these days, they try to be creative to recover old credit card debt (in most cases) that has been passed around by other collection agencies for so long that Gellman Moss & Associates probably bought the debt for next to nothing. It's most likely a valid debt but it's probably close to being off your credit report (7 years from the date it became delinquent) having been charged off by the original creditor years ago when they gave up. Every dollar Gellman Moss & Associates recovers is most likely profit for them since the original creditor gave up the account when they charged off the debt. The reason callers ask for the last 4 digits of your social security number is because callers must identify you as the debtor before they can release personal information about your file. If they can't confirm you as the debtor then they can say two things and two things only: (1) The name of their company and (2) the telephone number to reach them. What they can't say is that they intend to sue you for the debt you owe. If they say that then they just broke the law according to the Fair Debt Collection Practices Act (FDCPA). Google it or Bing it and become familiar with your rights regarding collection agencies. Please be aware that depending on the state you live in and its laws, you could be garnished or a property lien be filed against your home or land. But you cannot be taken to court over unpaid credit card debt, EVER! (unless you stole it and ran up the charges but the cops would be coming for you rather than a collection agency calling you). I recommend consumers request their credit report annually since it's free once per year and make sure you aren't being pursued for someone else's debt simply because you share the same name. It's happened to me and it's a mess to get fixed. The rule of thumb is to pay your bills on time and if you can't pay for something in cash, then you can't afford to have a credit card.

I worked for this shady a** company. The name is Geller & Ross (GRA) located at 1650 Sand Lake Rd Orlando Fl 32809 suite 250. They paid me under the table & fired me twice. I still haven't received my last check. They advised us to give out fake names. Carlos Ramirez is the name Jorge Sotos like to use. The company is ran by Tiffany Elaine & David. Their always hiring & firing. Every 30 minutes they change the company name & phone number to Gellman & Moss, Kash Moore, Savage Roman, Sanders Vega & the most recent one Zan & Koffman. They also change the script every few days & they never send out documents its b***s***. I'm not sure if the debt is real & I don't know where they get the info. I wouldn't recommend paying them s***. I notice that once you say this call is being recorded they hang up.
