Extortion Scam Related to Delinquent Payday Loans

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

02.28.14. - This happened on the date indicated. They advised that they had a locator out for me and provided me with a reference number. They told me I owed a pay day loan company (now out of business) $640.00 and I had to pay now or be served with papers. They stated that they were a pre-litigation firm. They were unable to provide me with proof of the debt. I paid them half and then started to do my research (turns out I should have done the research first) I ended getting in contact with Midwest Fidelity Financial, a legitimate company that had taken over CMG's old accounts and they could find no record of me. The representative at Midwest Fidelity Financial said what Midwest was trying to do was illegal and that I should have them prove the debt. I contacted my bank who advised me that they could not stop the pending debit, but I could come in the next day and fill out a form, which would stop any future debits and they would try to get the $300 back. I called Midwest back and spoke to a supervisor Lindsay West who when I provided her with all of the above said she would cancel the second payment and reverse the charge, because " We will not stake the reputation of our company over $640". She promised the charge would be reversed on Tuesday, 03/04/14 and to call her directly if it was not. I am headed to my bank tomorrow. This is CRAZY!!

I got a call from these jokers today, saying the company name is Midwest and is a law firm.  They were asking about a payday loan I had back in December 2011, which I paid off already.  They said they were also purchasing a locator company to find me and serve me with papers.  They said the file was sealed and they could not give me the information.  When I asked for a debt validation letter, they said it would come in the packet of documents they were going to "deliver" to my house.  I told them that until I received a debt validation letter I would not give sign for anything and they better not send someone to my house.  They said they could not give me the debt validation letter until I showed them proof I paid this account off??  Yeah right.  They call with a number that shows up as a local call (in my case Pennsylvania), but they have robot servers that do this.  Do not contact these jacka**s and give them information.  I threatened to sue them for harrassment and they shut up.  These people also sounded foreign, which puts me on alert right away.  Real debt collectors mail you notification and if they have papers to serve, they don't call first.  Do not give them any information.  I just checked all three credit agencies and this loan company is not on there at all, which they would be if I had not paid them for almost 3 years. The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

Phone number came up from Tennessee, 865-223-5367 left a message with a claim number and that I have been officially served. GOOD ONE!! Saying I need to call them back at 888-682-5439 that this is a law firm, didn't state which one. Good thing for phone number blocks. I won't be getting this call again.

I also am receiving harassing phone calls from these people from a 727 number (which is my local area code) but I see that this particular # is from out of the country - the person is very "official" sounding but does not give any information - only to call the 888 #.   I have had a recent problem with identity theft & believe this may be due to that, but can't get these people to listen!!! I want to file a complaint against them for harassing phone calls.

This number call my  boss and told them that they had a claim and provided  a claim number. I called the number and asked what this was about, they told me it was a payday loan from someone and that if I did not pay them today. That they were looking for a located processer, even  when I told say that I do not owe this person, nor do I know them they instead that I pay. So I received a call saying that they were threating and rude and to have them stop calling. So I called an told them that they were harassing this person and the only thing they could say: can you pay biy this evening. I have know idea who they are and I am going to report them to the  fraud and spams with my local government. If I owed them why not send out a notice of collection and make it a legal attempt to collect a debt.

Called my sister and her mother in law too. I filed a complaint on the fraud website. I do not owe anyone money but did take out a pay day loan 3 years ago and have had calls like this prior. It's a full scam. Even if they file a judgement it will not hold anything.

These people are ridiculous. I got a call from Todd Day. The actual caller ID showed 727-216-4615. He told me I could call 888-682-5439 to speak to someone about my claim. He has also called my workplace numerous times. The last time he asked for the owner of the business. He wants to verify an address to serve me papers. Not to mention, process servers don't give you a verbal notice that they are going to come to see you. And, if he knows the owner of the business by name, then he most likely knows the address of the business. He always ends with a threatening "you HAVE been notified."
