Debt Collector
I have read comments and the negativity that races around these type of forums. I have one thing to say, America (the Nation) is 99% in debt, it is what it is. If you have a home loan you are in debt, a car payment, or use that credit card, you are in debt and can't afford it. It is common sense!!! These are examples, I am not implying you have any of these!! I am sick and tired of people bashing other people because 1)They lost their high paying job, 2)they got in over their heads or 3) became ill and can no longer work. The remarks I have read are discriminating and not necessary. Discrimination is a crime, just like these fake debt collectors!!!! Just because a person did not pay a high interest rate bill and decide that they need to file bankruptcy does not make them trash. PERIOD!! These people called me. I have NO DEBT!! My home is paid off, no debt but they insisted to attack me and call me names!! It is discrimination, harassment and they have broke a large amount of Consumer Laws that by the way are Federally Regulated!! To the bill collector that is on here: think before you speak, especially to someone like myself because you just don't know who you are dealing with!! That is not a threat, it is a promise!!! ;)

I've been receiving calls from Rossi and Lombardi for months now. It sounds like these people are reading from a script. Tom Pena, Mark, Jennifer, Bob etc... They don't even say, "this is an attempt to collect a debt. The don't even say your name. Just saying that I'll be served with papers, or should've been served at my job, or home. Needs to go over page 15 with me, because my court hearing date is rapidly approaching. Calls from different phone numbers, 1-888-208-7341, 1-888-319-3217, extension 106. They also claim they have served me with papers at my home. Says my name and Social security number was picked. Hours to call are 8am-8pm Monday- Thursday, and 8pm-4pm on Fridays. They don't say what the debt. Keeps threating me. I don't answer them.

No one else reading this page can ''do something for it'' or end calls on your behalf. You have a right to a quieter phone whether you owe this collector or not. That right among many others is granted by the FDCPA and similar state laws.

http://www.ftc.gov/os/statutes/fdcpajump.shtm

To a ''not me'' case I always recommend putting the agency on notice, just as you would if you were the target and the debt claim was invalid. Send a ''cease-communication'' notice via USPS Certified with return card. This is the method promoted by the FTC and many consumer watchdogs, and the only way to set a legal landmine, as such a notice is ignored at their risk of a lawsuit from you. You may already be due some payback if you can prove you've endured abusive or misleading treatment in an effort to collect debt.

You can get the whole thing done in one one curt paragraph. Some variant of this will do: ''These are the affected phone numbers, I cannot help you with your problem, stop calling about this matter.'' In my ''shut-ups'' I also like to briefly review when I was called and what I was told by live reps and/or canned messages. This is done in a calm ''inside voice'' without making threats or citing rules. I also print the relevant USPS tracking number someplace near the page footer. My little parts and accessories establish the background for an escalated dispute, particularly if I encountered resistance or frustration during past calls.

Mostly incorrect .... A bit under a quarter of the United States require "all party" consent to record phone conversations. For purposes of gathering evidence of a debt collector's misdeeds, one party can announce recording and the others merely acknowledge. I believe the lack of objection also equals consent. The oft-heard "may be monitored for quality assurance" phrase is also a sufficient disclosure. The consensus I've seen is that the *other* parties may then also record, even if done quietly, since the expectation of privacy has already been waived.

In "single party" states you essentially give yourself consent to record and may do so unannounced. It's not hazardous to hedge your bet and announce, except that the other party may switch abruptly to Very Best Behavior mode and not provide the violation ammo you need.

Here's a nicely constructed site for journalists which explains the issue thoroughly:
http://www.rcfp.org/can-we-tape/state-state-guide

Additional legal support came in August 2010 when a federal appeals court ruled that a secret recording, AKA single party consent, does not violate the Wiretap Act when the recording is made with no intent of committing some other wrongdoing.

} How many times do I have to tell [scofflaw collection agencies] that I'm NOT the person they are looking for

Once apiece, if done on paper and sent USPS Certified with return card. Twice through a lawsuit if any recipient is stupid enough to ignore such a written order.

Hey, uh hum, "Rossi & Lombardi!" Where'd your fake website go? Looks like you also got a pretty bad rating with the one time BBB review, eh? That's what you get for lying! Shame on you. I checked your fake website and it says you've checked out for a bit? Too bad, huh? That's what you get for lying!

Ha here is one for you all. Tge address they list on tge BBB site doesn't exist. This company is redicilous. I filed a complaint with the FCC and they told me not to give any information and if they were a real collection company that we would recieve paper statements in the mail because an email is not a recognized form of contact.
Lovin it!!!

Say, has anyone noticed how quickly "Rossi & Lombardi" created a page with the BBB, that is after they were challenged to "actually be found on the internet?" What's funny is that they have a D+ rating!! Ha, ha ha!!! Not only that, they also created a lame duck web site called "randlcapital.us" (see sarah's posting above for May 3, 2012). Checked it May 7 and again on May 14 only to find that it said, "this site has stepped out for a bit." All of a sudden, they don't exist any longer. Gee whiz, I wonder what happened? Pretty easy to figure out, eh???

And one more thing. How many times do I have to tell Monarch Recovery, Enhanced Recovery, Plaza Associates, Creditors Financial Group and Niagra Credit Solutions that I'm NOT the person they are looking for before they understand the meaning of those words? Hello! Then Rossi & Lombardi, supposedly you, says all you have to do is answer the phone to make it stop. Guess you've never been on the other end of this, huh? I'm a business woman and my name is all over the internet, and it's not who you're looking for. Your people have the gall to call and threaten me? I don't think so. Bring it on. I have all your names and addresses, and you don't have a clue who I am. Bring it on.

This is a response from the administration at Rossi and Lombardi. The notices you are receiving are private and confidential. We apologize if you are receiving calls and we have the wrong number. If you respond to our department we will be happy to remove phone numbers that may be wrong so you do not get further calls. We have to, in accordance with state and federal regulations, make every valid attempt to issue notice to individuals. If we have the incorrect phone number for a respondent it is most likely because public record and or information the respondents themselves have provided it.

We assure you this is NOT a solicitation. This is a licensed company. If you are the individual we are attempting to contact we will provide you with verification of our legitimacy. If you are not we will gladly remove your phone number so you are not being bothered and we are not redundantly wasting our valuable time. WE UNDERSTAND YOUR TIME IS VALUABLE AS WELL.

Again simply ignoring the phone calls and reporting on this website will NOT stop the calls. If you cooperate, we will attend to the situation in a professional and courteous manner. We pride ourselves in due diligence and do not want to cause an inconvenience.

Thank you again for you cooperation in advance.

True....collectors making up fake debts is illegal. I dont think that was even part of the topic here. But our country is full of lazy people that dont want to take care of their debt by working and slowly paying it down, so then they blame collectors for their issues especially when a judgement may arise. Too many scam artists trying to run up credit and borrow from institutions with no intent to pay back and they know ways around the laws so that they can avoid paying as well. Take that to your boiler room jack***!

Debt Collector
Received a threatening call from a so-called legal company by the name of Rossi & Lombardi, whom when Googled, don't even exist! Called me after numerous attempts from Monarch Recovery to collect on a debt made by a woman named Vanessa Penya. I've had my phone number for not even two years and unfortunately inherited her harrassing phone calls along with it. Her debt, not mine. I'm mad as a hornet! Called a lawyer.

Nope, it's not a scam. Failing to pay bills is a breach of contract, neither a moral failing not a crime.

Now, fake collectors trying to collect fake debt and impersonating attorneys are in fact committing crimes. But you already know that. Take your BS back to the boiler room.

Is it a scam to not pay your bills? I think so....people that are recieving calls from any agency owe money in some way, shape or form....and I am sure it is annoying but there is one way to stop them legally. Pay your bills on time or dont accept credit or payday loans that you cant pay back!
