These people tell me that I had a loan from CapitalOne in the year 2000.  They say there was a 30-day default letter sent to me.  They indicate that they have this information, yet they will not show it to me.

I spoke with Steve.  Steve told me that "I work directly with the attorneys."  Later in the conversation Steve told me that he was an attorney, contradicting his earlier statement.  I asked for his last name and his bar number and he refused to provide it.  I told him that showed me that he was not an attorney.

Later I received a phone message from Scott Majors of Arbitrary Mediation, 888-248-7196.  I called the number once and left a recorded message.  I tried to call two other times and eventually the phone went dead.

I did an internet search for Scott Majors Arbitrary Mediation and found nothing legitimate.

This alleged company (Arbitration Resolutions) and it's alleged affiliate, Scott Majors is a total SCAM. Every aspect of their attempts to collect on an alleged debt from me, are in violation of consumer rights laws.

Don't fall for this scam. Their website isn't real. They refuse to provide written proof of owing a debt. They send a payment agreement via email that's on an editable Word doc - not even a real letterhead. They're attempting to sue as a third party debt collector (it's against FTC regulations for third party collectors to sue - they CANT sue).

I gave $50 to these b*****ds and set up arrangement ls to pay another $900 over three months. Stupid me. At least I'm only out 50 bucks. I cancelled my card and closed the account they were to draw from. I threatened to sue them. No word back.

Wanna have fun and aggravate them? Call them at 888-743-9314 and tie up their call center. They do NOT appreciate this. They need to be brought to justice!

919-229-4173 JAMES SPENCER - Called me on my cell phone - caller ID came up 911. Interesting. I listen to the message and call him back. He tells me is OFFICER JAMES SPENCER....Of course that alarms you. He then proceeds to tell  me I have legal case with them in regards to a Payday loan that I applied for it on line and revieced the money and then via online I gave an electronic signature and then when they went to take payment out - it was returned. That if I didn't pay the $762.29 cents today, they were filing a warrant for my arrest. I told this guy I have no clue what he was talking about....VERY heavy accent. He then gets pissed with me and hangs up. I google the number and it is a VoIP in Wake Forest, NC. I call the guy back and ask for him. I ask for him to provide me all the details. Loan number, case number etc. as I have never got a loan, nor have I changed my bank account in years. So I could got to the local police, he then gets quite mad... and tells me to go to the police and call him back when I have an officer with him. I then tell him I want the name of the police department he is representing. He tells me he isn't the police .. really? I said to him - you said you were a officer an officer of what? I am a restitution officer. Contiually getting madder. As was I .. wouldn't give me any information and hung up on me.

I did some more googling and ran across James Spencer on this site- interesting all of our stories seem to be the same. Nice to know. I will report this to the loca police department.

Thanks for your help!

Today I figured out this scam because I just happened to be gone and my machine picked up both calls.  They work together.  DSS Debt Solutions Services 855-673-5298 and Pre Trial Resolutions 888-278-8565 John Spencer.  The first call is from DSS around 11 AM today 3/31/2014, then three hours later Pre Trial Resolutions aka John Spencer with a case file and 48 hour warning.  I started out with DSS, called them first to see if I could find out why they were calling my deceased son after 16 years of being dead.  It was for a car loan with Capital One in 1975 when he got a loan bought a car and then told Capital One to come get it and repossess it.  My son was born in 1966  so at the age of 9 he took out a loan for a car and actually bought a car????  That was 39 years ago and in my state you have only 5 years to collect a debt on a contract and 3 if it is just an unsigned loan.  Then they changed their story to it must have been my husband who does not have the same name as my son.  However they had the last four digets of his SS #.  We never defaulted on any loan ever and pay cash for most things including cars and houses.  She informed me no matter what I said,  they were turning it over to the county where I now live and it would go to court and we would be sued.    I said well we will not be there so good luck to you and hung up.  Then I called the John Spencer number who it turns out is the second half of the scam, once you are told you will be sued, you are supposed to be sooooo scared you will quickly do what ever John Spencer says including paying him some huge amount of money to keep the thing out of court.  I just laughed when they told me this and hung up.

I just got a message along with a case number from a Jon Spencer stating they were called 'Arbitration Resolution' and to call back this number 888-278-8565. The call came from 804-446-8962 and I've gotten them before- I used to live in the Richmond area so that area code is what has caused me to almost answer the phone in the past.  I will file a complaint on the FBI website as well. Thanks for all these head's up comments- I've never researched that phone number this far. Glad I did today.

I got the same call and was threatened if I didn't pay on a payday loan from CashCall. I had included this in my bankruptcy in 2008 and actually spoke with Cashcall today. They told me I do not owe them anything and that they have been receiving calls from borrowers with the same info. I gave them the numbers of the places calling me. They said never give out the information they want, but they already knew my social and all that. Below describes how they get the info. Another person posted this on my post after I asked what to do. File a complaint with the FTC and contact your local authorities and also your Attorney General about the issue. My debt with the loan company was charged off and I do not owe anything, they found out obviously that I had one and never paid on it, but I guess they don't know I already charged it off and do not owe. They verified on the phone with me today and said everything is clear and that if I did owe them they would try to resolve the matter first before threatening to sue me.

One, if not both, are scam.. Demand debt validation sent via the US mail. Never pay a bill without it. Its the law. Follow the steps in what you need to know..

Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

There must be some legal way to stop this. Really all they will do is charge you the amount owed to represent you with the original junk debt company. They have no authority to do that. We should all start reporting this.

They actually are a company that sees court judgement and acts like they are the person who bought the bad debt. Well guess what, they were trying to collect on a debt I am already paying in installments. My agent for the real company offered to go on a three way call.  I did call back and informed them that they are collecting on a debt that is already being paid. She backed off immediately. It pays to do research.

reposting here since numbers are related
BUSTED: these numbers are linked: 516-453-0169 / 888-743-9314 and 516-408-2174 / and 888-390-7104

both use DIFFERENT fake company names BUT have the same employees, including a "Scott Majors".

over a month ago received a call from  516-453-0169 w/message left directing to phone back to 888-743-9314 "urgently" w/in 48-hours to resolve a payday loan. didn't phone them back because knew it was a scam and simply emailed the voicemail to FTC and Attorney General.

YESTERDAY, received call from:  516-408-2174 which left message to call back to 888-390-7104 (urgently w/in 48-hours or matter will be resolved in court, blah, blah, blah).

but thought something was familiar. called back to 888-743-9314, and low and behold: Scott Majors, the manager himself, answered the phone. however, instead of being like the ignorant cow that answered or demanding like Majors was yesterday, THIS time he was apologetic (because he knows the JIG IS UP)! when a certain number is called, it triggers a log file to Attorney General and FTC automatically.

I've received multiple computer generated messages from a Montana Area code 406-299-1250 plus other numbers.  Reverse lookup indicated that the calls came from a Butte, Montana location.  The whole "computer generated" call made me realize that is was bogus.  I can see how this might frighten many people.  What can be done so this is not taking advantage of some people?  Who can be contacted to stop this nonsense?  Guess I'll try our federal employees if I receive another. I hope no one thinks this is legit.

Received  two calls, one on yesterday and today from two different phone numbers with the same bogus message from John Spenser of Mandatory arbitration. I forgot to save the number of the first call, but today call came from 214-272-2123 to call back 888-743-9314. I call the 214 number, got some woman who answered the phone Pretrial litigation. WOW, what happened to Mandatory arbitration? I told her I was reporting this number to the local authorities as a scam, she immediately put me on hold into a phone cue, so I hung up. I just tried calling back, and now they don't answer and a automated system to allow a voice mail message to be left picks up. NOT! I am going to report the number to the Federal Trade Commission and whoever else I can. It is a Fraudulent call from a scammer trying to get money. Anybody that falls for this crap is not being smart.

IGNORE THEM THEY ARE FRAUDS.  Do not pay them a dime.  If you ever owe anything to anyone they are required to send it to you in the mail and many of these guys will sue you when if they "purchased" your debt from the original creditor they have NO LEGAL standing to sue you ... but they will anyway.  Most won't but some will.  If they do ... just DENY, DENY, DENY.  Deny your signature on any document because you can't remember signing anything.  The only way they can get any $$ from you is for you to admit you OWE it ...and just deny you owe it.  But don't ignore any "legal" action that may be filed.  Answer the complaint and go to court ... just deny owing anything or any knowledge of anything regarding that account.  If you don't admit to owing anything they can't get a dime out of you.

They are frauds ... do not pay them a penny.  Now they have your bank account or debit card number.  if they are real they MUST send you paperwork through the mail.  They told me they had to send it email.  I told them they were in violation of the Fair Debt Collection Practices Act ... They have no legal standing to make you pay anything ... even if you do have a bounced check or you defaulted on an account.  These people are FRAUDS.  CROOKS.  Change your debit card number or whatever account you have used with them because they will sell that number to crooks too !  NEVER pay anyone anything over the phone ... make them prove any debt on paper from a mailing.  They don't want to send thru the mail because that makes them subject to mail fraud charges.
