That's because someone admitted it WAS their debt. If you're in a car accident, do you immediately admit fault and tell everyone it's your fault? Exactly. DONT DO IT. Even AFTER the SOL is up. Stay on the phone - tell them you're not doing so well...you have diarrhea, it's really bad and smells and and and ITS JUST LIKE A DEBT COLLECTOR! If it's past the SOL - tell em to eat you and wait and see what they say. Get your credit report. Know what's real and NOT REAL. There's crap on it that you don't owe, BELIEVE ME!!! Challenge it. If they can't prove it's real - BOOM, off it goes!!! Work on it like that for six months and your score will go up 100 points and I know, because it happened to me and I did it. Debt collectors FEAR ME. Bring it on!

Unless the debt collector has ORIGINAL DOCUMENTATION OF THE ORIGINAL DEBT, not just a printout from their company computer records, it's NOT A VALID DEBT. ASK FOR DEBT VERIFICATION. They have 7-10 days to give you ORIGINAL DOCUMENTATION of the debt to verify that you owe it. I can make up my own fake documents that say they owe me money, too. Oh, if you do pay and they settle for less (they buy your $1000 debt for $1, you pay $500, And they've just generated $499 revenue.) READ UP ON THIS, KNOW YOUR RIGHTS AND DONT ALLOW YOURSELF TO BE TREATED THIS WAY AND DO NOT PAY OR ADMIT ANYTHING as this starts the clock on the SOL all over again. If you legitimately owe it and want to pay it, pay it, if it makes you sleep better. Otherwise, STICK IT TO THE SCUM BAGS!!! Look up consumer protection attorneys. They know what to do and will make it all go away.

I think all you rotten, no good, phone spamming ***holes should go do what the debt collector on 20/20 said to do...I don't need to say it here. If you're a garbage picker debt collector who's company has purchased a debt from someone else ($1000 debt for $10) you can take a flying leap. I photograph EVERY caller ID call you make. I record YOUR call because YOU say you're going to record the call. I'll call YOU BACK to waste your $$ on YOUR 800#, and I keep a log of each time you call. Believe me, if there's more calls to my phone, you better be prepared to give me YOUR FULL NAME AND EMPLOYEE ID NUMBER. I will then speak to YOUR SLUM SUPERVISOR and WANT DEBT VERIFICATION - original documents with my signature showing I owe the debt. From that point, until you send it to me, within one week and if not within that week, you are FINISHED. I have filed suit against six debt collectors under the FDCPA and have won EACH CASE because I know each fine point of the law. I dispute EVERY debt you claim I owe and EVERY ONE OF THEM have gone away, especially the ghost debts. Yeah, I know. If the "debts" were real, you wouldn't be using the fake "process server" act.
Nor would your "process servers" be calling relatives, when you clearly had the victim's address and could find their phone number, since you just pulled their credit report.
Nor would you be using illegal threats of "arrest" or trumped up "court costs" to coerce a "settlement".

Nor would you never send any real validation, just some "settlement letter".

Only true statements are that they can't send anything, and that they pulled a credit report.
Anyone could pull a credit report and pretend your husband "owes" something they find there.  In fact, if they want the best odds, they would pick an old account so you might not remember whether it was paid.  

Yet despite being past SOL, they play the fake "lawsuit" game, even though they admit they have NO PROOF.  You are supposed to believe that the credit report is somehow "proof" you owe them.  Yeah, right...

They can't serve you any "summons", because there isn't any "lawsuit".
The "failure to appear" is all BS, as are the "two failed attempts", and the threat to get a default judgement with no service of this nonexistent "summons".  They basically threatened to commit a "fraud upon the court".

As you found, they deny responsibility for all the lies, as they have deliberately segregated their deceptive scheme into the fictitious fake "process server" and "filing firm" ("debt collection attorneys", but not really, but "not debt collectors subject to FDCPA", or whatever) operations for this purpose.
Setting up their excuses in advance tells you they planned all this out, so they could make the illegal threats and get away with it, with just enough "plausible deniability".

The debt is still there, however its outside the SOL do you understand what SOL is?   It not only stand for s*** out of luck it also has a legal meaning.... Statute of limitations.    Meaning even if some junk debt buyer/collection agency sues they cannot win.... Its the law.    later   :)

Ha  they said they could not even send me anything, and they said they did not have to follow the fair credit reporting laws because the are not a collection agency the are a filing firm, LOL but he was not real smart because just prior to that he tells me they sent out notice to us 45 days ago  asking us to agree  to settle this debt. Now a company that is "just a filing firm" doesn't sent out notices to agree to settle debts.  LOL  seriously get your lies straight.  
When pressed for something to validate this debt, he said he could not send anything out, they did not have anything.

They called my dad, about my husband.  Same scenario that some of you had.  A lady said he had 3 hours to call back, they had two failed attempts at serving him, one more attempt would take place and if that failed it would be recorded as a failure to appear and the court action would proceed, hearing, without him. She said they were trying to serve a summons on him. When I asked him what her name was and what company she would not tell me.   When I spoke with Rincon the next day the guy told me that there was no summons or court case,yet.  I said yes I know, I checked.  So, i ask him, why did this lady call up and threaten a lawsuit. He claims no knowledge and that he cannot control what a process server does.  Baloney, this was not a process server that I spoke with, she knew the phone number to Rincon, and the case # yet Rincon thinks they can say they did not what this "process server" was doing and had no knowledge of it,  right!  I think not! Lets see how that will hold up.  lol.  
This is an old debt, outside of the SOL, not to mention the fact when I asked them to follow the Fair credit reporting laws and send us proof of the validity of this debt he actually said they have no valid prood of this debt but they have the credit report!  OMG.  Look people, they are nothing more than junk debt buyers, they purchase old debt for pennies on the dollar, scare you and your families, they come on this and other sights and actually post saying "yeah they sued me".  
If they were going to sue you they would, they would not threaten.   If they are going to serve papers, let them, learn your rights under the law.

I got a call from this company and they told me I needed to call within 2 hours or they would file a law suit against me, I asked for a payment plan but once I received their confirmation in the mail I could tell they were a fake company once I received a paper document in the mail, it looked cheap, like my little sister typed it up on her computer for a class project! I decided to google it and found all of this! I can't believe I fell for this s***! I'm going to report them and I won't give them a f****ng dime! How date they! They even called my mom's cell and my dad's house! How do they get this info?? They are harrasing my family!

"Agreements" obtained through illegal threats and deception are voidable due to duress.

Obtaining payments of alleged "debts" through illegal deception violates FDCPA.  Obtaining payment of unowed amounts through deception is fraud.  Using the phone to obtain such payments through deception is wire fraud.
