got a call from henry patterson, representing 'the law offices of john nicolia'. he said i was listed as a secondary contact in the file for someone named micheal with the same last name as me. he asked if i could give him micheals phone number. i do have a brother named micheal, but he isn't hard to find, so i pushed henry for a request in writing and an explanation of why i was listed as a contact. he wasn't going to be cooperative on either point, so i hung up on him.

I got one at work.  There is no paperwork at my home address, so there was no court review.  You are advised, by law, anytime you are being sued.  If this is a collector, they should watch out.  I know it is tough out there for folks counting on our money, but Dave Ramsey just focused on a call from a lawyer who sued the pants off a local collection company for over $1 million for pulling this kind of crap.  If it ain't in your mail, it never happened.  The court is required to copy you on any docket that goes before a judge.  If it is a simple finding pursuant to action, then you still get a notice that the court wants your action.  They don't just call you at work.

no these are attorneys giving you an opportunity to handle these accounts before the summons are requested from the court in your local county. You should ask for a "dunning" letter if you want to see why they are contacting you. request your file number, original account number, current balance and origianl balance. Then you will have the information on the debt that you forgot you had.

We need a phone number to contact the Mr. Wagner today called the number 888-754-0040 and the line has been busy all day long. we had made payment arrangements with this company. I have since lost my job and not able to make the payment due on 04/17/2009. My concerns are that this company will begin to sue us for the money owed and we just do not have it at this point. I have called all over the country today trying to find a good number for this company. We spoke to Mr. Wagner almost a week and a half ago, but no success today can any one help with the correct phone number??? Thank you. Ms. Hmilton

The number was changed to 866-941-3774 they should have had a forwarding message on the line. I'll call the phone company about it and see what i can do hope that helps you.

Oh how RIGHT you are, hon, lesson learned should indeed not be mis-leading [sic] people. Because that's the job of the fine crooks at Eastern Asset Management, they are PAID to mis-lead people, on the phone, and when necessary even here (apparently it's necessary to do it A LOT on here LOL).

So you go ahead with the mis-leading and we'll just sit back and count the FDCPA violations and act accordingly.

Half of that is hog-wash. You should have called with the new info. If the debit card info you gave them was attached to a checking account (therefore you gave them the account number and routing number, not the card number) then it is considered writing a bad check. Technicality they could go after you for the ,based on state laws, bouncing checks over state lines (same as any company). The rest is hog-wash.  Make sure you get the agreement in writing via email or fax and tell them you will be expecting a paid letter and want that they will provide you with it after payment in the email or fax with the agreement. Keep all of your payment statements as proof too. hope this helps

We also supply info by email and fax (regular mail is also avail, but faxes and emails you get faster) We accept all forms of payments but doing post dated  credit cards and checks do not cost any extra money we don't want you to have to spend more money when you already owe some. Oh And Lesson Learned, I have a feeling you are a collector. Common abbreviations (such as ppl) are used in collections to note files.

Always get paper work. Any place that won't supply it up front though email or fax, don't pay! also watch out there is a huge collection scam from India right now the feds are checking into. (John Nicolia's Office actually reported it to the feds) The people call and have a heavy mid-eastern accent. They harass the debtor and say extremely bad things if you say send me proof or that you will not pay. Most of the numbers come up as California area codes. Just a warning but be careful.

Again you must be an ex-employee of the company who got fired for doing shady things.  You should know  EAM is a huge company with many branches with many different managers and lawyers representing them. This particular number happens to go to a nice branch. And unfortunately for debtors, if they don't take care of there debt's we do sue.

This is obviously an annoyed collector. Mr. Sulu does not deserve quite this much attitude. Seriously you are correct about running an office and those of us nice enough to try and help these debtor by providing info. Some people on this page deserved your harsher message. Understand that we are doing our job and it is much easier to do when the debtor and collector are civil to each other. If you don't want to pay, fine, thats not my problem but don't yell and swear at me I didn't make you take out a loan and not pay it back.

If you have your paid receipt all you need to do is fax it over to the office and we will take care of it. call the office and ask for the fax number. I know That if my clients paid it, I don't want to kept calling them. As soon as I get the fax(s) I note the file and add the documentation and send it to the client.

I hope that you learned a lesson here. These ppl are going to steall all your money because you gave them permission to when you gave them your checking account information. Never ever do that. You should always send a a money order or certified check my mail. They cannot do anything to youn if they do not send you the correct documents my mail, that you requested to verify the debt.

I am taking these ppl to court myself and failing a federal cause because of all the federal laws they have broken.

 I actually was trying to clear up my bills at the time.  I had dealt with another collection agency two months earlier and paid my debt off.  The second company saw me coming and took advantage of that.  I paid 3 times what I owed, did not receive paperwork.  The company no longer exists and now a new company is being run by the brother of the orginal company.  So do not think we are all dead beats trying to beat the system.  In my case my ex-wife ran up the cards and phone bill and left.  Since they were orginally in my name I was responsible and I made a good faith effort to pay all of my debts off.

Hey Mr. Sulu, did you ever consider how frikking EXPENSIVE it is for our company to perform the PUBLIC SERVICE so necessary to keep our economy STRONG?

Ok, I'm young and I'm scared to death of this situation I'm in. They called me non-stop for a while and then quit calling me and have picked back up calling me again. They are threatening that if I don't pay $1000 dollars on a 5 year old credit card debt then they are going to take me to court and have me arrested. I had given this company my debit card information buy luckiely the bank had a breech in security and issued everyone new cards. However now they are saying I defrauded a financial institution and can face jail time. So are these people a bank or a law firm
cause they have told me both? The man I spoke with today says that they  can freeze my bank accounts as well. I just got a new job and I didn't tell them that but he said they can garnish my wages as well. I don't have a problem paying this but I do not feel comfotable after reading all this to give them my info over the phone. Please help! I don't know what to do!

A Mr Ponderaro called, left a message on my answering machine (These guys are breaking all the FDCPA (Fair Debt Collection Practices Act) regulations.

FDCPA does not allow a debt collector to:
Ruin your credit rating
Refer account to an Attorney
Garnishment or repossession
Extract money by giving false threats
Sending letters to debtors that appear to be sent by the Court is also not allowed.
The debt collectors are not allowed to inform the employers about the purpose of the call.
A debtor cannot be threatened of being arrested on failure to repay the debt amount.

Whom to contact in case of FDCPA violation?
In majority of the cases, debtors who have been harassed by debt collectors report irregularities to the Attorney General of the respective states. You can also approach the Federal Trade Commission or FTC to register your complaints.

A Mr Ponderaro threatened me on a message on my answering machine, "This is a Procession Summons from EASTERN ASSET MANAGEMENT for the law firm of John Nicolias, you can get 6 months in jail, for case number (fake case number # trying to get me to think it is legit), etc, call me at 1-888-743-4628."  He also said my father's name, not mine (breaking another FDCPA regulation).

EASTERN ASSET MANAGEMENT AKA ETHICAL ASSET MANAGEMENT is a bottom feeder Collection Agency, Extracting money by giving false threats and using intimidation tactics.

Nicolia John Law Office is a bogus front for their Collection Agency operations.  They say they are a "Law firm".  They have no lawyers but say they are a law firm (scam, scam, scam).  They call people's families and say they are trying to keep their loved ones out of court and jail so they should make a payment right away.  Once they get your money they vanish or change their number.  There are many people that work in the "office" and they keep giving fake names.  Avoid.

Do not return the call, nor give ANY information.

Report false threats to the Attorney General.

The office you were working with moved to a nicer location (according to the person i spoke with) and there should have been a message stating the number has changed (that what she told me). I just had this problem too. I was calling to request my paid letter when she told me about the move and to call this number if i needed to speak to the legal assistant in charge of my file. I called and talked to her. She emailed me a copy of the paid letter and said she would send one in the mail. I agree with ~been there, done that~ when it comes to kathy's comments. Erika should also read them.

erika that is not too smart you were about to get your credit fixed and now you are gonna screw it up. If you want paperwork ask for it. You and kathy should know what you sign before you take out a loan. Those online loan interest rates are extremely high! therefore when you dont pay you get charged the interest. secondly those loans are to be paid back in one lump. they do not want payment arrangements so if you make a partical payment you get charged. Tough thing is you signed for this loan electronically therefore you accepted those terms and legally owe them. No one should ever take out these loans! At least with this company they will work out a payment arrangement with you. You may not like the arragement but at least you can get it taken care of. Oh and most of the time if you supply your documentation showing what you have paid prior and the balance they will work with you to settle out for what you still owe not what the online company has supplied to them. You really should not be giving advice to others kathy when you don't understand your own situation.

To answer your question I'm calling the bank to stop my next payment because they took 200 out of my account and I still owe them 300for April and 300 for May and the number I spoke to a lady on 8887540040 has been ringing busy and I didnt get any paper work that I requested.

I received a call today from an attorney stating that I still owe debt from 2004. Its been almost 5yrs and all my attempts to contact this company before was unsuccessful. Anyway, my original debt was only $500.00.. They told me from interest over the years... the debt total ended up being almost $2000.00, but they told me they would settle for $1498.47. The women("attorney") I spoke to was clam, collected, and very understanding. She sent me an email, but the email stated no information of my past debt.. It just said what she told me on the phone.. like she was reading from it the whole time. As naive as I am, I gave her my bank information and supposedly, EAM is going to take a payment of 442.37 out of my checking account every month for the next 3 months. I am scared of what I am reading here. Should I continue on with this or should I just leave it alone and hope it goes away?
