Picked up the phone and it was a prerecorded voice (only half paying attention) did not use my name just said there was a complaint against my ssn and name and to call back a 1888 phone number.  The ladies name was Janet  and missed the phone number(no pen).  Tried to *69 the number and cannot be reached.  Once get all the information they usually will call back.  Suspicious right away since didn't use my name and said a complaint against my ssn and name.

It is not illegal to not repay a payday loan, period.
So you could never be arrested for it, you COULD be sued for the payment but if that is the case you would not be told over the phone about it, you would be served or sent a letter from your county.
But most legal PD Loan companies won't sue because it will cost them more in legal and court fees than it would to just send it to collections and move on.

If they are calling for a bad check, again you would not be informed by the company over the phone you receive a letter from your county bad check division, mine is called the "Worthless Check Unit" and they will usually send a copy of the check, and inform you how much you need to pay and when.

Also, arrest warrants are not just randomly issued, and they are usually only issued in criminal situations or missed court dates for instance.

So in short, this number is a scam and should be ignored, I don't even waste the time or energy to call them back.

Glad you told him where to go!  As stated in the FDCPA - it is a violation of its regulations to refuse to send documentation proving you owe a debt to them, and as such, you owe them nothing.  Threatening you with a lawsuit to scare you into paying is also illegal per the FDCPA.

If you have a company name and address for them, send them a cease and desist letter and also state you do not acknowledge the debt as yours.  You have asked for the legally required documentation that you actually owe this debt to them and they have refused to comply with federal law.  Send the letter certified mail/signature/return receipt and let them know that you are recording all calls they make to you on the advice of your attorney, for your own lawsuit against them for multiple violations of the FDCPA.

The threat to record (and it actually would be good to record the calls) as well as the stated intention to have your own attorney sue them is oftentimes enough to get scammers like this to stop calling you.

Bottom line - any company who refuses to give their name and physical address (not a PO Box), and who refuses to mail you documentation proving the debt is yours per the FDCPA - is out to scam you.

Thank you so much for the information.  They called again today, it was a different guy and I told him who I had talked to and what I requested.  I also told him what they sent me.  His exact words were "isn't demand for payment proof enough for you?"  I then told him that no, it wasn't enough and that I want proof and that I am entitled to that under the FDCPA.  He scoffed and said "Oh... You've been reading too much."

HIS EXACT WORDS.

Then told me if I didn't want to pay, fine, he would get in touch with his contacts here in my county and I would go before a judge.  Then hung up on me.

This is so ridiculously annoying!

If it's a scam, then they can't "come after you."  If you made payment through your bank account, file a dispute with your bank, otherwise, your money is gone.

What they sent is not proof that you owe a debt to them.  Demand a MAILED debt validation letter showing original creditor, amount owed, date of loan, date of last payment and if this company is legally entitled to claim and collect said debt in your state.  Also demand a copy of any contract you signed for this alleged debt.   Call the "supposed original creditor" and see what they say - many scammers will mail information claiming to be collecting on such and such a debt and when the consumer contacts the "original creditor" the account either never existed or was already paid off.  Get a company name and address - not a PO Box - so you can send a cease and desist letter via certified mail to them.  If they refuse to mail you the information legally required per the FDCPA, and will not give you their physical address - they are trying to scam you.

Failing to pay back a loan is definitely not a criminal matter, so there will be NO criminal charges.  They also don't get to say that you have to pay by the end of the day.  Sounds exactly like the cr*p scammers say to scare people into paying bogus debts.

Report the call to the FTC, the FBI and your state's Attorney General.  Advise the callers that you're recording all calls they make to you.

I received the same type of call this morning, stating that they were going to pursue civil and criminal charges against me.  I asked for written proof of debt (which legally I have a right to, before I pay any debt) and I received a letter via email that says ALMOST the same thing as I was told over the phone.  Basically, I can settle today with debit/credit card only. Also that the offer will expire if I don't pay the entire thing by today.  Funny thing, though... on the phone I SUPPOSEDLY owe a total of 650.00 and they would settle for 450.00 in one or 2 payments.  In the letter, the settlement is 650.00 and I have to pay it all today.  Also, the letter I was sent still does not PROVE that this is my debt.  It says the supposed original creditors name and "my" account #'s with them, but that is it.  Otherwise, it is a letter demanding I pay 650.00 today.  

I don't consider this proof of debt.  

Advice?!?!

These people are constantly calling and leaving a pre-recorded message from "Emily", when I return the call to get them to stop, the people become rude and refuse to do anything about the calls. I'm not entirely sure what they are trying to sell but they need to stop. My phone number is unlisted in the phonebook so however they got this number, they need to delete it. Besides, no one would give information over the phone to anyone, so these people aren't exactly the brightest crayons in the box.

I get the same thing. today they called my number 5 times. the last time they called they told me they found had found my son. Those papers are sealed. They told me he was on facebook, under the his given name.
they had no business doing that. Yea, the same lady s been calling me and claiming to be a lawyer.

It's a scammer.   You don't get a heads up before you're arrested, the cops just show up and arrest you.  Report the call to the FTC, the FBI and your state's Attorney General.  You could also call your local police station and file a complaint, although there is probably not much they can do except advise you not to return the call.  

If they call back, tell them you're recording all calls they make to you to give to your attorney for multiple violations of the FDCPA.

I received a call from Bill Brooks, he said he is an attorney and is calling to peruse criminal or civil actions against both me and my wife. He left this on my voice mail (pure fdcpa violation : disclosed personal information and  was not sure who's voicemail it was since our names are not present).

He also called and left a message saying he was calling from the law firm of CAR & Associates. (again they are not a law firm), just an old school collector trying to hit commissions by using scare tactics. Kind of silly when I think about this, I am a commercial / consumer collector and have been doing this for over 15 years. People I traced the company down and below are the phone numbers and address...

The people contacted my elderly uncle, as well as his ex wife (live in different cities) whom I haven't spoken to in well over 20 years and identified themselves as investigators.  They were rude to her and told my uncle in a separate call that if I didn't contact them by end of day that they would request a warrant be issued for my arrest in my jurisdiction.  I called back totally heated and nobody was there.  I received a call back today advising that this was in regards to a check that was written against my account back in 09/2009 that I didn't write.  He advised that a warrant had been issues for me 2 weeks ago but that he could put a stop to it if I paid him 200.00.  I called my county and spoke to the hot check division and they advised that this is a scam and that it should not be trusted.  They advised they would never call from an 800 number, it would be a DA office not some random company.  Also they advised that they would not ever hold me responsible, but they would hold the person that signed the check responsible.  The county attorneys office I called also advised that this company would have no way to issue a warrant for my arrest, it would come from the DA.  She ran me and said that I have no warrants and that it is a scam.  Typically they will never settle for less money than what is owed, (checks written for almost $800.00 and this man advised he could take my name off this for $200.00) that they would actually be adding fees and charges to a hot check that has a warrant and is valid.  Don't fall for these scum bags, they are fraudulent and are trying to extort money with scare tactics.

the same thing with me.  they leave messages at my job and cellphone.  i too had payday loans but they're paid up.  they do this around tax time.  i don't pick up the phone.  i write their number and come to this site to verify.  it's a scam

Every year about this time the same thing starts over. I get calls from people ( now it CAR and Associates saying my name and ss number are in jeopardy. or some such crap) I did at one time have a few payday loans which were paid in full over 5 year ago and they are still calling about these loans. I am so tired of these scam artist trying to get my hard earned money. Please can anyone stop this? I've even reported it to the BBB and my local state attorneys office.

These are low life bottom feeders who claim that you owe them money usually a payday loan or something. and they will try to extort money from you. I just tell them to contact my attorney and give them his number.  and when they become nasty i get nastier, and tell them to get a real job.

Same thing here calling my house multiple times a day. Askin for someone who doesn't live here at first now just leaving voicemails sayin car and associates concerning my name and social. They can't tell me my social and when I question this "Emily" she got very hateful and said see u in court. Come on ppl get a life!!! How can I make this stop?!!!?

I am reporting this call on behalf of my 91 year old mother, Rachel Thomas continues to receive calls from CAR Associates about calling problems with her name and Social Security Number.   They call her house continuously looking for a Donnell Thomas or some other person by another name.  My mother tells over and over that they have wrong number and that person does not or never lived there and she doesn't know who they are.   I called the 1-888-8760-6954 number on February 4, 2013 and asked that CAR Associates stop calling my mother.   The person was very nasty and told me they had no record of calling there.   I told her we have a recording from "Emily" who asked my mother to call 1-888-760-6954 about her name and Social Security Number.   Hopefully you can stop these people from calling and upsetting my 91 year old mother.
