Debt Collector
 These are scumbag collection agencies that often times (but not always) refer to themselves as 'Firms' to sound more legit and scare you into thinking they are some sort of law firm. Even if they are a legitimate collection agency, do not fall for their tactics. I shamefully admit that I briefly worked for one of these type companies a couple yrs ago so I know all the end and outs of their game.

  By law (see FDCPA) they are not allowed to threaten you with arrest or any type of legal action against you. Doing so comes with a fine of up to $1000 per offense. Often they will bend the law by 'insinuating' arrest or legal action without actually coming straight out and saying it, which can also be interpreted as a violation as well.

Tell them (dont ask them) that they need to send you a validation of debt in the mail. If they refuse then hang up. Furthermore, they are not going to have a process server come to your work or show up at your home either. They say that just to scare you into paying up.   Think about it for a moment, since when do real process servers call you on the phone ahead of time to tell you that youre being served?

Instead, next time they call do what I do and have a little fun with them. Call their bluff and listen to them get frustrated when they realize they cant fool you and that youre not buying into their lies.

In the end. what usually happens is that they'll call you a few more times and then your 'case' will get sold to another collection agency and theyll do the same thing all over again. The cycle may continue for awhile but it will eventually stop.

I got the same phone call yesterday he wanted to know if I'd be home tomorrow to serve me with papers that he had to witness, he called this morning and left a message that he will be over in a few hours to serve me and if I'm no home he will go to my work place to serve me. I haven't worked since 2008 and he even had my last four digits of my SS#. If he shows up I will not be opening my door.

Today May 2nd I got another message on my machine, and transcribed it.  There were a few red flags in it.

( 1 ) I am not employed, have not had a job since 2010. RED FLAG
( 2 ) Never ever ever does a delivery courier ever need to see 2 forms of valid ID.  RED FLAG
( 3 ) Never ever ever would a courier ever need a signature of work supervisor as witness. RED FLAG
( 4 ) She never gives the name of her company, nor her full name.  RED FLAG

"Hi, this message again is intended for ____(my name)____.

_____ , this is Carry/Karen (sp?) calling again in regards to the documents I've received with your name and social security number.  I've initiated a request for you to sign, for your intent to appear in regards to the claim being filed against you.  The call today is to make sure you did receive the information properly regarding the claim, and also to begin the stop order and also please confirm your scheduled date for service.

I'll be heading out to the residence tomorrow afternoon between the hours of 12 and 4.  And, if you are unavailable there, ______ , I will be heading out to your place of employment.  Please make sure you are available with 2 valid forms of ID for service purposes.  And also if you are at work, I will need a supervisor, to sign off as a witness.

If you have any questions contact the filing party directly at 1-888-803-7855.  You can reference case number A2171.  ________ , to just be clear, you are scheduled for service for tomorrow afternoon, unless I receive a stop order, I will be headed out to see you then."

I got a call on my answering machine.  I called "REVERSE LOOK-UP" and there is NOOOOO information for this number at all.  I deleted the call on my machine..

DO NOT CALL BACK.

( 1 ) Just FYI,  a real collection notice has to be done IN WRITING.

( 2 ) Consumers have rights.  Contact a CONSUMER LAWYER (Yellow Pages) to learn more.  It is an eye opener of good news!!

( 3 ) BE AWARE, protect yourself,  and use SAFETY FIRST.

( 4 ) If it's a real debt (and it's a lawyer, or even a "debt purchaser" type of company), they have to send you something in the mail.

( 5 ) The lawyer HAS TO BE BASED IN YOUR OWN STATE.  If the credit company is based in another state, and wants to use a lawyer, they HAVE TO USE A LAWYER IN YOUR STATE, in order to proceed legally, IN WRITING in 10 DAYS.  It's the law.

( 7 ) When you get something in the mail = that is what you respond back to, per the written instructions.

( 8 ) Lawyers have to be customer service minded.. THEY SHOULD NEVER EVER THREATEN.  They are performing a legal duty and are taught the proper etiquette, ("..this is an attempt to collect a debt"). THEY ARE LICENSED.

Take care.
P.S.  Thank you Alfalfa for the posting about the FTC!!

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.
