Per the FDCPA, debt collectors bear the burden of proving that you owe them money.  The calls people have received are from scammers - legitimate debt collection agencies will have no problem MAILING - do not accept email or fax - proof of debt and proof they can legally collect said debt.  If your caller refuses to mail this documentation, then, per federal law, he/she can go pound sand!

Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

? filed under: Press Release

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

Received the same call from Sara Marshall to call  855-847-8510 regarding charges that are pending and to be served that this was my only chance to resolve it.  Called the company, said was for a payday loan I refused to payback. Well they said was done on Dec 2012, however my account closed in July 2012. I tried asking for written documentation but the guy refused said it was too late and past the collection point, he refused to listen to me and just kept yelling and threatening someone to come to my work.   I have contacted the local AG office, FBI office, and the FDCPA.

Don't be intimidated, if you know you don't owe it, don't give them anything!!!!

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

I received a call from an unknown number at work from a lady named Marie Tanner. She said she had to serve me some papers regarding an allegation. She asked if I knew what it was regarding and since I didn't she told me to call a 855-948-2542. When I called the number no one answered and it said to leave a message. She then called me back about 45 mins later asking if I had a chance to speak with anyone because she was about to drive out here. I told her no and when I did I would call her back band she stated that she had no number and they would contact her once they had spoke with me. When I did talk to someone they said I had gotten a loan from Riverside Online Payday loan for $300 July 29, 2012 and that the could not get the money from my checking account. They wanted me to settle with them now for $357 or make payments and it would be $510.

I received the same call from an unlisted number. They also called where I work. I don't owe them any money. I paid off two loans last year. They wouldn't give me any contact info on Evergreen. They have a web site but it's set up so that you cannot contact them except to apply for a loan. This is a scam and it is egregious. I told them to please deliver my summons so that I can submit it to my attorney. They have not shown up.

Got a call from an unknown number didn't answer the phone the left a voicemail. The voice mail said they were going to file against me unless I called 18668205329. When I contacted them they said I owed this Evergreen/Riverside payday loan place $350.00 from a loan I apparently took out back in Oct 2012. The bank account I had back then is now closed. Mr. Davis said he had all the paperwork sitting in front of him where I authorized it and several attempts have been made to contact me via telephone and mail but he only had my physical address not my mailing address. I informed him I had my bank records and had just looked at them yesterday and there was no records of a deposit for $350. I told him send me some kind of verifcation that I agreed for them to put into my account, he said he worked for the debt collector and didn't have to send me anything. So i told him well how can I verify you are who you say you are. After arguing for a minute I ask to speak with his supervisor he said he did not have one then I told him fine you can speak with my lawyer and hung up. A few minutes later I received a call from a restricted number it was Mr. Davis calling back. I answered and asked him three times who am I speaking with before he told. I then hung up on him again. He called back again I didn't answer this time and he left a voicemail saying he was going to do me a favor and hold my file for 24hrs and I need to call him back. He also said he highly doubted I had a lawyer and if I did my lawyer needed to contact him. Once I got home I checked my bank records again and as I thought there was NO DEPOSIT.

My daughter called me today and said someone had called her and left a message on her cell phone about serving me court papers on Friday. I called the number and someone named Cory said I had a payday loan form 2010 for $669. He asked if I could settle the debt immediately. I told him no and so he asked if I could make payments. Lucky for me I didn't have my card at the time because I'm sure I would have given it to him. He stated he would call me the following day. After our conversation, I began to think about it. I did not recall ever having a payday loan with this company. I am so glad I have discovered this information. I can't wait t talk to him tomorrow!

This company called me at work at our legal dept. and said the same thing, that they were going to take me to court over a debt we didn't know anything about. They said they are with Evergreen/Riverside legal and that I owe a payday loan $510 from June of 2010. B***s***! Why can't we do something with these b*****ds? They had my address, SS#, previous place of employment, all kinds of info. We started doing more research and found that they are indeed a scam/phishing scheme! Regardless of what info they tell you that they have they are bogus! Do not give them any of your bank account information! They used the number 855-553-6339.

I also just received a call to my cell phone, work number and my in-laws residence stating that I had a legal case filed against me and they "didn't want to serve you at work" but must get these documents to me. So I called and the woman explained that  a payday loan from "June 2010" for $710 from a company called Evergreen and/or Riverside is taking legal action. However if I take "voluntary restitution" and make a payment with visa or mc, they will no longer take action. Are you kidding me? It's 2014, 4 years ago, and I've never heard a thing or received any bill, letter, etc... Until now? These people are a bunch of crooks! Do not fall for this scam! 1-888-823-0165 and number comes up as 'Unknown'! Any reputable law firm lists their phone number!

I received a call at work this morning from a woman named Sarah Marshal who claimed to be a "locator" and said that she had legal documents to serve me unless I called 8888230165. I called the number and was told that they were a mediator and trying to settle a debt without legal action. They wanted to receive payment today for a loan that I have no clue about. When I said that I would not make any payment or arrangement with them I was told that I would be served at work in 45 min to an hour. Nobody showed up. My brother called me at 4 pm, said that someone called looking for me and left the same number.
