Where do I report a debt collector for an alleged violation?
Report any problems you have with a debt collector to your state Attorney General?s office (www.naag.org) and the Federal Trade Commission (www.ftc.gov). Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General?s office can help you determine your rights under your state?s law.

Western NY Capitol might be going by the name Argos Alliance Group or AAG.  Please be aware of these people.   I received the same threatening phone calls.  They went through the whole summons with me as well.  I spoke to several lawyers who said correspondance validating the debt and them as a company should be done before making any payments.  When I called the collection agency that sold my account, they said they sold it to Western NY Capitol, but the company that was calling me was going by the name AAG.  I'm thinking FTC had something to do with Western NY Capitols mysterious disappearance :)  Good Job All!!

BTW:  the number that called from was 1-855-666-1469 (anybody see anything wrong in this number?)

These are illegal. They try to get information from people's family or friends by shaking them down, and using illegal "scare tactics".

They were reported to the FTC, the BBB, the state of Wisconsin, the local authorities and local news stations.

They will be shut down.

The call will start with a "process server" who will call trying to locate you.

DO NOT give them any personal information, inform them that legally they should be talking to the person the debt is for not to you. They will try to threaten you with the debt and that you will have to give a deposition in court against the debtor, but none of this will hold up. It may not even be true, they state that there was a loan received online and you may have been a "reference" that might've been bogus.

Do not provide these people with any information or call them back and state that if there is further communication it will be through authorities or through a lawyer.

You all file complaints with the NY Attorney General, FBI, FTC, BBB your state Attorney General etc.    The Chebat family has a history of getting their hands in the cookie jar.   Not only John Chebat who owns IAG International Asset group but also Western New York Capital  WNY  ...   Jimmy Chebat runs the Check Resolution in Kenmore NY.   They are the absolute of absolute bottom feeders.   There has been cases filed against IAG as well as Check resolution.

Check all states for court records and you will see for yourself.   By the way Jimmy Chebat so called moved form CA to NY.

Got a call from a Kyle Harris from BM services claiming to represent a legal company going after me for a cashnet loan.  Said I took it out in may of 2008.  I never did, they had all of my information down to banking info.  Have had to change banks, put notices through to the old bank about fraud on their part.  I even called cash net and have it in writing that I did not take out a loan.

New number they used... 800-704-6797 guess they changed their number

You must be dumb. Half these people are family members of people who didn't pay their bills or people who were victims of fraud.

If you look at the previous posts, WNYC was already reported numerous times. I believe someone even posted the name of the companies president. I think they're website has been shut down. Maybe they got too many complaints.

Just remember pay day loans are really terrible. Don't give into that area, because my family member decided to take one out, I am the one who had to suffer. And for the jaghole who says "why dont you just pay your bills?" guess what dude I DO, but I am the one who suffered for this. I have never taken out a payday loan in my life and these people are nuts, they called me at work they called my home accused my husband of being someone else. STAY AWAY FROM THEM AND REPORT THEM TO YOUR STATES' DESIGNATED DEPARTMENT OF TRADE/CONSUMERS WHICH IS UNDER YOUR STATES DEPARTMENT OF JUSTICE WEBSITE!

Dont give them any information!!!! You need to request validation of debt first. If the debt is valid, than you work out something.

But this company is very shady. They should not say you have been summoned to court, without sending you something in the mail. Its a legal threat that is not VALID. I suggest you read more about this company from prior people, and look up the laws in your state regarding this kind of matter.

I actually received a call from this company back in August maybe. Basically it was about a pay day loan. I didnt receive any threats as some of the people posted here, but they definitely were not friendly. They stated I owed $251.18 in a payday loan I took out. I told them I spoke to the PDL company already, and they brought it down to $75. Basically, since I wasn't going to pay the $251, they said it was a refusal on my part, and hung up. When I called back, they said they couldnt speak to me. Two months later, I get a notice from a collections agency saying I owe X amount of dollars for WNYC. Obviously, I protested and asked the collections company to validate the debt.

Curious to see what happens.

But has any one had any issues with this company recently?

Said that I was being summoned to court and that I should be available to sign paperwork in the next couple of days. They would have a rep in my area to get my signature. They used a friends name and said they would be summoned as well.I never received paperwork or any correspondence in regards to this matter, and they told me I was being sued for over 3000.00 and I could settle now by agreeing to pay 850.00 which they would only take by way of debit card. When he asked for my acct # I told him to send me some paperwork first that I didnt feel comfortable about giving my debit # and he hung up on me. I called back and asked for him by the name he gave me, and they hung up again. What can be done about this?

Telling me she would be serving me with a summons, tomorrow. Very rude, would not explain who she was or what she was calling about. Accused me of lying about my name. Hung up on me.

Debtors may owe money. Fortunately there are laws like the FDCPA that govern what a collector can and cannot say when they contact you.

For instance, failing to identify yourself as a debt collector, threatening legal action when legal action is either prohibited due to the type of debt, or without intention to pursue legal action, both are violations for which the collection agency can be fined for up to $1000.00 per offense.

Additionally, many states require that a collection agent be licensed within the state in order to contact someone residing within the state. They face far heftier fines for violating this.

A debtor may own money; that doesn't excuse the methods that these agencies use. It's akin to the mob sending people out to break kneecaps: It's in no way, shape, or form excusable.

You just happened to find this link in a Google search? You really expect someone to buy that? I know that when I go to Google I randomly click on links for reports of a scam artist collection agency that violates the FDCPA with every call.

An unknown number called my mom and sister, talking about needing to find them to sign a summons.

I called the number the "process server" left them and talked with some guy.  He said I was facing two criminal charges and they needed to send me a summons.  Having worked in the criminal justice system for many years, I told him he was full of crap and if they needed to have me subpoenaed for a criminal court hearing, it would be a deputy arresting me, not a private guy looking for me.  All of the sudden he starts saying, "Well, i didn't say that.  That's not what i said.  I was just saying it could happen."  Riiight.

Since that encounter, I read up on the laws and whatnot as far as debt collection goes.  I then filed a complaint to FTC and to my state's Attorney General's Office, although I doubt that will help.

This company called my uncle about my mother with very similar threats as have already been posted.  We've filed a complaint with the FTC.  The more people file complaints the more will be done about this.  It was really painless to file, all done online.  Go to ftc.gov and under "Consumer Protection" at the top click on "File a Complaint."  You put in as much info about the company as you have (name, number, address, etc.), your info...but you don't need to disclose anything about the actual debt or anything, and you type up your complaint.  Very easy, can probably be done in less than 5 minutes.

And so you know what laws they've broken so you can report them go to http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre18.shtm where you'll find a list of illegal practices.  I know I counted at least three that this company violated in our encounter.

I have to agree with lol... when you buy something or sign up for a service you expect to receive what you agreed to, just like the provider expects to get paid. If they have to resort to these extremes to get their money back from you that's no one's fault but you're own! Technically stiffing on a bill is stealing so if they stoop below the belt, an eye for an eye. And I don't work for them either - I don't even live in the US.

So does anyone get summoned eventually?  WNYC have been calling my relatives and threatening them.  I filed a complaint with FDC and asked me to contact my State Representative in Texas.  Believe me, I plan to.  I'm just wondering if they just threaten but never actually serve the papers?  According to FDC they have made four violations..including providing information to my relative.

I initially got a fax from these people to the attention of the person incharge of personel, on the fax they were requesting my ss#, phone #, address, my wages etc...luckily the person who got the fax from the fax machine gave it to me and I faxed it back to the fax number listed and asked not to request the information again.  The next day I got a call from Tom who claimed to be a process server and that he was on his way down to my town to serve me with a summons, he gave me (866)3437209 to call back and see if I could come with an agreement with the people that were sending me the papers, I asked him again where he was calling from and he kind of sturered and said well I'm calling from my car because I'm on my way to take the documents to you.  I called the Better Business Bureau and spoke to some one asking them what I could do, was it o.k. for them to do that? she faxed me a sample letter that I could send them asking to stop all contact at work, I faxed it to the same number where they sent me their fax from, I hope they got it, the only problem is that I need to figure out what their address is because I need to send a copy of the letter certified mail so I can have proof that I sent it.  I also filed a complaint with the Federal Trade Commission but I don't know how to follow up on it.

I see the slugs are out in force with the fake testimonials out of nowhere for their bosses.
They even went so far as to start their own report on one of their numbers that wasn't even looked up yet. Pretty funny.
Remember people, the FDCPA is your friend. And they can't STAND that you know that.

Recieved a phone message directed to me, my wife and my daughter stating his name as Mr. Wineberg and he was a procees server and that he was working on summons directed to all of us and my daughter as the primary defendant and that we need to contact 888-831-9692 and were given a file/case number.  He did not give who he was representing or who gave him whatever information he may have.  He also contacted and left the same message with both of my daughters.  Based on the phone number, I believe its the same place that has been noted in all the notations on this web-site.  I don't like being threatened by anyone.  We will be reporting this to our local police department and also the Federal Trade Commission.  To our knowledge there has been no documentation sent to anyone regarding a supposed debt.  Needless to say we will not be responding to these jerks or answering any calls that show as anonymous or private number.....From this end threatening, intimidating calls will not be tolerated and hope that our law enforcement and FTC handle these people swiftly and efficiently.
