I received a message from a lady named Marissa Miller who claimed she was with the Deposition Warrant Division. She called from a 706-391-8425 number. She was calling for someone that I used to be friends with who has apparently used my name as a reference on something. She told me that I had 24 hours to call back or a warrant would be put out. A few weeks ago I received a call from a lady claiming her name was Monica with Slay, Nebolsky, and Associates saying that my name was listed as 2nd on a complaint for depository check fraud with JP Morgan Chase Bank. (This is the same stuff that Marissa called me about today.)

You can't be arrested - "civilly" (really?) or "criminally" for failure to pay a debt.  Your caller has violated federal law (the FDCPA) by threatening you with arrest.  Please do report your caller to the FTC, FBI and your state's Attorney General.  per the FDCPA, you should NOT pay any caller who refuses to MAIL a debt validation letter showing that (1) you owe a debt and that (2) they have the legal right to collect said debt.  This applies for so-called "bad checks", as well as payday loans.  More info on this sort of scam here:

Extortion Scam Related to Delinquent Payday Loans

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

These people are NOT legitimate. After I was contacted by Melissa/Marissa Miller and informed that she was with the Deposition/Warrant Department I contacted the County Clerks office in Niagara County NY. They had no idea what I was talking about. I also talked to the local Sheriff, who informed me that this is a scam. They may take a very old legitimate debt, in my case a NSF check that had been written off 8 years prior and try to threaten you with jail time. Ms. Miller became combative with me when I asked for details of the debt and then told me that she was going to file for the warrant and that I should contact my local authorities to turn myself in. My family is in law enforcement, I knew this was bogus. The "attorney" that I was directed to contact gave me his name as Joe Cifa. He sated that he was an admitted attorney in NY. He provided his bar # as 135-35. The office of Court Administration has no record of him and the number is not a NY state bar registration number.

I received a call just like this today from a woman named Lisa Cummings. She too said that they had a warrant and that I had to call as well. They also said to be sure all weapons were locked away for their safety and that any children should have adult supervision. The leave no information other than that.

I received a call from Jennifer Brown who stated in her message to me that there was a Civil Warrant out for my arrest and that bad things were going to happen within 72 hours. I was given a docket No. but she did not tell me what this was for, the company she was calling on behalf for, nor the what the purpose for the phone call. I beleive she is from a debt collector but I do not know which one, nor do I know the agency she is calling from.

yesterday i got a call from a "restricted number" (didn't answer it), and a minute later from "blocked call" (didn't answer it either). had a message from melissa miller saying she had a warrant for me and they would be at my house or work. had me nervous when they said make sure no dogs or weapons to be at my residence? WTF? i called the number and spoke with her. obviously she is not in the state i live in by looking at telephone preference. she told me i would have to call a number and talk with the "attorney". that number was 888-866-2670. first person that answered just said hello. reallly? hmm. so i hung up and called back. this time a woman answered who mumbled the company name "Vantage Point legal processing". she transferred me to Joe after i gave her the docket number melissa referred  to in call. Joe said i had an outstanding bill with a company and my bank filled charges because of the check and i could only deal with him. he said it was too late to deal with anyone but him and i needed to call a lawyer. i asked him, if it was my bank then why wouldn't my bank tell me anything since i have banked with them for over 30 years? no answer. i called Clark Howard show for advice. yes it is a scam. i called the company they said i had issue with. they charged this off years ago and they don't do business with Vantage Point but referred me to the old company. was on hold forever but will try again today. by the way, Melissa Miller number is 855-843-8053. i have the feeling she may be working for Vantage.

They make statements like this because they're trying to scare people into paying debts they don't even owe, or if they DO owe, it's not to them.  NEVER pay any caller who refuses to MAIL proof that you owe a debt and proof that they have the legal right to collect said debt.  

Report your caller to the FTC, FBI, Dept of Justice and your state's Attorney General.

I also got a call from this same number. Just like the others, she stated that I had 24 to 48 hours to call them back or I, too, would have a deposition warrant issued. What is it with these people that they want to make statements like this? I don't get why someone would want a job like this.

I got a phone call stating there was a warrant for my arrest because of 2 bounced checks I apparently had 4 years ago. Ive had the same bank for 9 years and they have no record of this. I asked for proof of what I owe and would gladley pay it as I have NEVER been in trouble in my life and they hung up on me. How do we stop these threatening, against the law phone calls?
