Report the calls to the FTC, the FBI, Dept of Justice and your state's Attorney General.  If you can, get the company name and mailing address so you can send them a cease and desist letter - send the letter certified mail/signature/return receipt required so that they can't say they never received the letter.

Unfortunately, I doubt very much if they'll even give you their correct address, because they're nothing more than scammers.

As always - and as you have learned by doing your own due diligence - never pay any caller who refuses to mail proof that a debt is yours and that they have the legal right to collect said debt.  Per the FDCPA, callers who refuse to mail this proof are owed nothing.

As to their assertion that they'll stop calling once the debt is paid - again, nothing could be further from the truth.  Once scammers get you to pay a debt you don't even owe, they sell your info to other scammers who will call you on the same debt.

I got a call today from good ol Greg Zilch and he left me the same voicemail as he left you all. When I called back, they said my dad wrote a hot check and did I know how to get ahold of him. I obviously told them I did not and didn't confirm that he was my dad or i was his daughter. All you have to do nowadays is google someone's name and their relationships will come up. Great!

I got a call from this Greg Z as well this morning. Did my research and any debt I have had is well over 5 years old (the statue of limitations in my state is 5 years on a written document) so told the guy this wasn't my number and to take my name off the list. He then proceeded to call my aunt and tell her that they were going to file a criminal complaint against me (not criminal charges). All their debts are most likely past the statue of limitaions and legally by law you do not have to pay them (unless you take claim renewing the age of the debt).

Don't answer them.  If you do, by accident. give a fake name.  A lot of times they are trying to collect on debt that has already been written off and/or that statute of limitations is up on.  Don't ever acknowledge any debt you may have had in the past with them or anyone over the phone.  It kinda starts the whole process over again.  Feel free to f*** with these guys too.  It's a great stress reliever.  I like to act like a young kid or a person with a funny accent who can't understand English or just breath heavy on the phone.  Blowing a whistle in there ears also is fun & hurts their drums

I got a call and the guy stated I was being sued.  I told him I was working with a debt consolidation company and the amount had already been negotiated and I was paying it off.  He stated I was so stupid and that I was being sued.  He then threatened me with consequences such as jail time, loss of job.  I stated I was recording the conversation and I said to cease and desist.  He then started laughing at me.

Hi I too receive these calls.  For the people who are nervous. Don't be.  First even if the debt is yours they cannot arrest you, bench warrant, etc. payday loans are treated the same as credit card debt if you default.  More importantly these people are buying the debt for pennies on the dollar they are not going to waste there time trying to take you to court to get a garnishment. They would have to file in your county of residence and be licensed to collect in your state.  Plus check your states statute of limitations. The debt is probably not legally collectable.
As for how they got family information they probably subscribe to companies that keep databases on everyone ALL LEGAL that lists relatives, addresses, previous numbers, cell numbers, tax liens , any public record.
Have you ever wondered how collectors got your new cell or new non-published number?   Ever ordered pizza delivery. Bingo they all sell their daily sales data that list name, address, and caller id and number you give them. And you thought you were just ordering pizza.  Reward programs, grocery cards,  etc  You need to read fine print when accepting memberships.  These companies have tons of personal info you freely give out and then they sell to the national databases. For a nominal monthly fee collection companies subscribe to these databases  and that is how they know everything about you and your family.
So final point never talk to these vultures if you ever admit debt is yours they can re-age the debt which will make statute of limitations start over.  If you do speak to them because you get scared never admit debt. Just request that you need proof of debt in writing. Be careful how you request it so to not admit it is your debt. Just keep saying you dispute period.  Also never pay not even 1.00 for a letter that is their trick to re-age the debt.
Once statute of limitations is over you have NO LEGAL REQUIREMENT EVER TO PAY THE DEBT. Fight em hard. GOOD LUCK

got a call from Mr. Robinson, he would not verify any info. He wanted me to give it to him, of course I wouldn't and he became irate. Even suggested we get in a boxing ring. REALLY, first he insults and thens threatens me. Texas Attorney General will eat this company up in court.

I called back to ask for physicall address, Mr. Zilch quickly became defensive and said case was closed and hung up on me. Little does he know, this is just the beginning of them hearing from me. We should all call them every hour on the hour until they get the hint.

(I'm the same poster who wrote the message above) Just did a little research and am posting it here in case others find it reassuring, especially if, like me, these calls came out of nowhere and were a little unsettling...

In the interest of fining out a little more about our attackers, I googled "Davis and Cullen." Got nothing. Saw that other caller on this list had gotten a call from "Davis and Cohen". Googled "Law Office of Davis and Cohen". Got a hit.

Looked at their website, and noticed it looked pretty generic. Generic enough to be fishy-looking. Scanning the entire site, I found two phone numbers from two different area codes, one from DC and one from Georgia. Both, when dialed, yielded the same strange generic answering machine as the 888 number did. Hmmm....

Then, I did a google search for "Debt Collection Law Firm". My purpose was to compare this "Davis and Cohen" site with other websites of its kind. Not surprisingly, it was quite different.

When you look at Davis and Cohen's site, there are NO attorney bios, nothing stating where their lawyers are licensed to practice, and really nothing besides language designed to frighten scam victims. Whereas other websites discussed how they conducted their business, this site only lists what kinds of people they go after... More evidence that this is a fake...

While the fact that this is a scam reassures me that someone didn't steal my identity and write a bunch of checks, I'm still concerned as to how my information (and that of my relative's) got into these folks' hands. How are they cross referencing, I wonder...

Best of luck to everyone dealing with scammers. It's scary now.

Same as Cecilia above. These jerks called a relative about me, which frightened us both. There is no such debt, and I didn't know the phone number they used to contact my relative with. Scammers are commonplace these days, but these folks seem particularly aggressive and seem to have a strange collection of information to cross-reference. This call was from the same phone number as everyone else on here: 888-891-5197, but the caller (adult male, no discernible accent) identified themselves as The Law Office of Davis and Cullen. They said the call was in reference to a criminal complaint regarding check fraud, listed a docket number, and stated the last four of my social security number. As far as I understand, no legitimate law office would ever leave that kind of message on an answering machine, especially not that of a third party.

Received numerous phone calls from this man who states a family member wrote a bad check in 2008, and they will take legal action if nothing is done. I called them back and told them to take my family member to court. The guy became harrassing at that point. All I can say is challenge them if they challenge you!

Same thing, got a call threatening me with legal action.  Stated that I am to return the call if I want to avoid further legal action.  They state I have had check fraud.  I do not even write checks, they are so full of it.  They leave awful phone messages, very threatening.  They have called 3 times this week, and they have called my sister in another state looking for me.   I do not owe anything to a payday loan either, so I am not sure what the hell this is all about.
I ignore them and I've blocked a few numbers they call through, but it's not usually the same number twice.

Had a less than satisfactory conversation with these guys. The original voicemail was from Greg Zelch. When I called back, spoke with someone named Derrick Marshall. This was about a payday loan from DJR Group, which I paid off some time ago. I offered to send proof of payment but they weren't interested, threatened me claiming "the sherrif is coming to get you for a Class D felony". I passed this one on to my attorney. Outrageous and so illegal! I just wish we could do something to stop these jerks!

By the way, DJR Group is probably a scam themselves. They were paid off but I have continued to get phone calls from multiple collection agencies claiming that I still owe them money. Lesson learned? NEVER take out a payday loan. It just isn't worth it!

Just got a call and I will keep telling them someone answer from the "Fraud Unit"....lol.  You are the fraud unit with a "888" number they must think people are really stupid.  I usually call these people back for entertainment or to get a good laugh, but now I just tell them that they have the wrong number or I no longer work in that office and like the dummies they are they accept that answer and my calls have reduced DRAMATICALLY!!!!!!!!!

I got a call from my brother stating a call came from a greg zelch. Didn't leave a call back number, so my brother called back on the caller ID. The person said they were Loan Max, than gave out another number that was supposed to be a law office in Washington DC Call DAVIS AND COHEN. Said I got a loan online in 2008 and closed down a bank account right after I got the money and they wee going to file criminal chargers against me unless I pay the money back. When I ask what company it was from they said Quick payday loans Inc. so why is the number I called answered as loan max?...Never had a quick payday loan in 2008. Look up info about quick payday loans and 2007 they stop doing loans due to a lawsuit. Ask to see paperwork of when I open the loan up , what bank account  it was sent to and was told that they don't have any of that information . He will email me that info , so I got the email and all it said is that I owe 420 dollars..Its a scam!!!!

II received a call from this same number saying all the same things as the other people have stated. How do you make this stop, I have followed all the steps on reporting these frauds and it?s a new number calling a week later. I have paid off any payday debt that I had and have proof, these never match up with any of my banking records they are frauds, and they can never produce documentation proving what they are stating. I have been told if I want it to go away I just need to pay them and they will report it and the calls will stop, I highly debt it. I don?t even leave my ringers on anymore the calls are so bad and so often, they even call family member that I have not spoken to in over 20 years. The worst mistake I ever made was taking out a payday loan, not only did I pay double of what I barrowed back, I think I?m going to be harassed the rest of my life.

Started getting calls from this number two weeks ago. They call nearly every day. Usually I am working and unable to answer so they leave messages like, in order to avoid legal action you must call us back etc. One threatened me with criminal complaints and what not. Never heard of these people, call them back and the phone just rings.

Just got the same call from greg zelch.  He is so full of it.  Said there is a complaint, but will not give out any info.  If there was a complaint or fraud from my bank, I am pretty sure my bank would be getting a hold of me and not some scam artist. He wanted my info, told him if he knew so much he had it.  he got so mad at me and called me a few choice names---so very professional.  I have no loans and have not had any for over 10 years other than my house....stupid people

Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

I got the same jerk and I gave him some of his own medicine, I began calling him back, every 15 minutes and asking what his real name was and what his real business name was. I also told him that I wasn't the party they were looking for and was told my number was the contact and I either had to get them the party or they would keep calling me. That's when I decided to start calling them. They finally got tired and removed my number from their database and that altered the call forwarding to the actual law firm. I don't expect this will stop them. Keep in mind that each state has their own statute of limitations for payday loans and they are banking on you not knowing that. If you make any negotiations with them that restarts the time clock. I knew this and called them on it, they denied it was past but I knew better.

Repeated calls about a family member on a payday loan that was from 2008 in Texas. Used the same name of Greg Zelch. Threatened with court case, wouldn't give name of business at first and said they got my number off their tax return last year which was a lie. I called them back enough that apparently the skip tracer pulled my number from their system and I talked to a Thomas at the law office of Davis and Cohen.
