Debt is civil, not criminal, so you're not going to jail.  These callers are scammers - they've refused to mail you proof that the debt is yours and that they are legally able to collect said debt - which means, per the FDCPA, you owe them NOTHING.  Plus, no one calls to give you a heads up that you'll be served - this is yet another threat (and violation of the FDCPA) in order to scare people into paying money they don't even owe.

Colonial Asset Management has been sued multiple times in federal court for violations of the Fair Debt Collection Practices Act.  One plaintiff successfully subpoenaed the UPS Store where the "company" (which apparently is not incorporated) maintains its address.  It turns out the mailbox address is registered to Jason Zandstra of Norco, CA.  The plaintiff believes that Mr. Zandstra is the "brains" behind this operation.

The case is Tiggs v. Colonial Asset Management, 13-cv-50111 (W.D. Ill. 2013).

Hope this helps.

I was called originally in July by this same company, but the number was 1-855-319-9729. They called me at home originally, and when I called back I was on my cellphone, so they then started harassing me on my cellphone. They told me then I owed $1600  on a credit card that I never had, and when I asked for written proof, the gentleman told me he had already sent written proof in June. This was a lie, of course. He told me I would be served papers at work, and I told him that was harassment. He then told me I was harassing him. They have since used the courier scam, and I was told to call Curtis Pierce at the aforementioned number, and he gave me his extension, which is 403. He, too, sent me an email about a payoff. I am not concerned, however, at the possibility of them sending out a warrant for my arrest if there is a court date, and I am detained because I do not appear because I don't know the court date as several others have claimed have happened to them.

I have not heard from them since that day he hung up on me.  No phone calls, no sheriff knocking on my door serving me with papers.  I contacted a lawyer, and he pretty much told me that its bogus and that its a scare tactic on their part to get me to pay something.  I am curious as well to know if anyone has actually been served by them????

So a few weeks ago I recived a phone call from a 888-960-6294 that said I needed to call Colonial Management Legal Dept to set up a time to be served a summons to court.  I called the number, and the man I spoke to was very rude, and asked me "Why haven't you been served?"  I told him you are asking the wrong person.  I told him I wanted to see something with my signature or proof of the debt, and he told me that he wont do that, and emailed me a "settlement".  The settlement email looked quite fishy, no letterhead, just a list of amounts and what I needed to pay.  I called him back today and told him I wanted something more detailed, and he said "I understand, we will be moving forward with the lawsuit".  They even called me job looking for me and told my boss they needed to serve me papers.  Is that even legal to disclose something like that to whoever answers the phone?  When I told the guy I wanted to see something with more details about this account, he said he cant do that and hung up on me.

After telling them you contacted your lawyer, did they ever call you back?  I did the same thing, I requested a letter and it does not look legit.  It took him 3 days to send it to me.

For three days in a row i recieved a call from a so-called legal courier claiming he wanted to set up a time to serve me legal documents. When I asked him what this was about he gave me the number 877-957-5025. When I call that number I got the name of a company called the Bristol group who was very threatening and disrespectful to me on the phone. I was accused of taking out a loan I did not and was told I'm better just to wait for court. I'll call back later to get the information about the company they seemed like they didn't want to give me that information. I have Google Talk the number and the company and can't find any information. I have to contact this number to a different number because as soon as you call the person answering is trying to look you up from the number you're calling from.

I left a message with My phone number and file number And never received a call back. When I first spoke to the courier he said he try to contact me an address I haven't lived at in 12 years and another address I haven't lived at three years he said he could not take any information from me and I had to called colonial asset management. I found it real odd that  the courier could not get my current address from me does not make any sense

File a complaint with the FTC. The local police will not do anything unless you've given them money. These people harassed me over a non-existent debt for almost a year on a daily basis. They're being investigated, and after the migraines they've caused me I hope they're caught. You can file a complaint with the FTC online, record or write down every bit of info they give you. Any names, any numbers used, address, email, dates/ times they call, etc.
Everyone file a complaint.

They called me tonight.  Were verbally out of control. He called me a lowlife and trash and told me I didn't deserve to be an american.  When I asked to speak to his boss he told me he was the boss. When I insisted he would go fine and make a fake clicking noise and say yes I am the boss. He ccolondid this a few times.  He made fun of me because I don't have an american express card.  He asked me if I was drunk on drugs or psycho because I asked for proof that his company is legit.  I asked for a phone number that this debt originated from and he told me he didn't have one. I asked to speak to another representitive in his company and he told me I didn't need to because they were all puppets on his string.   The scary part was he had loads of information on me but got mad at me when I wouldn't confirm anything.  He told me I was a dirt bag for other debts but I have payment arrangements and am chipping away at those debts. I just don't like how he had my social, he told it to me, my date of birth, my name and any debts I owed

How do I get them to stop calling my sister who lives in another state? I called the number and let him talk and when I told him I goodled the number and found it was a scam, he quickly said he would send me the documentation for the debt. I have never heard of being warned about being served. And if I owe them $400 why would I pay $700 the day I talked to them??? I told my sister to tell them to stop calling her, I even told them to stop calling her, they have my number but refuse to call me. My step dad called the number and they gave him the same story they gave me, what legit debtor would do that???

They are a scam and I have never had any credit card from Bank of Marin!!!! I dont know how these people can even sleep at night...why are they willing to even work for such a place that tries to consume people with fear...I feel bad for the people who actually pay them a settlement!!! So last week, two days in a row I received a call from these people on my cell phone asking for my mother. I told them that this was my personal cell phone and not a number to reach her. The second day they called I told them that they had already called me the day before! They do call from a private number which makes me not want to answer any private number calls. I had passed the info along to my mother so that they would stop calling me. She did call them and asked for them to stop calling me but the man was very rude and said the calls would not stop. And he tried to say he did not know if she was the real person they were looking to speak with because they claimed they had already spoken with someone clamining to be her. Huh? Really? Not they are calling my Grandmother on my dads side to get in touch with my mother. They have no contact! I just want them to stop calling my grandmother and me. I am thinking of sending a cease and desist letter. And no summons has been sent as stated by them.

FYI, here we are a week later and still not "served" with any papers. I doubt I will, but if I do get any official papers either served or mailed I will post a follow-up here. No follow-up means no further communications with this outfit.

These people are calling my previous place of employment claiming there is a summoms against me. They have also been calling my personal cellphone claiming the same. I have no legal actions against me. I have forwarded them to my lawyer who is inquiring about the validity of such claim. No response has been given. Please do not give these people any personal information. They are trying to collect on debt that has been written off and is not in existance. They must be reported.

They called me and interupted my work asking if my stepson would be at my location in two hours to be served with papers. When I asked where the papers were to be served, the guy in the phone played stupid, and couldnt even tell me who he had called. How did he even get my number? Unfortunately I passed the 1-888-960 6292 and case # to my stepson to call, but he had the smarts to not give his SS# when they requested it. I strongly advised him to givr the info to the local PD believing it is a scam.

Update to my post yesterday. Not only did I NOT receive the summons as promised yesterday, they called again today, almost to the hour as yesterday, to offer me another opportunity to make arrangements before releasing the courier service to serve my summons. Don't know what they think may have changed with my situation since yesterday.

Same as before, If I do get anything I will come back and post it here for everyone's information.

Be Careful and God Bless!

just happened to me today. received a call from an unknown # for court summons.
had my DH call 18889606292. don't know what info my DH gave, but later upon request we got an email with this info

COLONIAL ASSET MANAGEMENT
12523 Limonite Avenue Suite #440-395

Ph 888-959-1534    Fax 951-520-0118

person working his file was at this #. 951-268-1416

After research I told him we will be talking to our lawyer.

link for state of limitations.
http://www.creditcards.com/credit-card-news/c ... ations-1282.php

following is copied from a website.

"Debt collectors do not want you to know this, but sometimes a debt is just too old to collect. All states have ?Statutes of Limitation? that prevent a creditor from enforcing a debt, if the creditor does not file suit within a certain period of time. In other words, if a creditor waits too long to sue you, it is simply out of luck.

Quick Point: The Statute of Limitations is an ?affirmative defense?, meaning that if the creditor sues you, you must raise this defense in your answer to the lawsuit. If you do not respond to the lawsuit and raise your Statute of Limitations defense in your answer, you could end up with a judgment against you, even though the debt is beyond the Statute.

Using the Statute to stop vulture debt collectors

What should you do if a debt collector tries to collect on a debt after the Statute of Limitations has run out?  Simply, tell the debt collector in writing that the Statute of Limitations has run out on the debt and instruct the collector not to contact you again. Because they count on debtors not knowing their rights, it is usually enough to let collection agencies know that you are aware that the Statute of Limitations has run out.  They will generally move on to another victim.  However, do not admit to owing the debt, make a payment, or agree to make a payment.  If you do, you may compromise your Statute of Limitations defense."

Same phone call same deal as everyone else, only they identified themselves as "Courier Services". Its funny that they already have a courier set to deliver a summons to me today, yet needed my address to mail me something else. Since its the same as my physical address you would think they would already have that information. Regardless, I do owe debts, all combined totaling less that $10,000. I do not deny owing them and never will deny it. Can't pay them, unemployed and trying to live on my VA Disability and what odd jobs I pick up in the neighborhood. They will just have to serve me; supposedly today. No wages to garnish, no property left to seize; besides that, in the State of Texas wages can only be garnished for Child Support, Taxes, and Federal Government debts and in rare cases student loans.(I am not a lawyer so take that at face value as information given to me by my previous employer's legal dept. before the big layoff) Since I do owe debts I get missed calls and voice-mail all the time and frequent this site to check validity. If I do happen to be served or anything else, I will post it here. Today is 28 Jan 2013. If you don't see a post after this, that means I am still waiting....

Word to the wise, if you do get a call, just wait for the summons and don't worry about it until you get one. If you are worried about not getting a summons, just call the county clerk's office and ask if there is an outstanding one, they will tell you (This is for Texas). If you do get a summons, appear as specified. Not appearing automatically gets a guilty plea on your favor then they can process further without you. Furthermore, in the State of Texas, all legit papers must be served by a county Sheriff's Deputy (in official uniform), County Constable (in official uniform), or State of Texas Licensed Probate courier, and they must show you State identification with the seal of Texas embossed and their full name and license number prior to attempting to serve. If they don't they are not legit, if they are not legit - DO NOT GIVE THEM A SIGNATURE, that only gives scammers a means to perpetrate additional fraud measures against you, (they already have your phone number and physical address, giving them a valid signature will complete their means of creating computer generated checks and forging your signature to them- before anyone knows whats going on they have already signed thousands of dollars in checks with your name, address, phone number, drivers license number (which is public data in most states, check publicdata.com to verify), and to top it all off, an exact signature that will be the burden for you to have to prove in court.

Again, after all my rambling, if you do not see a post from me after this one, that means I am still waiting on my summons.

Everyone be careful and God Bless!

Just received a call a few hours ago from a "No Caller ID" on my cell ( wanting to contact my son !! )
He gave me a Case # and the same 888 number to call, saying it was a "Court Summons" and that
my son needed to call that number A.S.A.P. and verify info so a courier could bring legal documents
to his house ( which is another state than I live in.)  He said that if that number wasn't contacted then
the court proceedings would go on without him !! I was taking notes on the info this guy was giving me,
so at the end of the conversation I asked for his name. Of course he came up with "John", then all of
the sudden the phone went dead. ~ He hung up !!
