Las Vegas, NV - In an enforcement action brought against Western Sky Financial, LLC, the Nevada Financial Institutions Division has issued a Consent Order permanently barring the internet lender from originating loans in Nevada.

The Division also found that loans made without a Nevada license were unenforceable and fined the company $50,000 in administrative penalties.

An investigation by the Financial Institutions Division was launched after an annual examination of licensee CashCall, Inc. revealed that some loans serviced by CashCall were originated by Western Sky Financial, LLC.

The investigation found that Western Sky Financial, LLC solicited and made loans to Nevada residents without a license.

On June 28, 2013, the Division issued a Cease and Desist Order against Western Sky Financial, LLC prohibiting the company from conducting the business of lending without a license pursuant to NRS Chapters 675 and 604A.

As result of an administrative hearing requested by Western Sky Financial in response to the order to cease unlicensed activity, the parties agreed to a Consent Order approved by the hearing officer which requires that:

? The Cease and Desist Order shall be permanent and remain in full force and effect.
? The assessed $50,000 administrative fine is due within 30 days of the approved Consent Order.
? Loans made to Nevada residents by Western Sky Financial, LLC cannot be enforced, validated, or collected through any equitable or legal causes of action in a Nevada or federal court.

CFPB Sues CashCall for Illegal Online Loan Servicing
Bureau?s First Online Lending Action Seeks Refund of Illegally Collected Money

WASHINGTON, D.C. ? Today the Consumer Financial Protection Bureau (CFPB) took its first action against an online loan servicer, CashCall Inc., its owner, its subsidiary, and its affiliate, for collecting money consumers did not owe. The CFPB alleges that the defendants engaged in unfair, deceptive, and abusive practices, including illegally debiting consumer checking accounts for loans that were void.

?Today we are taking action against CashCall for collecting money it had no right to take from consumers,? said CFPB Director Richard Cordray. ?Online lending is rapidly growing and deserves ample regulatory attention. The Consumer Financial Protection Bureau will take action against online lenders and servicers that engage in unfair, deceptive, or abusive practices.?

California-based CashCall, its subsidiary, WS Funding LLC, and its affiliate, Delbert Services Corporation, a Nevada collection agency, are all under the common ownership of J. Paul Reddam. The Bureau?s investigation discovered that beginning in late 2009, CashCall and WS Funding entered into an arrangement with Western Sky Financial, a South Dakota-based online lender. Western Sky Financial asserted state laws did not apply to its business because it was based on an Indian reservation and owned by a member of the Cheyenne River Sioux Tribe. But this relationship with a tribe does not exempt Western Sky from having to comply with state laws when it makes loans over the Internet to consumers in various states.

The loans ranged from $850 to $10,000, and typically had upfront fees, lengthy repayment terms, and annual interest rates from nearly 90 percent to 343 percent. Many consumers signed loan agreements permitting loan payments to be debited directly from their bank accounts, similar to a payday lender. The loans were then acquired by WS Funding and serviced by CashCall.

In September 2013, Western Sky stopped making loans and began to shut down its business after several states began investigations and court actions. But CashCall and its collection agency, Delbert, have continued to take monthly installment payments from consumers? bank accounts or have otherwise sought to collect money from borrowers.

The CFPB?s complaint alleges that defendants CashCall, WS Funding, Delbert, and Reddam have violated the Consumer Financial Protection Act?s prohibitions on unfair, deceptive, and abusive acts and practices. The Bureau?s investigation showed that the high-cost loans violated either licensing requirements or interest-rate caps ? or both ? in at least eight states: Arizona, Arkansas, Colorado, Indiana, Massachusetts, New Hampshire, New York, and North Carolina. Under statutes in at least these eight states, any obligation to pay such loans was rendered void or otherwise nullified in whole or in part by law. Therefore, the defendants are collecting money that consumers do not owe.

Under the Dodd-Frank Wall Street Reform and Consumer Protection Act, the CFPB has the authority to take action against institutions engaging in unfair, deceptive, or abusive practices. To that end, the Bureau seeks:

?Monetary relief, damages, and civil penalties: The CFPB wants CashCall to refund consumers the money that they took from them where the loans were void or the consumer?s obligation was otherwise nullified. The Bureau?s complaint also seeks additional damages and civil penalties.
?No further violations of federal consumer laws: The Bureau wants the defendants to adhere to all federal consumer financial protection laws, including prohibitions on unfair, deceptive, and abusive acts and practices.
This is the first CFPB online lending lawsuit. The Bureau has jurisdiction over a broad array of companies, including online lenders, loan servicers, and debt collectors. This lawsuit is a significant step in the Bureau?s efforts to address regulatory-evasion schemes that are increasingly becoming a feature of the online small-dollar and payday lending industry. In filing this suit today, the Bureau has worked closely and collaboratively with state attorneys general and banking regulators. Some of these state officials are also filing their own lawsuits and announcing formal investigations today; others are already in litigation.

Unscrupulous business that are in the business of collections.    I had set up a 7 month payment plan in 2013 which had been paid off this past month. Well needless to say when I received a call  from them TODAY I became quite livid.  They so- called representative claimed that I am a part of an 8 month plan and that I had ONE MORE PAYMENT!!!.    THEY ARE LIARS!!!  I have asked for them to send the so-called original documentation (unadulterated) that states that.    I still don't have it. But good news is I have located my copy from 2013 and it states my 7 month arrangement payment plan!!!!!   AT all cost avoid them if you can.  My job furloughed to subsequent lay off is the only reason I went that route at the time to stay off the street-perhaps maybe I should have taken my chances!!!!

EVERYONE IN FLORIDA who has a loan with Western Sky/Cashcall/Delbert. Please file a complaint with Attorney Gerenal Pam Bondi's Office. The more people who do this can help shut down these Predatory lenders. I did this by email. I did take off the name and address of the person I mailed all my paperwork to. I'm sure the same person will not be handling every complaint.They do get back to you pretty quick. Here is the email I recieved:

I was approved at Western Sky for small personal loan on Dec 12,2012 for
2600.00. Before I made the first payment I received information Cashcall was
recently assigned my loan. At that point Cashcall began to withdrawal money
from my checking account. Starting on 01/01/2013 $185.25 the next 7 payments
that were withdrawal 292.50 totaling 2234.75 with only 19.35 going to the
principle. The interest rate on the loan 139.13% Then on Sept.03, 2013 the
state of New York Attorney General sued Western Sky, Cashcall and Martin Webb.
They violated a state imposed cap on interest rates change to consumers. Loans
sold illegally outside of the tribal boundories. I begin to check into my loan
with them to see if it was even legal. After reading many blogs one stood out
to me saying You should look at all e-mails from Western Sky. Subject was
always about the Western Sky loan but sure enough the person sending me the
emails was from Cashcall. After the news broke that Western Sky was being sued
I went to sign on to the Cashcall web site to view my account and it said
account doesn't exist @Cashcall. I then received a email from Delbert Services
on 08/21/2013 saying that my loan was transfer to them and I need to sign new
paper work. As of this time I have not signed anything from Delbert or allow
them to withdraw money. I went on the Florida Office of Financial Regulation to
see it they have a license in Florida. I could not find one for Western Sky.
Delbert and Cashcall did have a license but it appears that the address have
been the same at one point for time. I believe Western Sky is actually a front
company for Cashcall. You think you're dealing with Western Sky on an Indian
Reservation, but reality is the entire process from orgination to underwriting
to servicing is handle by Cashcall.(None of the activity happens on the
reservation,it all happens in California.) Cashcall used Western Sky as a
facade to fraudulently give the loans the appearance to consumers that they are
subject to tribal law not state law and therefore not subject to state interest

Have a loan with them which   I'm current on my payments. The now call my number asking for a Dewana Washington. I told them wrong number and they told me I was wrong? Delbert Collections will call from a different number all over the United States seven days a week.
Don't ever borrow money from these people as they will do their best to drive you crazy. I got behind in my payments and they lowered my interest rate from 135% to 84% which I am very grateful for of course I do still owe more than I borrowed.  My loan is scheduled to pay off in 1/1/2018 and the total I will pay is $6,811.92 approx. for a $2500.00 loan.

The only way to get these loans is to have monthly payments automatically taken from your account, so they get their money every month when they are supposed to and they are calling at least 7 times a day for absolutely no legitimate reason.

I'm with you on this. WS had sold my loan and now what I thought was, isn't. My loan was for $300 and I'm now being billed over $800. Even though they have been taking $150 out if my checking account for the last 4 months. When I finally spoke to someone and asked how many mor payments I had, the response was "Oh about 15-20 more." Call me crazy but that doesn't that equal over $2,000 for a $300 loan??!!!

it is delbert services they are affiliated with western sky.  what they are doing is illegal in kentucky they are an online loan provider if you do have them and want them to stop call the dept of financial institution at (for ky that is) 1-800-223-2579 all online cash loans are ILLEGAL in the state of KY. working with them now to stop this harassment

Any luck with the AG's office re:  Delbert Services.  These loans normally originate with Western Sky, then sold to Cash Call and then Delbert Services.  I want to check the usary laws re: interest rates.  I did talk to them directly and had my number deleted from their phone rotor.  Don't know how long this will do any good.  Found out today that what I was originally told from WS is not what is happening.  If you hear anything else, please let me know and I will you as well.  You can email me at davideve11@yahoo.com.  Thank you.

I got a call from them when I started yelling at the guy he says to me "you can't talk to me like that " and I said to him "you called me so I can talk to you anyway I want!"  he still call back the next day.  I guess they're looking for someone who used to own this phone number.  so now when I get a call I just say "hold on please" , put the phone down and watch tv just to see how long I'll stay online.

This company bought out or somehow got a hold of the Western Sky loan I got in December of 2011. The loan went from Western Sky to Cash Call to Delbert Services. As another poster had said, my loan is in good standing as it is drawn out of my checking account each month. After they took over this loan I received an email telling me I needed to update my records on their site. Sorry but by the time that email arrived they had already drawn two payments from my account. I get a minimum of six calls a day from this number, never leaving a message. This number will be blocked from here on out.

This is Delbert Services.  They have bought "CashCall" loan accounts. I am not behind on my account nor have I missed a payment as CONFIRMED by this company today. They first told me I doubt it's auto dialing you 6-12 times a day & I doubt that no one is on the other end. I offered to send them my phone records but they refused to look @ them.  Getting involved in these high interest loans that prey on desperate people was the worst thing I could have EVER done in my life. I make these outrageous payments but the overall amount NEVER goes down. Never will win on them. If you are thinking of doing this DON'T it will fix ur problems for a month but will ruin the next 5+ yrs of your life.

I informed the company if they keep calling & not speaking I will close my bank account & see them in court.  Seriously folks never have missed a payment as confirmed by this company. They do not know why it keeps calling me. Great first impression of DELBERT SERVICES.

The phone calls I get are from 1-888-983-3523. They never leave a message and call me 4-5 times a day and leave voice-mails with no information saying nothing (normally I here people talking in the background or a fax machine) about 2-3 times a day. I want the calls to stop, this is harassment. I'm going to be talking with the Federal Trade Commission about different things I can do and possibly an attorney, if I choose to file a lawsuit. Leaving a voice-mail with no message is illegal for any business to do.

I won't just block this number because it won't change anything. Lets all be smart about this, learn our rights, and ways we can take action.
