I have been called both at my home and on my cell phone saying i have a debt to a carpet company and I have not ever bought carpet that has not been paid for! How do i get the calls to stop?

This is CRS.  They just called me regarding a debt for which the statute of limitations has passed.  After I hung up they immediately called me at work yelling at me to pay up.  I just spoke to the RCMP who will follow up with them.  I suggest you all do the same if they are harassing you.  These are the same people who pretend to be from Canada Post to get your address.

I received a call from this number today. I do no answer calls from numbers that I don't recognize, so it went to voicemail. The person did actually leave a message, stating that I was to call her back immediately, and left a different number than she had called from. Having been (currently am) a victim of the recent HRSDC student privacy breach, I am even more reluctant than ever to give ANY personal information. I did not (and will not) phone them back. I have no outstanding debt, and my credit is fine as I've recently been approved for a credit card and car loan. 


Some tips for people who have outstanding debt or are receiving calls:


1. Do NOT accept that the debt is yours. IF YOU acknowledge the debt as yours, it "resets the clock" on your statute of time, and they are within their rights to take legal action again (sue you).


2. Do NOT give any personal information, including address, date of birth, where you currently reside or work, etc


3. It is NOT your responsibility to prove that the debt is yours. Remember- the ownus is on them to prove that it is your debt. 


What they are legally NOT allowed to do (this may vary from province to province, and this is the research I have done- please do your own reasearch as I am not a legal council.... I live in Ontario):


1. They can NOT contact you except between 7am-9pm Monday - Saturday, and between 1pm-5pm on Sunday.


2. They are not allowed to call more than 3 times per week, if they have MADE CONTACT. Making contact includes speaking with you (or a member of the household), and/or leaving a voicemail. (This is why they often don't leave messages- so they can keep calling legally).


3. There is a statute on how long they can take legal action (sue you). Unfortunately, they are within their rights to keep seeking payment if payment has not been made or the debt is outstanding (forever).The bar only means that they can sue you after a certain amount of time- not that they can't keep trying to recover the debt. 


4. They are required by law to contact you via written mail PRIOR to calling you. Be aware though: they may have an old address, so they may have done so. Ask them why they have not contacted you via mail before calling. 


5. They cannot use profane, inappropriate, or abusive language, nor threaten. They cannot threaten to take legal action, garnish wages, or sue you if they are outside the legal parameters to do so (ie outside the statute). 


How to deal with them/ get them to stop calling:


1. If the debt is not yours (they're asking for someone you don't know), tell them so and advise them that they are not to contact any of your phone numbers or spouse's numbers again. Explain to them that if they do contact you again, you will seek legal action. Then, contact the BBB if they phone again. If they continue to call (which they likely won't), get a drawn letter from a lawyer. Yes, you'd have to pay for it, but that would be a choice you'd have to make if you want the calls to stop.


2. If the debt is indeed in your name, but you believe it has already been paid, is not outstanding, or is beyond the statute, you have a few options:


A) Ignore/block the calls. 


B) if you choose to answer, tell them that you do not assume the debt.


C) Tell them that you do not want them to contact you via telephone again. IT IS YOUR RIGHT to not be phoned in any manner- cell, home, work, spouse, neighbours or family. Tell them that if they continue to call after the current conversation, you will seek legal action. 


D) If they are intent that the debt is yours, ask them for documental proof (specifically, a copy of the original contract if the credit card, etc). Chances are, they do NOT have this. As someone else posted on this forum. If they cannot produce a copy of the original document, how can they state that you owe anything? MOST IMPORTANTLY, if they state they can (which is extremely unlikely, especially if the debt is old, as most people on here mentioned), still be sure to state that you want no further contact via telephone, and that they are to MAIL the information to you. If they ask for your address, tell them that the responsibility is on them. Make them do the work! Don't make their job easy for them. 


E) If they refuse, tell them that you insist that the debt is not yours, and that they are to desist from all further contact with you or you will peruse legal action immediately.


I hope this is helpful. If nothing else, DON'T panic. Keep calm- they're just trying to suck money out of people- that's their job. Don't loose sleep.

My office is being harassed by calls from 1-902-442-8588 - We have asked and asked them to stop calling.  But they continue to do so.  This is even the same woman.  They call regularly and the last time I hung up on her.   Still another call came.  What do they not understand about stop calling here.

i hope your from crs, or at least one of the collection agencys.  because thanks to this site, ppl know what you can and can't do.  one is harassing ppl for a debt thats expired. oh ya, you can call, you can send letters, u can ASK all you want.  go waste your time, waste the company's time, u may hit the one odd duck that doesn't know any better that sends you a check, but you'll never scare me into sending you a dime, because i don't owe you anything.

couldn't even make out who the company was he was representing. thick accent. 902 area code is used by pei and nova scotia. he repeated himself several times but didn't talk clear enuf to make anything out...gave a reference #. but i honestly have no outstanding debt.  unless it's from something that was missed 10 years ago when the debts were supposed to be taken care of through the lawers. and that's no longer my issue. the statute here is 6 (varies province to province). i learned they can still ask for the money but your not obligated after the statue runs out to pay it.

my dh literally just got out of hospital (years ago when i did owe money cause he was off work with his heart conditon) when one of them called and demanded to speak with her. i calmly explained that he was just relased from hospital and couldn't take the call right now.  she raised her voice. PUT HIM ON THE PHONE NOW~.i got really rattled, i said look he just had heart surgury and is recovering..she threatened to call back every 15 mins.  at the time, u could pull call trace on the phone, which i did. but she never called back so i didn't have to go through the police.

we don't either have any outstanding debt and this one agency keeps calling.  but something else weird going on at the same time. when my hubby went to get his police record check for volunteering, there was another guy using my husbands name, place of birth etc. so you might want to get a records check as well as a credit check done and make sure somebuddy isn't out there messing you up.  when we get a chance we are going into equifax and transunion and putting a note on our account that we don't have any outstanding accounts and maybe mention that there was an identity theft issue and give them the police station where they can verify. i get so ticked with these calls.

My husband recieved a call from them just now over a debt from Canadian tire credit card. What I don't understand is how they got his number when the phone is registered in my name. The debt was settled more then 5 years ago so it's obviously just a scam.

Stupid collection company is hiring 'stay at home' losers to use their home phones to make collection calls.  Fortunately my phone blocks all phone numbers except my personal contact list.  This jerk collection company has hundreds of jerks around Canada in their employ, working from their homes, and stupidly enough using their home phone numbers to make these attempted collection calls.  Why they would sacrifice their home phone numbers to engage in this bottom feeder employment shows the signs of desperation that such callers have sunk to.   It makes me feel like a million bucks compared to these low lifes.  Do a Google look up on this phone number and you will find the stupid woman's number mixed in with all the phone identity results.  Dumb dumb dumb...  I hope she turns her home phone off at night... ;)

They are or the person calling is "Lisa" from some place called Credit Resources Services (CRS) which is a 3rd party debt collector.  However the debt they are trying to collect has been stricken off by the original company, mostly Credit Card Companies.  You are under no obligation to acknowledge or accept the debt or tell them anything about yourself.  You are protected under Canadian Law from such actions.

They appear to be buying numbers in various Provinces to facilitate their desires of getting in touch with people, and at no point during the conversations do they use a last name, yours or theirs.  They want the call to sound as if they know you personally, this is not the case.  Remember you are protected under the law from this sort of action / harassment.  Collection Agencies have to work within strict regulations.

The above is a Supreme Court of Canada Ruling on a similar situation, Short version and then Long Version.  Always pays to do you research, don't acknowledge the debt and don't acknowledge who you are to them.  Better yet if you don't know the number don't answer the call.  If you get caught tell them to call your lawyer, they won't.

This number keeps calling and won't stop. The first couple of times I answered there was no one on the other end. Now I pick up and don't say anything and someone keeps saying hello. I just hang up now and don't say anything. Pick up and hang up. If you want to be annoying I can be too.
