Debt Collector
i actually work in collections myself and i understand that some rules are bent sometimes. the f.d.c.p.a is way over the top and most people are so used to debt that they dont even care about the calls and hang up as soon as i begin to identify myself. its sad that people wont reasonably speak about these matters, actually, most people jump through hoops to avoid paying bills they know they owe and 95% of the people in debt i speak with lie to me.
that being said, what i heard about this company and their tactics and what they use and things they say on the phone to people in debt and to myself when i called is absolutely disgusting. the story i heard almost brought tears to my eyes and i am doing everything i can to take this company out of business. the woman they ripped off i have had contacting the authorities and we are in the process of locating them. i believe they are a criminal scam operating somewhere in the middle east, possibly india. they dont actually have accounts that they are entitled to collect on they have just somehow found a way to gain access to actual debts owed and try to get the money themselves. they all have accents, they all lie and everything i heard about them makes me sick. i was told they were taking every penny from this single mothers weekly paychecks, verbally abusing her, and worst of all on the day of a family members funeral they called her from caller id "911" to tell her she was going to jail because she was a few hours late on a payment. they can make their caller id look like anything, they will say anything, they are not real collectors, this is a total scam and they belong in jail. when i finally got somebody there on the phone and tried to get to the bottom of why they were doing this they told me they were the f.b.i and were cursing at me and using phrases i cant even repeat here. PLEASE NOBODY PAY THESE LUNATIC CRIMINALS. IF THEY CONTACT YOU CONTACT THE POLICE IMMEDIATELY. they give real collectors that are just trying to make enough money to get by like myself a horrible name.

******SCAM******  I received a call telling me that I owed almost $500.00 to payday lender and papers were going to be filed at the courthouse. They threatened to shop up ay my place of employment and serve a warrant for my arrest. Other than my name, I did not confirm or deny any personal information. They spoke broken English. I was transfer 2 or 3 times and an atty Sean(sp) Williams with a local law Firm of based out of Sulphur Springs TX was handling my case. They threatened that if taken to court, I could be fired, I would have to $9,000.00 in court costs but they would settle with me for $500.00. The catch was I had to pay them that day. I asked them to call me back the following day.  I ran a search through texas.statelawyers.com and used white pages.com and yellowpages.com. The law firm was not listed in either place. Also I downloaded an app that allowed me to record the phone conversation when they called back. They called back I told them I was recording the call. I had them give me the name of the firm, their contact info etc. I informed them I did not owe this money and I would turn my recorded conversation over to the DA's pffice. This was 10 days ago they have stopped calling.

THIS IS A SCAM. THESE PEOPLE ARE IN INDIA. People that have applied online for a payday loan, did so on a fraudulent website. Do not send these people any money. The call you and try to extort money by threatening to contact your employer. Unfortunately you gave them all of your information when you filled out the online application. Do not fall for this. The FBI as a bulletin posted http://www.fbi.gov/news/pressrel/press-releases/paydayloanscam_120710

>>> They said 'dont disregard the call.  If I do not call them back or they do not hear from my attorney the only thing they can do os wish you good luck as the situation unfolds on me' <<<

This sounds very much like the highly stilted English that is often read off a written script by people at Indian call centers.

I suggest that you do a Google(R) search for the last phrase or two, verbatim, that he said to you.

Ultimately, only you can take the responsibility of deciding whether to call back or have an attorney call them back, as nobody here is going to give you legal advice based on your sketchy information.  And nobody knows what state you are in, so even if there was someone willing to give you legal advice here, he could get into very serious trouble for practicing in your state without a license.  But my money would be riding on the caller being a scum of the earth criminal extortionist, not a legitimate debt collector.

This is a criminal extortion scam operating out of India. They are making the calls utilizing VOIP and the names of legitimate firms to make it appear the calls are originating from within the US. There is NO "company" or "debt" and you will NOT be arrested. They are harvesting and/or buying consumers' personal identifying information and you need to do whatever you can to protect yourself. This includes: Notifying the FTC: https://www.ftccomplaintassistant.gov/, placing fraud alerts with all three credit bureaus, notifying your bank and employer and letting these criminals know you are aware they are attempting to extort money for a non-existent debt and have alerted the authorities.

ABC News released an investigative report on this scam a year ago:

got the same phone call as everyone else.  "Daniel" was representing an attorney's office. said I would be arrested at my place of employment on this coming Friday  from not paying a payday loan I never asked for.  I told him that his call was bogus, and that I would be contacting my states attorney general.  by the way, this happened to me last year also.

The same thing that happened to those above happened to me...the 903-945-7976 called my cell phone & work phone each twice yesterday and said if I don't return the call the only thing he can do is wish me good luck as the situation unfolds on me.  He wanted me or my attorney to call back.  Very scary.  If the calls continue I will be filing a report.

They indicated I filed for a loan and didnt accept it and now I owe them money. They asked me did I have a lawyer and wanted my lawyer name. They also wanted me to confirm my personal info over the phone. It was kind of scary. I blocked them. now they are calling my job harrassing my supervisor and now there calling me from another number 321-329-5868. Its so strange.

Most likely a spoofed number.

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

  This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

I got calls from them today saying if I don't send them 800 dollars through a green dot voucher through Walmart the police will come and arrest me and I will be charged with a criminal charge. I called the local police and they informed me that its a scam and I had to file a police report as well. The police said that  people don't get arrested for not paying a payday loan it goes to collection first. I also called the district attorney and they also said we don't ever call and say we are going to arrest you and you have to pay money today. There is an article on the http://www.fbi.gov/news/pressrel/press-releases/paydayloanscam_120710 that talks about what they are doing. The person said they were from a lawyers office and they represent  US Cash Lending. The person said his name was Robert Smith but he had an Indian accent.
